AR236b497 RESOLUTION RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY ARROWHEAD LOCAL IMPROVEMENT DISTRICT NO. 1993-1 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, in accordance with Section 30-20-607, Colorado Revised Statutes, as amended, a Statement of Expenses and Apportionment has been filed with the Weld County Clerk to the Board by the Weld County Engineer, which is attached hereto as Exhibit A, and WHEREAS, pursuant to Section 30-20-608, there has been proper notice of this hearing and of the costs of the improvements, and the share to be assessed to each lot, and WHEREAS, the Board of County Commissioners finds that the properties described herein, which includes all or portions of Arrowhead Subdivision, vacation and rededication of 1st Filing Arrowhead, recorded at Reception #1424095, filed December 19, 1963; 2nd Filing Arrowhead, recorded at Reception #1409349 on May 27, 1963; 3rd Filing Arrowhead, recorded at Reception #1424420 on December 23, 1963; and 4th Filing, recorded at Reception #1596868 on September 5, 1972, as replatted by Replat of Block 10, Arrowhead Subdivision, 4th Filing at Reception #02037407 on December 30, 1985, in part of Section 27, Township 5 North, Range 66 West, all in relation to the 6th P.M. in an unincorporated portion of Weld County, Colorado, in an area generally south of the existing city limits of Greeley and west of the existing city limits of Evans, have been specifically benefitted by the construction of the improvements authorized under the Resolution of February 17, 1993, and March 31, 1993, for the following reasons: A. The market value of each of the properties will increase; B. The proposed improvements will adapt the property to a more profitable use; C. The proposed improvements will facilitate access to the properties and thereby increase the convenience of use of said properties and will benefit parcels currently adjacent to paved roads by redirecting traffic onto more direct routes to other properties; D. There will be an alleviation of fugitive dust, eliminating the health hazards to the benefitted properties and to users of the public roads to be improved; and E. The alleviation of fugitive dust will reduce maintenance costs to the subject properties and paving will lessen the maintenance required for a public road. B 1419 REC 02366497 12/29/93 15 :28 $0. 00 1/018 F 1339 MARY ANN FEUERSTEIN CLERK & RECORDER WELD CO, CO 930955 RE: ASSESS COSTS - WELD COUNTY ARROWHEAD LOCAL IMPROVEMENT DISTRICT NO. 1993-1 PAGE 2 WHEREAS, copies of the resolution creating this local improvement district have been provided to the Division of Local Government and the Weld County Treasurer and Assessor, and WHEREAS, at the time and place set forth in the notice, the Board of County Commissioners met in open session for the purpose of hearing and considering any objections and protests that might be made against the proposed assessments by the following property owner: Virginia M. Williams, and WHEREAS, the Board has determined that the properties are benefitted in the amount of the assessments and that equity and justice do not require further modification or changes in the apportionment; therefore, the apportionment is confirmed, and WHEREAS, this resolution shall be prima facie evidence of the fact that the property assessed is benefitted, the amount of the assessment, and that the assessment has been lawfully levied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado: A. That a local improvement district for the construction and installation of street improvements, to include shaping, grading, drainage, preparation of the base and grading, compaction, and paving, together with any necessary incidentals on certain County roads as hereinafter described, was created and established in accordance with the laws of the State of Colorado, and is known as "Weld County Arrowhead Local Improvement District No. 1993-1. " All proceedings heretofore taken by the Board of County Commissioners and the County staff and then adopted in connection with the district are hereby ratified, approved and confirmed. This proposal to create said district was initiated by the Board of County Commissioners by Resolution of November 18, 1992, upon a petition, proper in form, subscribed by a majority of the owners of property who will bear the cost of more than one-half of the total proposed assessment in the district and notice duly given as heretofore stated. B. That the Statement of Expenses and Apportionment, attached hereto and incorporated herein by this reference as Exhibit A, has been submitted based upon the fact that there has been completion of the entire local improvement as previously authorized. D. That the assessment, as set forth in the attached Exhibit B, per lot or parcel being levied for the improvements shall be due and payable within thirty (30) days after the effective date of this assessing resolution. However, all such assessments may be paid at the election of the owner in ten (10) equal annual installments of principal together with installments of interest on unpaid installments at an interest rate of eight percent (8%) simple interest per annum. The first of said installments of assessment shall be due and payable at the same time as ad valorem property taxes for the year 1993, due and payable in 1994, and similarly in each successive year thereafter until all are paid in full. E. That cost of the improvements assessed to property within the district is $171,293.84. F. That the Clerk to the Board shall prepare a local assessment roll, in cooperation with the Weld County Treasurer and Accounting Department, in a form showing in suitable columns, each parcel of land assessed, the total amount of assessment, the amount of each installment of principal and interest if, in pursuance of Part 6 of Article 20 