RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL) TO P.U.D. (I-1 AND C-3 USES)
FOR JACK E. AND MARJORIE J. EDSON, CIO JAKE EDSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 1st day of June, 1992, at 9:00
a.m. for the purpose of hearing the application of Jack E. and Marjorie J. Edson,
c/o Jake Edson, 11623 Quivas Circle, Westminster, Colorado 80234, requesting a
Change of Zone from A (Agricultural) to P.U.D. (I-1 and C-3 uses) for a parcel
of land located on the following described real estate, to-wit:
Part of the NW* NW; Section 10, Township 2 North, Range
68 West of the 6th P.M. , Weld County, Colorado
WHEREAS, the applicant was represented by Vern Nelson, Nelson Engineers,
and
WHEREAS, Section 28.8 of the Weld County Zoning Ordinance provides
standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission, and, having been fully
informed, finds that this request shall be approved for the following reasons:
1. The applicant has complied with all the application requirements
listed in Section 28.5 et seq. , of the Weld County Zoning Ordinance.
2. The request is in conformance with Section 28.8 of the Weld County
Zoning Ordinance as follows:
a. The proposed Planned Unit Development (P.U.D. ) District is
located within the I-25 Mixed-Use Development (I-25 M.U.D. )
area. The uses associated with the proposed P.U.D. District
are consistent with the uses described in the I-25 M.U.D.
section of the Comprehensive Plan.
b. The uses allowed in the proposed P.U.D. District will conform
to the performance standards contained in Section 35.3 of the
Weld County Zoning Ordinance.
c. The P.U.D. District will be served by the Left Hand Water
District and the St. Vrain Sanitation District.
d. Access to the proposed P.U.D. District will be provided from
Weld County Road 7 in accordance with the memorandum, dated
March 26, 1992, from Drew Scheltinga, County Engineer.
e. The property is located in the Flood Hazard Overlay District.
No other overlay districts affect the site. The mining of

existing commercial mineral deposits on the site has been
determined to be economically unfeasible.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Jack E. and Marjorie J. Edson, c/o Jake
Edson, for a Change of Zone from A (Agricultural) to P.U.D. (I-1 and C-3 uses) ,
on the above referenced parcel of land be, and hereby is, granted subject to the
following conditions:
1. The Change of Zone plat shall be delivered to the Department of
Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The following notes shall be placed on the P.U.D. District plat:
a. Uses allowed within the P.U.D. District shall comply with uses
allowed in the I-1 (Industrial) and C-3 (Commercial) Districts
of the Zoning Ordinance, except that the following uses are
excluded from this P.U.D. District: retail outlets,
convenience stores, restaurants, drive-ins, auto service
stations, theaters, night clubs, taverns, car washes, and
entertainment establishments.
b. A site plan review is required in accordance with Section 35.4
of the Zoning Ordinance.
c. All streets within the P.U.D. District are private and shall
be built to County standards. All streets within the P.U.D.
District shall be maintained by the owners of the P.U.D.
District, unless other arrangements are approved by the Board
of County Commissioners.
d. Uses in the P.U.D. District involving outdoor storage of
vehicles, equipment, or materials shall be screened from
public rights-of-way and all adjacent properties.
e. The maximum building height shall be 48 feet.
f. The P.U.D. plan application shall include a stormwater
management plan and a detailed master drainage plan for the
P.U.D. District. All drainage plans submitted with a site
plan review application shall comply with the approved P.U.D.
stormwater management plan.
g. The P.U.D. plan application shall include a plan for signage
which complies with the mixed use development policies of the
Weld County Comprehensive Plan. All plans for signage
submitted with a site plan review application shall comply
with the approved P.U.D. plan for signage.

h. The property is located in the Flood Hazard Overlay District.
All uses and structures shall comply with the Weld County
Flood Hazard Overlay District requirements.
i. The P.U.D. plan application and all site plan review
applications shall comply with the requirements of the
December 16, 1991, letter from Mark A. Lawley, Division Chief
Prevention, Mountain View Fire Protection District.
j . The P.U.D. plan application and all site plan review
applications shall comply with the requirements of the
December 18, 1991, letter from Evan A. Hooper, Jr. , Colorado
Department of Transportation. No direct access shall be
permitted to Highway 119.
k. Sewer service shall be provided by the St. Vrain Sanitation
District.
1. Water service shall be provided by the Left Hand Water
District.
3. Prior to recording the P.U.D. District plat:
a. The six existing general notes on the P.U.D. District plat
shall be removed.
The above and foregoing Resolution was, on motion duly made and seconded,

