RESOLUTION
RE : APPROVE ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT WITH
C & M COMPANIES AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road
Improvements and Maintenance Agreement with C & M Companies, and
WHEREAS, said Agreement concerns increased truck traffice due
to a Special Review Permit granted to C & M Companies , and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement, a copy being attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Road Improvements
and Maintenance Agreement with C & M Companies be , and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
January, A.D. , 1990 .

ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
THIS AGREEMENT, by and between the COUNTY OF WELD, STATE OF COLORADO,
hereinafter called "County" and C & M Companies hereinafter called
"Operator", is made and entered into this 29th day of January
1990
WHEREAS, Operator has been issued a Special Review Permit for an
open-cut gravel mine located in Section 29, Township 2 North, Range 68
West of the 6th Principal Meridian, known as the Williams Site; and
WHEREAS, the County and Operator have reviewed proposed improvements
to Weld County Road 3-1/4 and acknowledged they will enhance the
accessibility and safety of the haul route to the above mentioned gravel
pit.
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and Operator mutually agree
as follows:
1. Vehicular traffic shall ingress and egress onto Weld County
Road 3-1/4 as shown on the submitted Use by Special Review
plat. The haul route shall be from the point of ingress and
egress south to State Highway 52.
2. The Operator agrees to adequately repair any damage on the
entire haul route as described above that is created by
heavy truck traffic hauling from the site.
3. The Operator will be responsible for providing adequate dust
abatement along Weld County Road 3-1/4. Maintenance will
consist of regular grading to keep the surface reasonably
smooth and to control dust. The Operator is responsible for
using materials and methods not inconsistent with any federal,
state, or local laws, rules or regulations pertaining to
hazardous materials, health or environmental protection. The
County will be responsible for all other aspects of maintenance,
such as culverts and signs.
4. In the immediate vicinity of this site, Special Review Permits
SUP 447:80:37 and SUP-260 have been granted for open pit
mining operations. These two permits will also use Weld County
Road 3-1/4 as a haul route. At some future date, Weld County
wishes to have Weld County Road 3-1/4 paved with two 12 foot
lanes, 4 foot gravel shoulders, and conform to Colorado
Department of Highways specifications.

5. It is agreed that the three Special Review Permit holders and
Weld County will equitably share in the cost of the paving
based on ultimate volume of usage, length of road used,
and life of the operation as compared to the design life
of the pavement.
