HomeMy WebLinkAbout941000 RESOLUTION RE: ACTION OF THE BOARD REGARDING VIOLATION OF THE WELD COUNTY ZONING ORDINANCE - HINER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rex and Sharon Hiner, R.M. Hiner Construction Co. , Inc. , VI #2120, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, on the 11th day of October, 1994, a public hearing was held before the Board of County Commissioners, at which time Department of Planning Services staff requested this matter be continued for sixty days to allow property owners time to submit a Use by Special Review application, and WHEREAS, the Board deems it advisable to continue said matter for sixty days. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that this matter be, and hereby is, continued to December 13, 1994, at 10:00 a.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 11th day of October, A.D. , 1994. Dear Mr. and Mrs. Hiner. As of September 28, 1994, the above property remains in violation of the Weld County Zoning Ordinance. I have scheduled a hearing with the Board of County Commissioners on Tuesday, October 11, 1994, at 10:00 a.m. to consider this Zoning Violation. The property will be reinspected on October 10, 1994, to determine compliance and if the uses on the property are not in compliance at the time of the inspection, then the Zoning Violation will be considered by the Board of County Commissioners at the hearing. On August 11, 1994, I conducted a site visit with you. We drove around the subject property and discussed several items concerning the site, what constitutes a violation of the approved Special Use permit, and solutions for the violations. The first item we discussed was material storage within the 100 year floodplain. Section 53.7.1.2 of the Weld County Zoning Ordinance indicates, "any use which results in an alteration or relocation of a watercourse within the Floodprone districts shall apply for and receive approval of a Flood Hazard Overlay District Development Permit." To determine if material was stored within the Floodprone district, I utilized a copy of the plat for this case which was recorded August 8, 1989, and confirmed the location of the Floodprone district with Floodway map Community 11080266, Panel #0003, which was revised September 28, 1990. - The second issue we discussed concerns the oil and gas business operating from _ this site. The use of this site for an oil and gas support and service facility requires an amendment to the approved special use permit, because this use is not a use allowed by right in the A (Agricultural) zone district. We also talked about the water ski use on one of the on-site lakes. This use is classified as a recreational facility which also requires an amendment to the special use permit, because recreational facilities are not a use allowed by right in the A (Agricultural) zone district. As I understood from our discussions, the people using the lakes for waterskiing are not associated with the gravel mining operation. 941020 Rex Hiner August 23, 1994 Page 2 Finally, you indicated to me, a desire to keep the uses which are already approved, including gravel mining, and concrete and asphalt batch plants, and would like to add water skiing and an oil and gas support and service facility. To accomplish this, an amended special use permit could be applied for which would add both uses. The materials stored within the Floodprone areas on-site would either need to be removed, or a Flood Hazard Development permit would need to be applied for the materials. If you determine the materials which are stored on-site will remain, staff would need to evaluate whether the storage of materials at this site would constitute a material deviation from the Special Use permit which was approved in 1980. Staff would evaluate impacts to determine if an amended special use permit would be required for the material storage. Thanks for spending time with me on-site. Evidence was present that two land uses which were not specifically permitted by the Special Use permit are now being conducted on-site. Apparently, the lake created when Phase II was mined is being utilized by a water ski club. Two signs posted on the north property line, and slalom buoys indicate this. Additionally, the site had several trucks and materials stored upon it, which did not appear to be associated with the approved concrete and asphalt batch plants.