The following business was transacted:
I hereby certify that pursuant to a notice dated April 27, 1992, and duly
published April 30, 1992, in the New News, a public hearing was conducted
to consider the request of Jack E. and Marjorie J. Edson, c/o Jake Edson,
for a Change of Zone from A (Agricultural) to P.U.D. (I-1 and C-3 uses) .
Lee Morrison, Assistant County Attorney, made this a matter of record.
Lanell Swanson, Planning Department representative, entered the favorable
recommendations of the Planning Commission and the Planning staff into the
record. Vern Nelson, Nelson Engineers, represented the applicant and
stated their intention is to develop an industrial park for trucking
distribution. He explained the proposed design structures and said the
high-traffic uses will be excluded from the final P.U.D. Mr. Nelson said
they are in compliance and they agree with Planning's recommendations and
conditions. He said one issue, which was resolved this morning, concerned
an agreement with Amoco for a 120' by 200' area at the southeast corner of
the property to accommodate Amoco. This area will include a 200' buffer
around it, which precludes building therein. Mr. Nelson presented a copy
of said agreement to Ms. Swanson and Mr. Morrison for the record.
Commissioner Lacy said that matter would be addressed in the final P.U.D.
stage. Ms. Swanson clarified, however, that it is one use on the
property. Commissioner Lacy said he feels the exclusion of the high-
traffic uses is very important, and he questioned whether the access to
Weld County Road 7 will be addressed in the final P.U.D. stage. Mr.
Morrison said it would be more appropriate to discuss said access at the
final stage. There was no public testimony offered concerning this
matter. Commissioner Lacy moved to approve the request of Jack E. and
Marjorie J. Edson, c/o Jake Edson, for a Change of Zone from A
(Agricultural) to P.U.D. (I-1 and C-3 uses) , based on the recommendations
of the Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record. The motion was seconded by
Commissioner Harbert, and it carried unanimously.

Pursuant to the zoning laws of the State of Colorado and the Weld County Zoning
Ordinance, a public hearing will be held in the Chambers of the Board of County
Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th
Street, First Floor, Greeley, Colorado, at the time specified. All persons in
any manner interested in the following proposed Change of Zone are requested to
attend and may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped record
which will be kept during the hearing, the Clerk to the Board's Office shall be

AGREEMENT
THIS AGREEMENT is made and entered into this 29th day of May,
1992 by and between Amoco Production Company ("Amoco") with an
office at 1670 Broadway, Denver, Colorado 80202 and Jack E. and
Marjorie J. Edson (the "Edsons") , whose address is 1482 Leisure
World, Mesa, Arizona 85206.
RECITALS
A. The Edsons own approximately 36 acres of the surface
estate in the NW/4 NW/4 of Section 10 , Township 2 North, Range 68
West, Weld County, Colorado (the "Premises") .
B. The Edsons intend to develop an industrial park
consisting of warehouses used for trucking distribution on the
Premises.
C. The plat attached to this Agreement as Attachment 1
reflects the lots for the proposed facilities on the Premises.
D. Amoco owns oil and gas leases pertaining to the right to
explore for, develop and produce oil and gas underlying the
Premises.
E. Current Colorado Oil and Gas Conservation Commission
rules and regulations allow the owner of the oil and gas rights
underlying the Premises to locate at least two drillsites on the
NW/4 NW/4 of Section 10, one to be located in approximately the
center of the quarter quarter section and one to be located in the
center of the quarter section.
NOW THEREFORE, in consideration of the covenants and the
mutual promises set forth herein, including the representations set
forth in the recitals, the parties agree as follows:
1. Drillsite Locations and Access
(a) Location in the Center of the NW/4 . With respect to one
or two wells that Amoco desires to drill in this
location, Amoco shall locate one or both drillsites for
the center of the NW/4 within the legal spacing location,
but no greater than 7,20 feet from the south line and no
greater than 200 feet from the east line in the extreme
southeast corner of the Premises (the "Drillsite
Location") as shown in the attached plat. In addition,
a buffer zone (the "Buffer Zone") shall exist for a
distance of 200 feet to the north and west of the
Drillsite Location. The Edsons shall not construct a
warehouse within the Buffer Zone or Drillsite Location.
(b) Location in the Center of the NW/4 NW/4 . Amoco shall
have the right and option to apply for a location
exception to this location. It will seek approval to

