RESOLUTION
RE: APPROVE VACATION OF SPECIAL USE PERMIT #663 - JAMES AND NORMA CHITTENDEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution on April 17, 1985, the Board approved a Special Use
Permit for an agricultural recreational facility for James and Norma Chittenden,
and
WHEREAS, said permit was granted for property described as:
Part of the SE,' Section 32, Township 5 North, Range 64
West of the 6th P.M. , Weld County, Colorado
WHEREAS, Operation Standard #10 of said permits states:
"The Use by Special Review Permit shall not be
transferable to any successors in interest to the
described property and shall terminate automatically

operation of the facility."

[a WHEREAS, on April 12, 1993, said property was conveyed by James and Norma
Chittenden to Leeane Brenner, and

o a WHEREAS, after study and review, the Board deems it advisable to approve
ei W the vacation of Special Use Permit #663.
O NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
cxw County, Colorado, that Special Use Permit #663 for an agricultural recreational

Subject:
Operation Standard #10 for the abovementioned Use by Special Review indicates,
"The Use by Special Review permit shall not be transferable to any successors in
interest to the described property and shall terminate automatically upon
conveyance or lease of the property to others for operation of the facility. "
I have enclosed a warranty deed which shows the transfer of the property on which
this Use by Special Review was granted. On April 12, 1993, James R. and Norma
I. Chittenden conveyed the property to Leeane Brenner.
Planning Staff recommends USR-663 be vacated, based upon the conveyance of the
subject property and the Operation Standard which stipulates that a conveyance
automatically terminates the Use by Special Review permit.

OPERATION STANDARDS
James and Norma Chittenden
USR-663 85 : 1
1 . The uses permitted shall be an Agricultural Recreational
Facility as described in the application materials on file in
the office of the Department of Planning Services and subject
to the Operation Standards below.
2 . The maximum number of people allowed on the subject site at
any one time shall be two hundred (200) . .
3 . A three component sink with hot and cold running water and an
easily cleanable surface counter shall be installed at the
subject Use by Special Review site.
4 . Licensed security personnel shall be retained for dances,
birthday parties, family reunions, weddings, hayrides, indoor
or outdoor parties for all occasions, where the number of
people is in excess of 25 and where alcohol or beer is
present. In no instance shall the uses herein listed be open
to the general public. The operator shall require a written
agreement with the sponsor of each of the hereinabove listed
uses.
5 . Hours of operation shall be limited to 8 :00 a.m. to 10 :00
p.m. Sundays through Thursdays and 8 :00 a.m. to 12 :00
midnight Fridays and Saturdays .
6 . An identification sign shall be placed at the entrance to the
subject site. The sign shall be made of wood. It shall not
exceed sixteen (16) square feet in area. The sign shall
clearly identify the route to the subject Use by Special
Review site. A light shall be placed above or below the sign
so as to sufficiently illuminate the sign.
7. The applicant shall maintain the gravel easement from Weld
• County Road 50 to the applicants ' residence. The gravel base
shall be a minimum of two inches in thickness. The gravel
base shall be a Class VI aggregate base course.
8 . The applicant shall maintain a dust abatement program on the
access road from Weld County Road 50 to the applicants '
residence. Asphaltic emulsion, waste oil or commercially
available chemicals may be used to control dust. The
applicant is responsible for using materials and methods not
inotulsistent with tint, state or local law, rules or
• reyulatipns ' pertai/xiag to hazardous materials, health or'

9 All activities shall be be limited to the subject property,
the access easement a"-i public highways .
10 . The Use by Special Review Permit shall not be transferable to
any successors in interest to the described property and
shall terminate automatically upon conveyance or lease of the
property to others for operation of the facility.
' 11 . All litter shall be contained on the Use by Special Review
subject site . All litter associated with the Use by Special
Review shall be picked up daily.
12 . The applicant shall comply with the design standards for the
Use by Special Review, Section 24 . 5 et seq. , of the Weld
County Zoning Ordinance.
13 . The applicant shall comply with the Operation Standards for
Uses by Special Review, Section 24 . 6 et seq. , of the Weld
County Zoning Ordinance.
14 . Representatives or members of the Weld County Health eI
Department and Weld County Department of Planning Services
''shall 'be granted access onto the site at any reasonable time
in order to insure the operations carried out on the site
comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
15 . The Use by Special Review area shall be limited to the plans
shown,. hereon and governed by the Standards as stated above
and all applicable Weld County Regulations. Any material
deviations from the plans and/or Standards as shown or stated
above shall require the approval of an amendment of the
Permit by the. Weld County Planning Commission and the Board
of County Commissioners before such changes from the plans
and/br: Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services.
16 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated
Standards . Noncompliance with any of the above stated
Standards may be reason for revocation of the Permit by the
Board of County Commissioners .
