HomeMy WebLinkAbout940078.tiff RESOLUTION RE: APPROVAL OF SERVICE PLAN - THOMPSON RIVERS PARK AND RECREATION DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 32-1-204, CRS, as amended, a Service Plan concerning the proposed Thompson Rivers Park and Recreation District was filed with the Weld County Board of County Commissioners, and WHEREAS, pursuant to Section 32-1-108, CRS, as amended, the Board of County Commissioners scheduled a public hearing on the Service Plan to be held at 10:00 a.m. on January 12, 1994, and WHEREAS, notice of the date, time and location and purpose of said hearing was duly published in the Windsor Beacon, the County legal newspaper, on December 23, and 30, 1993, and January 6, 1994; notice was provided to the Division of Local Affairs of the name and type of the proposed District; and notice of the date, time and location of said hearing was provided to the Petitioners, to the governing body of each municipality and of each special district which had levied an ad valorem tax within the next preceding tax year and which had boundaries within a rad?us of three (3) miles of the District, and to said Division, as required by Sections 32-1-202(1) and 32-1-204(1) , CRS, as amended, and to the Weld County Planning Commission as required by Section 32-1-204, CRS, as amended, and WHEREAS, the Weld County Planning Commission studied and considered the Service Plan at its meeting on December 7, 1993, at which time said Commission adopted a Resolution recommending approval of the Service Plan for various reasons as more specifically stated therein, which recommendation was subsequently presented to the Board of County Commissioners at its hearing on this matter by a representative of said Commission, as required by Section 32-1-204(2) , CRS, as amended, and WHEREAS, the Board did, on January 12, 1994, conduct a full public hearing on this matter, taking evidence establishing the jurisdiction of the Board to hear this matter and further taking evidence regarding the substantive issues set forth in Section 32-1-203, CRS, as amended, at which hearing all interested parties were afforded an opportunity to be heard, and WHEREAS, the Board fully considered the Service Plan and all testimony and other evidence presented to it in this matter relating to said Service Plan, including the favorable recommendation of the County Department of Planning Services, and WHEREAS, the Board, after consideration, finds that the Service Plan and the evidence and testimony presented to the Board meets the criteria contained within Section 32-1-203, CRS, as amended, and WHEREAS, no written requests for exclusion were submitted to the Board, and 940078 RE: SERVICE PLAN - THOMPSON RIVERS PARK AND RECREATION DISTRICT PAGE 2 WHEREAS, no tract of land more than forty acres used primarily and zoned for agriculture is to be included within the District without the expressed consent of the property owner, pursuant to Section 32-1-307, CRS, as amended, and WHEREAS, the District is not currently proposing any construction of the type listed in Section 32-1-1005(1) (b), CRS, as amended, but will require notice and hearing before this Board before constructing, owning, or operating such facilities under Section 32-1-1005(2) (a) , CRS, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that: Section 1. The Board hereby determines that all of the jurisdictional and other requirements of Sections 32-1-202 and 32-1-204, CRS, as amended, have been fulfilled, including those relating to the filing and form of the Service Plan, the form and publication of the public notice of the hearing on the Service Plan and the type of public hearing held herein, and that, pursuant to Section 32-1- 204(1.5) the petitioners did give proper and timely postcard notification of the hearing to the property owners within the district. Section 2. The Weld County Planning Commission has considered this matter as required by law and has recommended approval of the Service Plan. Section 3. Based upon the information contained within the Service Plan and evidence presented to the Board at the hearing, the Board hereby finds and determines as follows: a. There is sufficient existing and projected need for organized services of the nature proposed in the Service Plan in the area to be serviced by the proposed District; b. The existing services in the area to be served by the proposed District are inadequate for present and projected needs; c. The proposed District is capable of providing economical and sufficient services to the area within its proposed boundaries; d. At this time, it is not anticipated that the District will incur indebtedness; e. Adequate services are not and will not be available to the area through Weld County, or other municipal or quasi-municipal corporations, including special districts, within a reasonable time and on a comparable basis; f. The facilities and service standards of the proposed District are or will be compatible with the facilities and service standards of Weld County and of each municipality and