locate a Codell/Niobrara or Sussex/ Shannon well within
the location reserved in Paragraph 1 (a) , above. In the
event Amoco is not granted such location exception, the
parties shall negotiate in good faith to reach agreement
as to an acceptable drilling location.
(c) The Edsons shall either modify their rezoning application
to Weld County to remove the Drillsite Location or shall
request that Amoco shall retain its use by right for the
location and drilling of said wells.
2 . Access. Access to the Drillsite Location and easements for
roads and pipelines shall be at mutually acceptable locations
which are convenient to Amoco. Provided, however, Amoco shall
use its best efforts to access the Drillsite Location by the
existing road that borders the south line of the Premises.
Amoco shall have the right to the use of any and all roads
constructed by the Edsons, including the road shown as
Attachment 1 (the "Road") , for oil and gas operations;
provided, however, neither Amoco, nor the Edsons shall
unreasonably interfere with the use of the Road by any other
party. The Edsons shall require any third parties not to so
unreasonably interfere with Amoco' s use of the Road. Amoco
shall promptly repair any damage which it causes to the Road.
3 . Surface Damages. As consideration for the inconvenience to
Amoco of giving up its rights to drill the well in the center
of the NW/4 NW/4 , and in consideration for Amoco not objecting
to the Edsons ' application to Weld County to develop the
industrial park, the Edsons waive any rights they have to
surface damages for the wells which Amoco locates on the
described premises at locations other than the center of the
NW/4 NW/4 .
4 . Indemnification. Amoco and the Edsons (with the Edsons being
jointly and severally liable under this agreement) each agree
to defend, indemnify and hold the other harmless for injuries
to persons and damage to property caused by its own negligence
or willful misconduct or for claims for which it is strictly
liable.
5 . Successors and Assigns. This Agreement shall be binding upon
the successors and assigns of the parties and the benefits of
this Agreement shall inure to their successors and assigns.
6 . Entire Agreement. This Agreement represents the entire agree-
ment between the parties and supersedes any and all prior oral
or written agreements. This Agreement shall not be amended
except in writing signed by all parties.

Agricultural zone. Vern Nelson explained the property is not considered high
quality agricultural land. Jean Hoffman asked about the sand and gravel mining
in the area and what, if any, increase in traffic would be. Vern Nelson said the
sand and gravel pits in that area have been mined out, no active mining is taking
place.
The Chairman asked if there was anyone in the audience who wished to speak for

Thank you very much for sending the Edson PUD change of zone application to the City of
Longmont for our review and comment. The proposed PUD includes 35 acres± located at the
southeast corner of SH119 and WCR7. The applicant intends to have a mixed use commercial
and industrial development with outdoor storage.
The City of Longmont previously commented upon the sketch plan for this proposed PUD, and
I have attached a copy of those comments which discuss several concerns, e.g., transportation
access, location and screening of outdoor storage, landscaping, signage.
The information the applicant has submitted with the change of zone application does not provide
sufficient detail for the City to determine to what extent the applicant addresses our concerns.
The change of zone application materials indicate that the applicant will provide detailed
information as part of the PUD final plan application: the next stage of Weld County's PUD
process. Therefore, the City's previous comments remain, and we look forward to reviewing the
detailed information, particularly the private covenants, which should be part of the PUD final
plan application.

