HomeMy WebLinkAbout920505.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING REQUEST FROM COTTONWOOD WATER SKI CLUB, LTD. , C/O LARRY E. O'BRIAN TO SCHEDULE APPLICATIONS FOR A CHANGE OF ZONE AND TWO SPECIAL REVIEW PERMITS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has received a request from Cottonwood Water Ski Club, Ltd, c/o Larry E. O'Brian to schedule applications for hearings on July 13, 1992, for a Change of Zone from I-3 (Industrial) to A (Agricultural) ; a Special Review Permit for an open-cut gravel mining operation in the A (Agricultural) Zone District; and a Special Review Permit for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District, or as an alternative, to permit water skiing as a use until the hearings could be concluded, and WHEREAS, said property is described as part of the NW* SEy and SW* SE'-* of Section 30, Township 1 North, Range 66 West of the P.M. , Weld County, Colorado, and WHEREAS, after study and review the Board deems it advisable to permit water skiing as a use until the hearings could be concluded, with the hearing date to be set as July 22, 1992, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the water skiing be, and hereby is, permitted as a use until the above mentioned hearings for Cottonwood Water ski Club, Ltd. , c/o Larry E. O'Brian, are concluded. BE IT FURTHER RESOLVED by the Board that the allowance of this temporary use shall in no way be considered as indicating an intent to approve the Special Review Permit for a water ski facility. Case Numbers Z-473, USR-968 and USR-969 On behalf of our Client, Cottonwood Water Ski Club, Ltd. , we wold like to make two requests of the Board of County Commissioners regarding the above referenced cases. The first one is for the Board to hear the three cases on Monday, July 13th, 1992 , instead of waiting for the next regular hearing date that is open, July 22nd, 1992 . I understand that under some circumstances the Board will hear a case on a day other, than a regular scheduled hearing. We feel this is one case when the Board may grant an exception. In addition the Planning Department suggested we ask the Board of County Commissioners for approval to use the lake for skiing until the hearings could be concluded. If this were approved then there would be no need to hold the special hearing on July 13th, since the Club could use the lake while waiting for the hearings later in July. Cons tiering these e ircumstrinccs: - -- was _ n.. h � property purchased by the Club for water skiing purposes in 1984 and until this year the lake was not big enough to ski on; any loss of use during the summer is hard on the owners. The temporary use approval would be the most fair, since as it is now the owners are denied use of their property. We feel the following information supports both requests and should be taken into account. 1. The Weld County Planning staff recommended approval of all three cases. 2 . The Weld Count Planning Commission voted, unanimously, to recommend approval of these cases to the Board of County Commissioners. 3 . There is no opposition to the Rezoning and Special Uses. 5. The very short time period each year when water skiing can be done. 6. Allowing water skiing in an Industrial Zone District would have less impact to the community that any Use By Right allowed. We would like these requests presented to the Board for their consideration.
