AkdgQ2231 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #1620 - MILLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption #1620 was submitted by Frieda Miller, 33646 Weld County Road 23, Windsor, Colorado 80550, for property which is described as Lot A of Amended RE #348, being a part of the NW* of Section 13, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into two parcels estimated to be approximately 2.4 acres each, more or less, and WHEREAS, this request was considered by the Board on August 1, 1994, at which time the Board deemed it advisable to continue said matter until August 3, 1994, and WHEREAS, at said meeting on August 3, 1994, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3. 2. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption #1620, submitted by Frieda Miller, be, and hereby is, denied. The parcel of land on which this request is being made is described as Lot A of Amended RE- 348, being a part of the NW4 of Section 13, T6N, R67W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1/3 mile south of Weld County Road 70 and east of and adjacent to Weld County Road 23. This request is to divide a 4.8 acre parcel into two parcels of 2.4 acres each, more or less. There is an existing dwelling on proposed Lot A and proposed Lot B is currently vacant farm ground. The applicant had indicated that she intends to live in the existing residence on proposed Lot A and sell proposed Lot B as a residential building site. North Weld County Water District currently provides proposed Lot A with water and is proposed for Lot B. A septic system provides proposed Lot A with sewage disposal and is proposed for Lot B. The Town of Severance reviewed this request and indicated no objections. The Weld County Health Department and Weld County Public Works Department reviewed this request and recommend conditional approval. The Department of Planning Services' staff recommends denial of this proposal based on the lack of efficient and orderly development, noncompliance with the agricultural goals and policies, and noncompliance with the transportation goals and policies as stated in the Weld County Comprehensive Plan. The 4.8 acre lot was created in 1978 by AM RE-348 to divide the improvements from the farm ground. The applicants for AM RE-348 were Mr. and Mrs. Miller. This request by Mrs. Miller, if approved, would therefor be the second split on the property with identical reasons that were stated for the first Recorded Exemption, being that she cannot physically maintain the acreage any longer. The applicant has indicated within the application materials that the approval of this proposal would decrease the fire danger to the area by allowing for increased maintenance on proposed Lot B. This type of reasoning may be questionable due to the fact that the new owners of the property may or may-not have the ability or equipment to maintain the proposed 2.4 acre parcel. The size of the parcel is to small to economically farm and would be a large area to mow. 940757 RECOMMENDATION Frieda Miller RE-1620 Page 2 Access to proposed Lot A is existing from Weld County Road 23 and is proposed for Lot B. There are six existing accesses onto Weld County Road 23 within a 1/8 mile span, including the existing access to proposed Lot A. The Comprehensive Plan States: "An Arterial County Road is a major road that covers a length of the County. The average daily traffic greater than six hundred and fifty (650) vehicles. The number of access points on an arterial should be kept to a minimum in order to maximize traffic flow and promote safety." This proposal is in conflict with the transportation goals and policies due to the addition of an access onto an arterial County road, which already has numerous accesses. It is staff's opinion that the creation of the L-shaped lot has the potential to reduce the usability of the whole lot, which is in conflict with efficient and orderly development. The shape of proposed Lot B also lends itself to a further division in the future. There is a high level of development in the area; directly south of the 4.8 acre parcel is the Kennedy Subdivision and to the northeast is Antelope Hill Subdivision. This request, if approved, would allow for the addition of a dwelling on proposed Lot B, additional access onto Weld County Road 23, and further intensify the density of residential use of this agricultural area. A Weld County septic permit is required for the proposed home and its septic shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) . 2. One legal access shall be allowed per lot; if a new driveway access is proposed, the applicant shall submit a new access information sheet to the Weld County Public Works Department. 3. Prior to recording of the plat, a 100 foot easement shall be dedicated for Weld County Road 23 and shown on the plat. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. These parcels can accomodate 4-H projects or small agricultural enterprises. 6. Explain how the proposal is consistent with efficient and orderly development.