Thank you very much for sending the Edson PUD sketch plan to the City of Longmont for our
review and comment. The proposed PUD includes 35 acres± located at the southeast corner of
SH119 and WCR7. The applicant intends to have a mixed use commercial and light industrial
development located in an area that the conceptual land use plan for the I-25 Mixed Use
Development Area designates as "office." My understanding is that the Department of Planning
Services considers that these proposed land uses are consistent with the office land use
designation.
With the view of preserving the functional integrity of the adjacent road system, we question the
need and desirability for multiple access points to both SH119 and WCR7. The City assumes
that the Weld County Engineering Department and the Colorado Department of Transportation
will review whether one access point to WCR7 will provide adequate access. We also assume
that the covenants and/or plan documents will require access to the lots be taken directly from
the private street.
The City looks forward in the future to reviewing the covenants and architectural controls which
will control the open space, landscaping, architecture, and signage. The applicant may want to
consider providing some amenities to Outlot A so that it could be integrated into activities in the
development and used by employees and customers, e.g, picnic tables, benches.

The application states that there is going to be outdoor storage. We suggest that its location be
delineated on the plan at the appropriate stage of the PUD process, and that Weld County
consider limiting it to lots that neither front SH119 or WCR7. We also respectfully request that
Weld County consider requiring screening (whether landscaping, fencing, berming, or a
combination) along SH119 that is more effective at screening outdoor storage than we recently
have seen used elsewhere along SH119.

We have reviewed the application for the Edson P.U.D. and we have the
following comments:
Direct access to State Highway 119 from this development will not be allowed.
The highway has been designated as a "Category 2" highway in this area.
According to the State Highway Access Code, "Private direct access shall
not be permitted except when the property in question has no other reasonable
access to the general street system." The development, as proposed,
obviously has reasonable access to County Road 7. Further, the Code
specifies that "No additional access shall be provided upon the splitting
or dividing of existing parcels or contiguous parcels under the same
ownership or control . All access to the newly created properties shall
be provided internally from the existing access or a new access determined
by the permit application or subdivision procedures and be consistent with
the requirements of this code." Those Lots with frontage on the state
highway that are created by the P.U.D. will not be allowed direct access
to the highway at any time in the. future.
While the P.U.D. Sketch Plan Map indicates Outlet "A" as a Detention Pond
area, the developer must be reminded that the state highway drainage system
is for the protection of the state highway right of way. That drainage
system is not intended to accommodate drainage from abutting properties
beyond that which has historically been accepted. Therefore, the on site
detention of surface runoff must be provided so that the historical runoff
rate will not be exceeded due to the development.
Any landscaping within the highway as a result of the development must
be maintained by the adjacent private property owner and must not impair
sight distance at any highway access, must not present a safety hazard,
and must not unreasonably conflict with future highway expansion. New
trees are normally not permitted since they can be difficult to relocate.

Buildings on those Lots with highway frontage will be subject to traffic
noise that could exceed the standard residential or commercial design noise
level . To minimize this potential adverse impact, we recommend that the
buildings be located as far away from the highway as possible. Noise
insulation of the walls and double glazing on the windows exposed to the
highway should also be provided. If no measures are taken to mitigate
traffic noise impact, these properties may not qualify for a state funded
noise abatement project, if funds for such a project at this location were
to become available.

planned unit development is applied for. I have no objection, but would like
to point out some issues discussed at the sketch plan stage.
I expect improvements on Road 7 will be necessary because of the truck traffic
that will be generated by the zone change to I-1 and C-3 uses. I recommend one
entrance be allowed off Weld County Road 7. Also, at the PUD stage, an
additional 20' of right-of-way (for a total of 50' east of the section line)
be dedicated.

Dear Mr. Allison:
The Mountain View Fire Protection District has reviewed the sketch plan for the Edson PUD and
has no conflicts provided the following is done:
1.Fire hydrants be placed as noted on the site plan.
2. A required fire flow of 1,500 gpm with a residual pressure of 20psi be provided from each hydrant.
3. All roads must be a minimum of 20'unobstructed and be capable of supporting the imposed loads
of fire apparatus(60,0001bs). Roads also must be constructed with an all weather driving surface.
4. MI buildings will have to meet all the requirements of the Uniform Fire Code,which could possibly
include additional water, fire hydrants and fire sprinkler systems.This will depend on the construction
type and hazards of the buildings.
5. The Mountain View Fire Protection District has adopted a plans review and inspection fee. The entire
fee for the infrastructure of the PUD is payable at the start of construction of the first structure of the
PUD. The fee for the review completed so far is$200.00, which will be credited to the full fee at the
time it is paid.The$200.00 fee is not refundable whether the project continues or not.
I have included a copy of Resolution 9 t-2 which includes the fee schedule. In calculating the amount due
for the entire project, the cost of waterlines,hydrants and streets should be included. The cost of land
and architect's fees are not included.

