RESOLUTION RE: APPROVE REQUEST TO VACATE A PORTION OF SPECIAL REVIEW PERMIT #386 AND CERTIFICATE OF DESIGNATION - COORS ENERGY COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated June 20, 1979, a Special Use Permit for open cut mining was granted to Adolph Coors Company, and WHEREAS, by Resolutions dated July 11, 1979, and December 19, 1979, said Special Use Permit was amended, and WHEREAS, by Resolutions dated April 15, 1987, an amendment of Use by Special Review for surface coal mining and ash disposal and a Certificate of Designation for ash disposal was granted to Coors Energy Company, and WHEREAS, said Permit and Certificate of Designation were granted for property described as: Part of Sections 25, 26, 35, and 36, all in Township 3 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, the Board has been presented with a request from Coors Energy Company that part of the Permit area be released and vacated from the Certificate of Designation, as displayed in the plat, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A", and WHEREAS, said matter was considered on March 24,, 1993, at which time the Board deemed it advisable to continue said matter to April 7, 1993, at 9:00 a.m, and WHEREAS, at said meeting of April 7, 1993, after study and review, the Board deemed it advisable to approve said vacation of a portion of Special Review Permit #386 and Certificate of Designation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Coors Energy Company to vacate a portion of Special Review Permit #386 and Certificate of Designation as hereinabove mentioned be, and hereby is, approved. On June 20, 1979, the Board of County Commissioners approved this Special Use Permit for an open cut mining permit for surface coal mining. The permit was amended in 1987 to allow ash disposal in the mined areas. On October 14, 1992, the Board of County Commissioners approved an application from Waste Services Company for a sanitary landfill. The approved area overlapped the approved area for the Coors ash disposal site. One of the conditions of approval for the sanitary landfill was that prior to beginning construction of the landfill site, the Coors permit must be amended to exclude the area permitted for the sanitary landfill. No part of the site which is proposed to be vacated has been used for coal mining or ash disposal activities. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASON: The area being vacated is not used as part of the Special Use Permit area for the coal mining and ash disposal facility. The area is dryland pasture and a portion of it has been approved as part of the permitted site for the sanitary landfill. The rest of the area to be vacated is a part of the buffer zone around the landfill. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. An amended Special Use Permit plat shall be submitted in compliance with the application requirements as listed in Section 24.7.4 of the Weld County Zoning Ordinance. 2. The plat shall be submitted to the Department of Planning Services within fifteen days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 3. Coors Energy Company subsequently obtained a Certificate of Designation for Ash Disposal within the mine permit boundary. STATEMENT OF REQUEST Coors Energy Company is requesting that part of the permit area be released and vacated from the Certificate of Designation . Attached is a plat which displays the entire permit area . The crosshatched area is the portion of the permit to be vacated .
