HomeMy WebLinkAbout940355.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ALLAN E. PEZOLT FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Allan E. Pezolt, BCV #2100, is allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of April, 1994, a public hearing was held before the Board of County Commissioners for the purpose of hearing any testimony relating to said violation, and WHEREAS, the property owner was neither present nor represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners delayed referral of said violation to the Weld County Attorney's Office for a period of thirty days to allow adequate time for the property owner to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff, and WHEREAS, the Board deems it advisable to proceed with legal action against the above named individual without further Board action if the subject property is not brought into compliance within thirty days. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if said violation still exists on May 12, 1994, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Allan E. Pezolt to remedy the violation of the Weld County Building Code Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. S. 3 AA/ E( 7 c o 7 - V- 2- & ,orcl7o <. - - C NOTICE The applicant, his agents and employees shall comply with all the rules, restrictions and requirements of Weld County Zoning Regulations and Weld County Buildings Codes governing location, construction and erection of the above proposed work for which the permit is granted. The Building Inspector or his agents are authorized to order the immediate cessation of construction at any time a violation of the codes or regulations appears to have occurred. Violation of any of the codes or regulations applicable may result in the revocation of this permit. Buildings MUST conform with plans, as submitted to the Department of Building Inspection. Any change of plans or layout must be approved prior to the changes being made. Any change in the used or occupancy of a building or structure must be'approved prior to proceeding with construction. The applicant is required to call for inspections at various stages of the construction, and in accordance with the aforesaid rule, the applicant shall give the Building Inspector not less than one day's notice to perform such activities. In the event construction is not commenced within 180 days of the issuance of this permit then the same is automatically void. Cessation of work for a period of 180 continuous days shall also cause this permit to be void. Weld County is not liable for workmanship. Permits are not transferrable. 940355 Hello
