AR23001?1 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1399 - HAMM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a request for Recorded Exemption No. 1399, submitted by Robert Hamm for property which is located in part of the SE* of Section 12, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 23 acres and 57 acres. WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. 2. It is the opinion of the Board that adequate access to the proposed lot does not exist. 3. The Board feels an 1,850 foot long easement does not represent efficient and orderly development. 4. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption #1399, submitted by Robert Hamm, be, and hereby is, denied. The parcel of land is described as part of the SE4 of Section 12, T6N, R67W of the 6th P.M. Weld County, Colorado. The property is located approximately 3 miles northeast of the Town of Windsor; west of Weld County Road 25 and approximately 1320 feet north of Weld County Road 70. The applicant proposes to use North Weld County Water District for a domestic water supply. Individual septic systems will provide sewage disposal. The Department of Planning Services' staff has concerns about this proposed division. The applicant proposes to split off 23 acres on the west side of this parcel leaving a 57 acre tract on the east side. The 23 acre parcel would have access to Weld County Road 25 by means of a 30 foot access easement. It is the opinion of the staff that an 1,850' long easement for access to a building site does not represent efficient and orderly development. The applicant has stated in the application materials that the proposed 23 acre parcel is difficult to irrigate and therefore less productive than the balance of the property. This is the primary reason for this request. The staff does not argue this point, but there is evidence to show that the parcel has historically been irrigated. In a telephone conversation, an authorized agent for the applicant indicated that the entire parcel has been irrigated for approximately the last 3 years. Aerial photographs from the accessor's office also demonstrate that prior to 1970, the property was in irrigated crop production. It is the opinion of the staff that the applicant has not adequately documented how this proposal is consistent with the Weld County Comprehensive Plan. The 57.707 ac will continue to be used as agriculture. The reason for splitting that portion off the total acreage of 81 .047 is that the new parcel slopes excessively to the west, thus making it dificult to irrigate for agri- cultural purposes. After seeding the new parcel for dry land pasture it will be sold for the enjoyment of a single family while at the same time the balance of the agricultural land will be more efficiently utilized with the extra irri- gation water that has turned out to be a waste in past years. 5) This proposal is consistent with the policies of the Weld County Comprehensive plan and will enhance the piuductivity of the property. 6) Statement - intent of the district: This property is an agricultural zoned area and the split remains consistent with agricultural zoning. 7) The uses on the new parcel will be for horses or farm animals while the balance of the property will remain as irrigated agriculture land. This is consistent with the pasture and agricultured land that surround the property. 8) Statement of compatibility with surrounding land use: The sur- rounding land uses is irrigated farm land and pasture land which is consistent with the pasture land that is proposed on the property slated for the exemptions. 9) The proposal will not be inconsistent with efficient and orderly development.