special district which is an interested party hereto; 940078 RE: SERVICE PLAN - THOMPSON RIVERS PARK AND RECREATION DISTRICT PAGE 3 g. The Service Plan is in substantial compliance with the Weld County Comprehensive Plan; and h. The creation of the proposed District will be in the best interest of the area proposed to be served. Section 4. The Service Plan of the proposed District, be, and hereby is, approved. Section 5. The Clerk to the Board be, and hereby is, directed to advise the Petitioners in writing of this action and to attach a certified copy of this Resolution for the purpose of filing the same with the District Court of Weld County. Section 6. All Resolutions, or parts hereof, in conflict with the provisions hereof, are hereby repealed to the extent of such conflict only. Section 7. This Resolution, immediately upon its passage, shall be authenticated by the signatures of the Board of County Commissioners and the Clerk to the Board and sealed with the corporate seal of the County. When I spoke at the hearing, I neglected to state my real estate ownership in Weld County, NW4 19-5-67 . My family has held real estate ownership in the County since prior to the 1920's. As stated, I graduated from Johnstown High School in 1949. During my senior year I was a substitute school bus driver, so I learned the district boundaries. My question to the commissioners was, "Who will vote on a tax inereas,? !". It is obvious the proponents weren't going to pay to meet the proposed budget. The question was appropriate as it was reported to us that there are exclusion features for some property owners. No one in the audience felt a clear answer was given as to which real property owners are eligible to vote. I felt inspired to comment on the obvious confusion on this matter for the following reasons: 1. An earlier hearing was adjourned because all. District RJ5 real property owners were not notified. 2. I had talked with several other district real property owners who were not notified of the January 12, 1994, meeting. 3. I have read the proponents ' service plan submission and the Colorado Statute 32-1-203(3.5) cited in the notice and find no reference to the exclusion the commissioners and their counsel referred to; i.e. , 50 acres (and over) are excluded from taxation. As a citizen and taxpayer, I respect and cherish the process of notifi- cation, information, and the right to question for clarification when my rights are involved. If my comments were out of order, I apologize. Even though the Commissioners approved the service plan, I, as well as several others in the hearing who caucused in the halls later, did nct hear: 1. The proposed district is anticipating one and one-half mills on the full assessed value of the district. Section 32-1-307 provides that all tracts of land over 40 acres are excluded without written consent of the owners thereof. Plus, oil and gas property owners can petition for exclusion, since they receive no benefit. The last two recreation districts have had the oil and gas owners request exclusion. Therefore, the district' s anticipated tax revenue should not count on any revenue from agricultural property or oil and gas property. With the above properties excluded, the property tax revenue would be $38,230 versus the $`2, 500. Respectfully submitted, 4 & .44v Wadas, Chairman Thompson Rivers Park and Recreation District Committee 940073 Part II - ( a ) PROPOSED THOMPSON RIVERS PARK AND RECREATION DISTRICT The proposed district boundaries would follow those of Re-5J School District except for the small area which is in Larimer County, thereby limiting the proposed district to Weld County. It will be composed of an area of about 58, 000 acres , a map and legal description may be found in Section D. A mill and one-half levy tax of the properties within its boundaries would establish r•. fundamental monetary base from which the district could operate more effectively. The recreation committee has determined the only way in which our communities can further expand and enhance our programs is through the establishment of a special park and recreation district , and the tax to be gained therefrom to finance the services . Currently, the recreation programs are for the most part organized, financed, and operated by the groups having an interest in that activity. These groups work with the recreation committee in finding coaches and managers , group buying of equipment , finding and scheduling playing fields and courts . As the system is set up, participant fees have been kept very minimal . Ths is to encourage the broad participation in the recreation program from a community area which has a large percentage of particm pants who may not have otherwise been able to participate . Because of the current system of fees and the desire for as many people to participate in the program, the recreation committee sees that to better maintain and promote new activities , a recreation director is needed to enhance the program. 