RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST CERTAIN PARTIES FOR VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Donald and Diane Stienmetz, VI #2018, Danny, Willard, and Viola Miller, VI #2023, Edwin Wiedeman, VI #2015, and R. K. and Doris Sittingdown, VI #1991, are alledgedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matters, the violations have not been corrected, and WHEREAS, on the 8th day of March, 1994, a public hearing was held before the Board of County Commissioners for the purpose of hearing any testimony relating to said violations, and WHEREAS, Donald Stienmetz, R. K. Sittingdown, Mark Geil, representing the Millers, and Mark Miller, representing Edwin Wiedeman, were present, and WHEREAS, at said hearing the Board of County Commissioners delayed referral of said violations to the Weld County Attorney's Office for a period of sixty days to allow adequate time for property owners to bring subject properties into compliance, and WHEREAS, the Board deems it advisable to proceed with legal action against the above named individual without further Board action if the subject properties are not brought into compliance within sixty days. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if said violations still exist on May 8, 1994, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Donald and Diane Stienmetz, Danny, Willard, and Viola Miller, Edwin Wiedeman, and R. It has always been, Mr. Wiedeman's intent to fully cooperate with your office in order to alleviate these concerns . Because of the drilling activities and the weather, however, it is necessary to extend the time within which to complete any remedial measures reasonably necessary to alleviate your concerns. • By way of brief, background, the storage of material and equipment at that site has been ongoing since the late 1940s or early 1950s, pre- dating your zoning resolution. Ironically, this seems to have come to your attention because of the efforts made by the oil and gas company to avoid negatiye impact upon the Arrowhead Subdivision by slant drilling under Arrowhead from this site on Mr. Wiedeman's property. It was necessary to push the stored material onto mounds to clear the drilling site for four different wells. It has always been Mr. wiedeman' s intent to replace that material to the same profile as preexisted the drilling. Frost, ice, and mud prevents doing that until spring. Sr. Wiedeman is willing to work with your office to establish reasonably guidelines to alleviate your concerns. Of course, those guidelines must be consistent with Mr. Wiedeman's rights, including the rights to maintain this use under law and your zoning ordinance.
