RE: APPROVAL OF TEMPORARY PERMIT FOR A RETAIL LIQUOR STORE TO TONY HERNANDEZ,
DBA WESTVIEW LIQUORS, 5901 WEST 10TH STREET, GREELEY, COLORADO 80631
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Tony Hernandez, dba Westview Liquors, 5901 West 10th Street,
Greeley, Colorado 80631, has presented an application for a Change of Ownership
of Retail Liquor Store License for the sale of malt, vinous, and spirituous
liquors for consumption off the premises only, said License previously held by
Jerry Hernandez, dba Westview Liquors, and
WHEREAS, Section 12-47-106.5, C.R.S. , which became effective July 1, 1991,
allows for the issuance by the Board of County Commissioners of a Temporary
Permit to the transferee of an existing liquor license to authorize the
transferee to conduct business and sell alcoholic beverages at retail in
accordance with said license, subject to compliance with certain conditions, and
WHEREAS, Mr. Hernandez has complied with all of the conditions set forth
in said Section, and
WHEREAS, Mr. Hernandez has also submitted the required application fee for
said Temporary Permit of $100.00.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, having examined Mr. Hernandez's application and other
qualifications for the transfer of the Retail Liquor Store License, and having
considered Mr. Hernandez's request for a Temporary Permit does hereby grant to
Tony Hernandez, dba, Westview Liquors, 5901 West 10th Street, Greeley, Colorado
80631, a Temporary Permit to conduct business and sell alcoholic beverages at
retail in accordance with the license of the transferor, Jerry Hernandez, dba
Westview Liquors, subject to all rules and regulations set forth in the Colorado
Liquor Code and all other rules and regulations set forth by the Board of County
Commissioners of Weld County, for a period of 120 days, or until such time as the
application for Change of Ownership is approved by the State of Colorado,
whichever shall occur first.

The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 15th day of July, A.D. , 1991.

RE: Operation of Retail Liquor Store Under License Issued to Jerry
Dale Hernandez
Dear Mr. Frank:
Weld County, Colorado, has been informed that you have taken over
the ownership of Westview Liquor, located at 5901 W. 10th Street,
Greeley, Colorado. The liquor license for the Westview Liquor
premises is currently under the name of Jerry Dale Hernandez, dba
Westview Liquor. Mr. Hernandez apparently is no longer in control
of the Westview Liquor premises, either by lease or by ownership.
Please be advised that pursuant to Section 12-47-106 ( 3 ) , C.R. S . ,
only the licensee may exercise the privileges granted under the
license. Given that Mr. Hernandez is considered to be the licensee
under the current license, you are not authorized to sell liquor at
Westview Liquor without first obtaining a transfer of ownership of
the licensed premises .