Regulatory office.
During Mr. McKee's site visit, it was found that no wetlands
exist at this site.
This letter is to inform you that the proposed activity will
not require a Department of the Army (DA) Permit.
Although a DA Permit will not be required for the project,
this does not eliminate the requirement that other applicable
federal, state, and local permits be obtained as required.

1. The PUD district application forms and application fee.
The PUD District application forms and application fee of
$800 are attached.
2. A statement describing the proposed PUD Concept, land-use(s) ,
and architectural style of the PUD.
The 35 acre PUD will consist of C-3 (Commercial) and I-1
( Industrial) uses as listed in the Weld County Zoning
Ordinance.
Edson PUD will be governed by private covenants, which will
address architectural and design features of the development.
Items such as, screening, open storage, landscape require-
ments, maintenance, fencing and signs will be addressed in
the convenants at the PUD final plan application stage. In
general, the architectural style will provide for open space
interspersed with conventional buildings using building
materials mainly consisting of brick, wood, masonry and other
appropriate materials tastefully designed to be compatible
with the surroundings. Open storage can be located away from

and in rear of lot areas in order to utilize building
screening as well as fencing and/or tree and shrubbery. Open
storage will be tastefully designed to take advantage of the
topography and natural environment. All outside storage areas
shall be screened in accordance with Section 33.6.1. 9 of the
Zoning Ordinance.
It is the intent of the applicant to exclude certain uses
which are high traffic generators to the site. Such uses as
retail outlets, convenience stores , restaurants, drive-ins,
auto service stations , theaters, night clubs , taverns, car
washes , and entertainment establishments will be excluded as
uses in the covenants as developed for the final PUD.
3 . A statement which demonstrates the proposed PUD rezoning is
consistent with the policies of the Weld County Comprehensive
Plan.
The proposed land uses are consistent with the Weld County
Comprehensive Plan designation for Planned Unit Developments .
The site is in a Planned Unit Development Overlay District

known as the I-25 Mixed-Use Development Area and Activity
Center. Uses allowed within the PUD are intended to fall
within the Weld County Zoning classifications of C-3 and I-1.
The Department of Planning Services considers that these pro-
posed uses are consistent with the office land use designation
as addressed in the Conceptual Land Use Plan for the I-25 Mixed
use Development Area in the Weld County Comprehensive Plan.
4 . A statement which demonstrates how the USES allowed by the pro-
posed PUD rezoning will be compatible within the PUD district.
In addition, a detailed description of how any conflicts be-
tween land uses within the PUD district are being avoided or
mitigated and can comply with Section 35. 3 of the Weld County
Zonning Ordinance.
To insure compatibility of uses within the PUD, land uses that
are compatible or alike will be located adjacent to one
another. Therefore, no conflicts between land uses within the
PUD are anticipated. Design standards will be established
through architectural covenants and will specifically address
the Performance Standards outlined in Section 35 . 3 of the
Weld County Zoning Ordinance. The uses allowed within the
PUD will be limited to those allowed in the Weld County
Zoning Ordinance for C-3 and I-1 uses and as described in Para-
graph 2 .
There are no known unique natural features on the proposed
site, such as wildlife areas, wetlands, or vegetative cover.
5 . A statement which demonstrates how the USES allowed by the
proposed PUD rezoning will be compatible with land uses
surrounding the PUD district; in addition, a detailed des-
cription of how any conflicts between land uses surrounding
the PUD district are being avoided or mitigated.
Surrounding land uses adjacent to the property are agriculture
with a small amount of C-3 and C-4 zoning. Lands to the north-
west, west, south, east and northeast are all zoned agriculture.
Part of the site and some land adjacent to the south and east
and northwest are designated SUP and USR for purposes of
gravel mining, though some of the areas have not been mined
due to negative economic conditions. Adjacent to the northwest
corner on the site is a small tract of C-3 used for farm equip-
ment supply and a small tract of C-4 used as lounge and
restaurant. See vicinity map for specific locations .
Compatibility with surrounding land uses will be ensured by
the following:
a. The proposed uses are consistent with the Comprehensive
_ Plan designations with further limitations as described
in paragraph 2.