of Title 30, Colorado Revised Statutes, the same is payable in installments, and the date when each installment will become due, with suitable columns for use in case of payment of the whole amount or of any installment or penalty, and shall deliver the same, duly certified, under the County seal, to the County Treasurer for collection. That failure to pay the whole assessment prior to December 3, 1993, shall be a conclusive determination and held to be an election on the part of all persons interested, whether under disability or otherwise, to pay in such installments. All persons so electing to pay in installments shall be conclusively held and considered as consenting to said improvements. Said election shall be conclusively held and considered as a waiver of any right to question the power or jurisdiction of the County to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, the validity or correctness of the assessments, or the validity of the lien thereof. H. That failure to pay any installment, whether principal or interest, when due shall cause the whole of the unpaid principal to become due and collectible immediately, and the whole amount of the unpaid principal and accrued interest shall thereafter draw penalty interest at the rate of one percent per month from the first day of May until the day of payment, or until the day of sale. In computing the amount of penalty interest due under this section, any portion of a month shall be counted a whole month. I. That all resolutions or parts thereof in conflict with this resolution are hereby repealed, but all portions of the resolution indicating the intent to create the district not in conflict with the provisions of this resolution are re-enacted as if set forth herein. J. That the effective date of the resolution shall be November 3, 1993. Box 758 Greeley, CO 80632 Re: Arrowhead Local Improvement Docket No. 93-01 Dear Sir: In reference to your Docket 93-01, I am filing a written objection to the paving which was done at Arrowhead, because I live at : 5035 Arrowhead Drive which has paved streets coming into Arrowhead and paved streets in front of my home. 1 do not feel the paving has done any good in my area, in fact, the areas that are now paved which goes past my place to the end of Arrowhead Drive has became a speed trap for motorists and we do not feel safe riding our horses anymore because of this. Also, new residents that have build in the area were familiar with the streets when they build or purchased homes and knew it is a country area, why do we have to pay for pavement for them when they knew they were moving to a country area with dirt road? Many of the new residents allow their children to run up and down the roads with three-wheelers, which is not safe, and certainly do not feel the pavement has justified anything for me. Further, my situation is: me and my spouse purchased our home in October, of 1990 to live in the country and away from noise in town, however, I had the unfortunate situation happen on April 2, 1991 only a few months after we purchased our home, when my husband, Richard L. Williams passed away in our residence of a fatal heart attack. I am not in the situation to pay the $625.16 since I am a widow and am on a fixed income trying to work, make my house payments, etc. and trying to survive. I do not feel this was a necessary job which was done and since I already have pavement by my home, why do I have to pay for the "Yuppies" who have moved in the area and can jog everyday on paved streets which could have been left the way they were. AMENDED NOT I C E Docket No. 93-01 OF A PROPOSITION TO CREATE A LOCAL IMPROVEMENT DISTRICT IN WELD COUNTY, COLORADO, TO BE KNOWN AS WELD COUNTY ARROWHEAD LOCAL IMPROVEMENT DISTRICT NO. 1993-1, FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING STREET IMPROVEMENTS TO INCLUDE COMPACTION, GRADING, AND PAVING, TOGETHER WITH ANY NECESSARY INCIDENTALS, TO CERTAIN ROADS THEREIN, AND OF A PUBLIC HEARING THEREON. All owners of real estate and property hereinafter described and all persons generally, are hereby notified that the Board of County Commissioners of Weld County, Colorado, has adopted a Resolution declaring its intent to create a local improvement district within an unincorporated area of Weld County, Colorado, to be designated as Weld County Arrowhead Local Improvement District No. 1993-1, for the purpose of constructing and installing street improvements to include compaction, grading, and paving, together with any necessary incidentals, and to assess the cost of said improvements as proposed by petition of owners of the property who would bear more than one-half of the total proposed assessment within the district, all in accordance with the laws of the State of Colorado. 1. All persons are further notified that the kind of improvements proposed and the streets to be improved are as follows: Cheyenne Drive, Pawnee Drive, Kiowa Drive, Ute Drive, and part of Arrowhead Drive, which are the unpaved roads in Arrowhead Subdivision, Filings 1 through 4. The improvements include shaping, grading, draining, and paving the above described roads. The major construction quantities consist of 4, 181 tons of hot bituminous pavement. 2. The area to be included within the district includes all of Arrowhead Subdivision, vacation and rededication of 1st Filing Arrowhead, recorded at Reception #1424095, filed December 19, 1963; 2nd Filing Arrowhead, recorded at Reception #1409340 on May 27, 1963; 3rd Filing Arrowhead, recorded at Reception #1424420 on December 23, 1963; and 4th Filing, recorded at Reception #1596868 on September 5, 1972, as replatted by Replat of Block 10, Arrowhead Subdivision, 4th Filing at Reception #02037407 on December 30, 1985, in part of Section 27, Township 5 North, Range 66 West, all in relation to the 6th P.M. in an unincorporated portion of Weld County, Colorado. The District shall also include the rights-of-way of the County roads described herein. 