31i0023 PART II - b PROPOSED THOMPSON. Secondly, there is need for expensive special equipment , such as batting practice machines , and special coaches brought in for specialized training seminars . Third, to improve the program, several projects need to be set in motion, such as transporation between the towns of Johnstown and Milliken , and to meets and games ; a daylight tournament sized softball field built on land purchased in Milliken, and upgrading of both Milliken and Johnstown fields. Fourth , maintain and improve the existing twenty year old swimming pool . Future plans would include the possible construction of a recreation facility containing classrooms , administration offices , and combination basketball and volleyball courts . Many of the above-described projects are projects which lay as far out as 10 years for completion . Presently, many projects are underway even with small resources . This year the Re-5J School Board was unable to finance and maintain repairs on the swimming pool facilities , and Johnstown and Milliken volunteers with financial assistance from the three governmental entities repaired the pool . It encompasses approximately 91 square miles , and within its boundaries are located the Towns of Jbhnstowi and Milliken . Johnstown and Milliken are Located on State Highways 60 and 257 , connecting to US 87 ( Interstate 25 ) and US 34 . The area of the proposed District is engaged primarily in agricultural activities , including irrigated farming, dh .irying , poultry raising, and stock feeding for packing plants . Tte major crops produced are sugarbeets, wheat, beans and corn. Livestock feeding is predominant within the area . Approximately 60 percent of the agricultural land is irrigated. Weld County has ranked high in agricultural production for many years . This agricultural empire with approximately 85 percent of its area devoted to irrigated and dryland farming and livestock raising, is ranked among the nation ' s leaders in agricultural production. There are approximately 33, 000 producing dairy cows in Weld County, and the County ranks second in the nation with the largest total number of livestock sold for market . The historically stable economy of the District is charging from predominately agricultural to a balance of agriculture - commerce and industry - mineral exploration and production . Former Great Western Sugar Refinery, located in Johnstown, has been pirchased by the Biotechnology Division of Adolph Coors Brewery Company, and has been renovated and expanded . Approximat:ley 150 new Coors employees are presently employed at the facility . An increase in oil and gas activity within the District it recent years has been evident , and has not only substantially raised the mineral tax base , but has also resulted in a number of oil and gas related service companies being in evidence in the District . Such prominent names as Amoco Production Company, Halliburton, Energy Minerals and Panhandle Eastern, lead the list of names of the companies which own, operate or service oil and gas properties the District . Some major employers , which are not within the boundaries of the District, but are nonetheless important to the local ecomony, arc the manufacturing concerns which are located nearby. Two of the most notable are Eastman Kodak which is located in Windsor and employs about 2 , 900 people and manufactures film, and Hewlett- Packard , a high-tech computer and precision instrument manufactur- ing firm located in Greeley, Loveland and Fort Collins . Electricity and natural gas service are availablc in the District through Public Service Company of Colorado. An adequate supply of natural gas is available to serve the loads. that may develop in th s area . This gas system is served primarily by two pipeline companies , Colorado Interstate Gas Company and Western Slope Gas Company, a wholly-owned subsidiary of Public Service Company of Colorado . 7A Part II - ( i ) ADDITIONAL INFORMATION Presently, the Johnstown-Milliken Recreation Program offers a wide variety of activities throughout the year for area residents of all ages . Activities include adult volleyball , men ' s basketball , boy ' s basketball , girl ' s softball , T-ball , youth soccer , swim lessons , swim team, track , tennis , youth football , plus many more . EXISTING FACILITIES BALL FIELDS: The Recreation Program currently has access to five ball fields and utilizes Milliken Middle School and Milliken Elementary School fields for its soccer program. GYMNASIUMS : All four school gyms in the Ile-5J District axe used, when available , during the course of the year for youth as well ai adult activities . TENNIS COURT: Two regulation size tennis courts are available ant are located at the Roosevelt High School in Johnstown . PARISH PARK: Located in Johnstown on Charlotte Street: and available for sand volleyball , a basketball court , as well as a shelter area for large or small group picnics . LOLA PARK: Located in Milliken on Irene Avenue . Has available for horseshoes , sand volleyball , as well as shelter area for larq_ or small group picnics .
