Home My WebLink About921045.tiff AR23117233 RESOLUTION RE: APPROVE VACATION OF THAT PORTION OF WELD COUNTY ROAD 23.75 IN NE,' OF SECTION 36, AND SEa OF SECTION 25, TOWNSHIP 1 NORTH, RANGE 67 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Janice Dersham has requested in writing that the Board of County Commissioners, Weld County, Colorado, vacate that portion of Weld County Road 23.75 located in the NE; of Section 36, and the SEa of Section 25, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority to vacate roadways within its jurisdiction, pursuant to Section 43-2-303, CRS, as long as said vacation does not leave any land adjoining the roadway without an established public road or private access easement connecting said land with another established public road, WHEREAS, the Board of County Commissioners considered Ms. Dersham's request at its meeting on October 28, 1992, and WHEREAS, Ms. Dersham presented two easements granted to owners of lands adjoining said roadway which provide access to an established County road, and WHEREAS, it appears that the vacation of this portion of Weld County Road 23.75 will not leave any land adjoining said roadway without an established public road or private access easement connecting said land with another established public road. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Weld County Road 23.75, as it extends north easterly through the NE'-a of Section 36, and the SE,' of Section 25, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, be, and hereby is, vacated. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to record this Resolution in the office of the Weld County Clerk and Recorder, as required by Section 43-2-303(4) , CRS. Dershan: On July 13 , 1992 the Board of County Commissioners of Weld County, Colorado considered your June 6 , 1992 letter which requested a vacation of WCR 23 3/4 in Sections 36 and 25 , TIN, R67W. The Board agreed that the County should vacate the roadway, given the fact that you have been maintaining it for a number of years . The Board directed me to contact surrounding landowners to let them know that the Board would be considering the vacation at one of its regular meetings . I plan to place the matter of the vacation on the Board ' s agenda for September 30 , 1992 .