3. The assessment for said improvements may be paid in ten (10) equal annual installments of principal with installments of interest on unpaid installments at an interest rate of eight percent (8%) simple interest per annum. 4. The assessment will be due and payable without demand within thirty (30) days from and after the final publication of a Resolution assessing the cost of said improvements, against the real property described herein in Paragraph 2. In the event any assessment against his or her property is not paid within said thirty (30) days, then the whole cost of the assessment against such property shall be payable in not more than ten (10) equal, annual installments of principal with interest on the unpaid installments, as aforesaid. The first of such installments shall be due and payable at such time as may be determined in and by the assessing Resolution and the remainder of said installments shall be due and payable successively on the same day in each year thereafter, unless otherwise determined by the Board of County Commissioners, until they are paid in full. 5. As shown by the estimates of the Weld County Engineer, the total cost of the street improvements to be assessed against the property within the district is estimated not to exceed $1, 310 for the 111 lots that are currently adjacent to unpaved roads; and $655 (one- half assessment) for the 52 lots that are not currently adjacent to unpaved roads. This represents an estimate of the cost of the labor and materials for installation by contract of the hot bituminous pavement and base preparation. The Board of County Commissioners, pursuant to Section 30-20-606, Colorado Revised Statutes, has preliminarily found and determined that each and every describecbUo, in rr- TxhL- , r or parcel ,.ill specifically benefit from the proposed improvements based on the following facts: A. The market value of each of the properties will increase; B. The proposed improvements will adapt the property to a more profitable use; C. There will be an alleviation of fugitive dust, eliminating the health hazards to the benefitted properties and to users of the public roads to be improved; D. The alleviation of fugitive dust will reduce maintenance costs to the subject properties and paving will lessen the maintenance required for a public road; and E. The proposed improvements will facilitate access to each of the properties and thereby increase the convenience of the use of said property. Based on the findings and determinations of the Board of County Commissioners, it is intended that all of the costs of the street improvements will be assessed equally against all of the above described lots, parcels, and tracts. Property owners are specifically referred to the schedule of estimated proposed assessments on file in the Office of the Clerk to the Board from which the approximate amount to be assessed against any particular lot, tract, or parcel of property may be determined, but further it is stated that the approximate cost per lot is $1,310 for the 111 lots that are adjacent to unpaved roads, and $655 (one- half assessment) for the 52 lots that are not adjacent to unpaved roads, based upon the Engineer's cost estimate. THESE COSTS ARE ESTIMATES ONLY. THE ACTUAL COST MAY BE HIGHER OR LOWER, DEPENDING UPON THE FINAL OVERALL COST OF THE PROJECT. IT IS NOT ANTICIPATED THAT PAVING SHOULD OR WILL REQUIRE RELOCATION OF GAS TRANSMISSION LINES WITHIN OR ALONG SIDE PUBLIC RIGHTS-OF-WAY. All owners of real estate and property hereinafter described and all persons generally, are hereby notified that the Board of County Commissioners of Weld County, Colorado, has adopted a Resolution declaring its intent to create a local improvement district within an unincorporated area of Weld County, Colorado, to be designated as Weld County Arrowhead Local Improvement District No. 1993-1, for the purpose of constructing and installing street improvements to include compaction, grading, and paving, together with any necessary incidentals, and to assess the cost of said improvements as proposed by petition of owners of the property who would bear more than one-half of the total proposed assessment within the district, all in accordance with the laws of the State of Colorado. 1. All persons are further notified that the kind of improvements proposed and the streets to be improved are as follows: Cheyenne Drive, Pawnee Drive, Kiowa Drive, Ute Drive, and part of Arrowhead Drive, which are the unpaved roads in Arrowhead Subdivision, Filings 1 through 4. The improvements include shaping, grading, draining, and paving the above described roads. The major construction quantities consist of 4, 181 tons of hot bituminous pavement. 2. The area to be included within the district includes all of Arrowhead Subdivision, vacation and rededication of 1st Filing Arrowhead, recorded at Reception 01424095, filed December 19, 1963; 2nd Filing Arrowhead, recorded at Reception 111409340 on May 27, 1963; 3rd Filing Arrowhead, recorded at Reception 01424420 on December 23, 1963; and 4th Filing, recorded at Reception 01596868 on September 5, 1972, as replatted by Replat of Block 10, Arrowhead Subdivision, 4th Filing at Reception 002037407 on December 30, 1985, in part of Section 27, Township 5 North, Range 66 West, all in relation to the 6th P.M. in an unincorporated portion of Weld County, Colorado. The District shall also include the rights-of-way of the County roads described herein. 3. The assessment for said improvements may be paid in ten (10) equal annual installments of principal with installments of interest on unpaid installments at an interest rate of eight percent (8%) simple interest per annum. 