b. Architectural covenants will be established which provide
for design standards to ensure a compatible development.
c. Landscaping will be required in conjunction with the
development.
6. A description of each use within the PUD. A description of
all building, structures, and open storage areas, including
size, floor area, and height. A description of the type of
residential units within the PUD, including total number of
units for each type.
The PUD plan application will include detailed information
and covenants regulating signage, outdoor storage, and land-
scaping. Outdoor storage will be screened from Highway 119
and the balance of the PUD district as required by the Weld
County Zoning Regulations . Open space area will be required
with conventional buildings not exceeding 48 feet in height.
No residential units are planned for this PUD.
Covenants and architectural controls , which will be submitted
later, will govern the quality of this development . Building
materials will be compatible with the surroundings . Colors
will tend toward the natural to blend into the local environ-
ment. Signage will be limited to on-site, be unpretentious,
and be developed in accord with site codes. The average
density is 2. 9 acres per lot.
7 . A description of the size and type of any public and private
open space and semi-public uses, including parks, recreation
areas, school sites, fire and sheriff facilities, and similar
uses.
Private on-lot open space will be provided along Colorado
Highway 119 and Weld County Road 7 . Sizes of open space
will be dictated by actual uses described in the final PUD
plan. No public or semi-public uses are anticipated.
8 . A description of the water source and system and a statement
from the representative of the provider of the water system
which demonstrates that the water supply quality and quantity
is sufficient to meet the requirements of the uses within the
PUD district. A PUD district with residential USES shall be
served by a PUBLIC WATER system.
Water service for the PUD will be provided by the Left Hand
Water District (see attached statement) . The internal water
system will be developed consistent with the Fire Protection
District Regulations and approved by the Left Hand Water
District.
9. A description of the sewage disposal facility. If the faci-
lity is a sewer system, a statement from the representative

of the provider of the sewer system utility which demonstrates
that the sewer system will adequately serve the uses within
the PUD district.
_ Sanitary sewer service for the PUD will be provided by the
St. Vrain Sanitation District ( see attached statement) . The
collection system will be designed and installed consistent
with the regulations of the District.
10 . A description of the functional classification, width, and
structural capacity of the STREET and highway facilities
which provide access to the PUD district. If the street or
highway facilities providing access to the PUD district are
not adequate to meet the requirements of the proposed district
the applicant shall supply information which demonstrates the
willingness and financial capability to upgrade the STREET or
highway facilies in conformance with the Transporation Section
of the Weld County Comprehensive Plan. This shall be shown
by submitting, with the Planned Unit Development District
application, a separate off-site road improvements agreement
describing the proposed road improvements and method of
guaranteeing installation of said improvements in conformance
with the Weld County Policy on Collateral for Improvements.
The agreement shall be used for the purposes of review, evalua-
tion, and compliance with this section. No rezoning shall be
finally approved by the Board of County Commissioners until
the applicant has submitted an improvements agreement or con-
tract which sets forth the form of improvements and guarantees
and is approved by the Board of County Commissioners.
Weld County Road 7 , near its juncture with Colorado Highway
_ 119 , will provide access to the site. Colorado Highway 119
is designed and constructed to state standards for the current
and predicted uses and is functionally and structurally
adequate for the proposed PUD as well. Weld County Road 7 is
an asphalt paved roadway serving the neighborhood adequately.
When the final PUD is developed and traffic patterns and
impacts are determined, Weld County Road 7 will be analyzed
through site specific traffic studies to determine whether or
not it will be adequate or if new improvements are or will be
needed. A separate off-site road agreement describing the
improvements, method of installation , and the other appro-
priate guarantees from the developer of the PUD will be
developed all in conformance with the Weld County Policy on
Collateral for Improvements.
The actual design and specifications of the pavement for the
internal roadways will be determined after an extensive soil
study and testing of specific materials has been accomplished
at the PUD Final Plan stage .

