The Site Specific Development Plan and Sprial Review permit is for a major facility of a public utility (Dry Pit Gravel Mining) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of,Plamsing Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The open-cut grovel operation shall comply with Sections 64.4, 44.5, and 44.6 of the Veld County Zoning 0rdi..a-.re. 4. Fugitive dust shall be controlled on this site. 5. All liquid and solid castes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. The open-cut gravel mine shall be operated in compliance with the Air Pollution Control Division, Colorado Department of Health. and maintain any reamed emission permits. 7. No peraaneat dfspo*a1 of wastes shall be permitted at this site. 8. The maximum permissible seise level shall not exceed'the industrial limit of 80 db(A), as measured according to Section 25-12-102. C.R.S. 9. Any required NPDES Permit shall be maintained in compliance with the Water Quality Control Division of the Colorado Dep.ar ent of Health. 10. Adequate toilet facilities shell be provided for the employees. 11. An individual sewage disposal system is required for the proposed facility and the system shall be installed according to the Weld Canty Individual Sewage Disposal Regulations. 12. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility areea in a manner that will prevent nuisance conditions. 13. A parable water supply shall be provided for employee use. 14. All construction on the property shall be in accordance with the requirements of the Veld County Building Code Ordinance. 15. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the . Weld County Zoning 16. r The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Held County Zoning Ordnance. 17. Personal from the Wald County Health Department and Veld County Depa-tent of naming Services Shall be granted access onto the peupeL4' at say reasonable tine in order to ensure the activities carried out on the property comply with the Development Standards seated hereon and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or crated shall require the approval of an amendment of the Permit by the Wald County Planning Commission before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. lg. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Pernit by Weld Conty. EXHIBIT D Mining Plan - Mining is being and will be accomplished by surface earthmoving machines , primarily with a rubber-tired front-end loader dumping into tractor- trailer dump trucks. Extraction of the dry alluvial material will be less than 20,000 tons per year. Approximately two (2) acres of the site may be considered as a major disturbance area, including both the excavated area and the stockpile. The remainder of the area will either be undisturbed or only slightly disturbed. The mined area is above any ground water. Therefore, this would be considered a "dry pit" operation. Useable material is near the surface, with little or no overburden. It is relatively fine-grained, with 100% passing a 1" sieve. The meager topsoil, less than 6" thick, has been and will be pushed aside into small mounds by dozers and front-end loaders for future replacement. Current operations are taking place in Section 1 (same pastureland, just one section north) , File No. 81-286. EXHIBIT E Reclamation Plan - All stockpiled material will be removed from the site, or incorporated into the excavated area as part of the reclamation plan. As a large enough area is completed, the excavated area will be regraded to slopes flatter than four feet horizontal for each vertical foot. The finished area will be sloped to correspond to the natural drainage pattern of the surrounding area. The stockpiled topsoil will be placed uniformly on the graded surfaces at a thickness equal to the adjacent lands. In this case, less than 6" , using rubber-tired scrapers and blade graders. The finished surfaces will be seeded with grasses compatible to the area during the season, and at such rates as recommended by the Soil Conservation Service, and as detailed in Exhibit D. The reclamation plan will result in a return of the area to the equivalent use of the adjacent native pastureland. However, the performance and financial warranties must be approved by the Division or Board before a permit will be issued even if you receive an automatic approval .