4. The assessment will be due and payable without demand within thirty (30) days from and after the final publication of a Resolution assessing the cost of said improvements, against the real property described herein in Paragraph 2. In the event any assessment against his or her property is not paid within said thirty (30) days, then the whole cost of the assessment against such property shall be payable in not more than ten (10) equal, annual installments of principal with interest on the unpaid installments, as aforesaid. The first of such installments shall be due and payable at such time as may be determined in and by the assessing Resolution and the remainder of said installments shall be due and payable successively on the same day in each year thereafter, unless otherwise determined by the Board of County Commissioners, until they are paid in full. 5. As shown by the estimates of the Weld County Engineer, the total cost of the street improvements to be assessed against the property within the district is estimated not to exceed $1,310 for the 111 lots that are currently adjacent to unpaved roads; and $655 (one- half assessment) for the 52 lots that are not currently adjacent to unpaved roads. This represents an estimate of the cost of the labor and materials for installation by contract of the hot bituminous pavement and base preparation. The Board of County Commissioners, pursuant to Section 30-20-606, Colorado Revised Statutesc. r-r preliminarily found and determined that each and every described lot or parcel will specifically benefit from the proposed improvements based on the following facts: A. The market value of each of the properties will increase; B. The proposed improvements will adapt the property to a more profitable use; C. There will be an alleviation of fugitive dust, eliminating the health hazards to the benefitted properties and to users of the public roads to be improved; D. The alleviation of fugitive dust will reduce maintenance costs to the subject properties and paving will lessen the maintenance required for a public road; and E. The proposed improvements will facilitate access to each of the properties and thereby increase the convenience of the use of said property. Based on the findings and determinations of the Board of County Commissioners, it is intended that all of the costs of the street improvements will be assessed equally against all of the above described lots, parcels, and tracts. Property owners are specifically referred to the schedule of estimated proposed assessments on file in the Office of the Clerk to the Board from which the approximate amount to be assessed against any particular lot, tract, or parcel of property may be determined, but further it is stated that the estimated cost per lot is $1,310 for the 111 lots that are adjacent to unpaved roads, and $655 (one- half assessment) for the 52 lots that are not adjacent to unpaved roads, based upon the Engineer's cost. Blehm, 5502 Ute Circle N Greeley, C.O. 80634-9302 SUBJECT: Comments on creation of a special district to pave the unpaved streets in Lake Arrowhead Subdivision I have asked that this commentary be delivered by courier to you on the date of the hearing for the consideration of creation of this special improvement district. I thank you in advance for your time and attention. My comments are simple and direct: 1. With the passage of Amendment 1, it is unlikely that extra funds will be available at any foreseeable time to accomplish this paving project without the special district. By evidence of the petitions before you, the residents have undertaken to shoulder this cost themselves. Given that paving will enhance the value and desirability of this area, and given that the value will enhance the net property values and taxable proceeds from this area, all persons benefit -- the residents and the government of Weld County. 2. Paving adds to the safety of the area relative to driving and operation of other motorized and non-motorized vehicles. 3. New construction standards for subdivisions require that streets be paved for reasons of value, maintenance, health and safety. This special district will allow an upgrade to near new standards for Lake Arrowhead at limited net cost to the government of the county. 4. Paving of these roads will not increase -- in fact it will likely decrease through reduced road grader operations -- the county costs to maintain the roads in Lake Arrowhead. 5. According to informal input fran real estate developers and agents, the net cost for paving of $665 to $1300 per lot would likely be recovered by current owners of lots in increased future value; in increased future marketability; and in increased future demand for these properties when they are sold. This increase in value will , according to professional real estate opinion, offset the current costs of paving. 6. Paving eliminates a current and increasingly bad fugitive dust and air pollution problem originating with the unpaved roads. With increased traffic due to increased occupancy and residency (over 30 lots have been sold and construction started or planned in the last two calendar years) , this dust and air pollution problem will not improve without paving. Creation of the special district is a net gain for everyone with the increased value likely to more than offset the current costs. It is in all of our best interests to approve and create this special district. THANK YOU. My main decision to move to Arrowhead was for the country atmosphere that was close to the city. The dirt roads are a natural part of that atmosphere together with the wide open space, horses, and the natural pastures. I feel that any attempt to "improve" the roads would seriously detract from the nature of the subdivision. The cost of such improvements would also be a burden for some of the property owners.