11. A soil survey and study of the site proposed for the change
of zone with a statement regarding suitability of soils to
support all USES _allowed in the proposed zone. If the soils
survey and study indicate soils which present moderate or
sever limitations to the construction of STRUCTURES or faci-
lities on the site, the applicant shall submit information
which demonstrates that the limitations can be overcome.
This information will be forwarded to the Colorado Geological
Survey for evaluation.
The soils within the PUD are made up of two general types as
defined by the Soil Conservation Service soil survey of Weld
County southern part.
Aquolls and Aquepts Soils : deep, nearly level, poorly
drained soil formed in alluvium deposits.
Bankard Sandy Loam: deep, somewhat level, well drained,
on flood plains, and formed alluvial deposits. The soil
is stratified with thin lenses of sandy loam, loam, and
fine gravel.
This application is being accompanied by guideline excerpts
from the published "Soils Survey of Weld County, Colorado,
_ Southern Part" , developed by the United States Department of
Agriculture, Soil Conservation Services (SCS) . That report
reveals that the site has some limitations to construction
due to localized flooding. This area remains relatively wet
during the summer months due to poor drainage and a high
water table.
The soils show some restrictions that will have to be addres-
sed by site specific soil testing and report by a certified
soils engineer prior to development of each area of the final
PUD. These restrictions can be mitigated through detailed
subsurface soils investigations, application of appropriate
drainage facilities, and strict adherence to the recommenda-
tions of the soils report.
12. If, according to maps and other information available to Weld
County, the Department of Planning Services determines that
there appears to be a sand, gravel, or other mineral resources
on or under the subject property, the applicant shall provide
a mineral resourse statement prepared by a certified geologist
_ or other qualified expert. The statement shall indicate the
estimated quality of resources and indicate the economic feasi-
bility of recovery, now and in the future, of the resources so
that the Planning Commission and Board of County Commissioners
can determine whether a COMMERCIAL MINERAL DEPOSIT, as defined
in Colorado Revised Statues is contained on or under the sub-
ject properties. This information will be forwarded to the
Colorado Geological Survey for evaluation.

According to U. S. Soil Conservation Service maps , there
appears to be no evidence of commercial grade mineral or
gravel deposits underlying the site. In addition, there are
no records of mineral owners or lessees other than oil and
gas leases, for the subject property.
Borings have been accomplished to determine gravel resources
_ on the site. The results of that testing show an average
depth of 11 . 5 feet of gravel with an average depth of over-
burden of 3 feet. The ratio of mineable gravel to overburden
is 3. 8 to 1, a ratio somewhat higher than 3 to 1 that generally
describes a gravel mine to be of economic value. However,
the size of the parcel remaining after required setbacks in
combination with the marginal ratio of gravel to overburden
would render the gravel recovery uneconomic. Only about 26
acres are actually mineable after setbacks and excavation
slopes are honored, thereby rendering a full scale mining
operation most unlikely and generally uneconomic.
Oil and gas mineral rights are leased. It is the intent of
the applicant to obtain an agreement with the lessees for an
agreeable drill site, if necessary, that will be allocated on
the final PUD plat.
13 . If the proposed change of zone is located within a FLOOD
HAZARD AREA, identified by maps officially adopted by Weld
County, the applicant shall submit information which either
documents how the Weld County supplementary regulations con-
cerning flood plains have been satisfied or document how the
applicant intends to meet the requirements of the Weld County
supplementary regulations concerning flood plains.
The FEMA maps and information for this location have been
developed using USGS quadrangle topographic data and without
_ the benefit of drainage investigations or studies of the area.
Fortunately, however, unpublished floodplain information pre-
pared by the U.S. Corps of Engineers does provide floodplain
elevations for the 100-year flood boundary. These elevations
are nearly the same as the existing contours and will be re-
flected on the final PUD plan. The unpublished information
is available at the Colorado Water Conservation Office. The
completed structures will be constructed at elevations above
the floodplain elevations to satisfy surface drainage and
sanitary sewer needs.
14 . If the proposed change of zone is located within a GEOLOGIC
HAZARD AREA identified by maps officially adopted by Weld
County, the applicant shall submit information which either
documents how the Weld County supplementary regulations con-
cerning geologic hazards have been satisfied, or documents
how the applicant intends to meet the requirements of the
Weld County supplementary regulations concerning geologic
hazards .

The PUD is not located within any known geologic hazard areas
as defined by the Geologic Hazard Map adopted by Weld County
on April 19, 1978 .
There are no known apparent hazards, restrictions, or over-
lay districts that would conflict with the PUD application.
The area is in the St. Vrain/Boulder Creek flood zone as
designated by the Federal Emergency Management Agency (FEMA) .
There are no known geological hazards related to this area .
15. A sign shall be posted on the property under consideration
for PUD rezoning. The sign shall be posted by the applicant,
who shall certify that the sign has been posted for at least
ten ( 10 ) days preceding the hearing date. The sign shall be
provided by the Department of Planning Services .
The required sign will be posted by the applicant and the
affidavit will be forwarded to the County at that time.
16 . A certified list of the names, addresses and the corresponding
parcel identification number assigned by the Weld County
Assessor of the owners of property (the surface estate) within
five hundred (500) feet of the property subject to the appli-
cation. The source of such list shall be the records of the
Weld County Assessor, or an ownership update from a title or
abstract company or attorney, derived from such records , or
from the records of the Weld County Clerk and Recorder. If
the list was assembled from the records of the Weld County
Assessor, the applicant shall certify that such list was
assembled within thirty (30) days of the application submis-
sion date.
A certified list of property owners within 500 feet of the
property was prepared by Nelson Engineers and is attached.
17 . A certified list of the names and addresses of mineral owners
and lessees of mineral owners on or under the parcel of land
being considered. The source of such list shall be assembled
from the records of the Weld County Clerk and Recorder, or
from an ownership update derived from such records of a title
or abstract company or prepared by an attorney derived from
such records.

The recent change in the Weld County Comprehensive Plan,
_ wherein the 1-25 Mixed Use Development Area (MUDA) and
Activity Center was created will encourage changes of use
and activities in the MUDA. The property is in the South-
west Weld Enterprise Zone and is projected as a commercial
district by the Weld County Planning Office. The develop-
ment of the public sanitary sewer has further enhanced the
potential of changes of use and activities. As a result
there have been and will be changing conditions in the vici-
nity that warrant this change of zone. To further substan-

Dear Vern:
This letter is in reference to the following described real property:
NW/4 of the NW/4 of Section 10, T2N, R68W of the 6th
P.M. , Weld County, Colorado -- approximately 40 acres.
Referenced property can immediately be served. A major trunk line is available
along the North side of Colorado Highway 119 contiguous thereto. The property
is within the District.
St. Vrain Sanitation District has 1852 SFE (single family equivalent) taps, of
which 288 have been purchased, resulting in 1564 available for purchase. These
taps are available to referenced property and other eligible properties on a
first-come, first-serve basis. As the present supply of taps is consumed, the
District plans to increase the size of its treatment plant to serve 5,555 SFE
taps. These additional taps would also be made available on a first-come,
first-serve basis.
The above-referenced property is eligible to utilize the available supply of
taps on a first-come, first-serve basis, subject to the following:
a. Installation of off-site lateral and/or connection to the District' s
system by the applicant;
b. Execution of a Service Agreement;
c. Purchase and payment of the required number of taps; and
d. Compliance with the District's Rules and Regulations.
Should this property wish to obtain an absolute commitment to serve, taps may
be prepurchased and held until needed. Monthly service charges will be assessed

I have reviewed the location map of the Edson property to determine that it is located
within our service area. This letter is to confirm that United Power does provide
electrical service to the subject property.
There is an existing overhead three-phase electrical line along the west side of the
property. The property could readily be serviced from that line. The line is available
with capacity for industrial and commercial customers.
We support the proposed rezoning and we look forward to the development of this site as
an important part of economic development in southwest Weld County.
