WHEREAS, the Board of County Commissioners of Weld County, z w
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the m
affairs of Weld County, Colorado, and c
WHEREAS, in accordance with C.R.S. , Section 30-20-607 , as
amended, a statement of expenses and apportionment has been filed z V)
with the Weld County Clerk to the Board by the Weld County
Engineer, and o

WHEREAS, pursuant to C.R.S. , Section 30-20-608 , there has a
been proper notice of this hearing and of the costs of the x N
improvements, and the share to be assessed to each lot, and

WHEREAS , the Board finds that those properties generally t214,
described as portions of Sections 8 , 9 , 16 , and 17 , Township 5
North, Range 66 West, in relation to the 6th Principal Meridian in o
an unincorporated portion of Weld County, Colorado, in an area
west of Greeley, between U.S. Highway 34 Bypass , and U.S. Highway
34 Business Route, more particularly described as lots within the O ,
Knaus Subdivision, Second Filing, as recorded at Book 741 ,
Reception No. 01662603; Knaus Subdivision, Third Filing, as n o
recorded at Book 741 , Reception No. 01662604; Lots 1 and 2 , 1st Qi°
Replat of Bird Subdivision, as recorded at Book 1255 , Reception
No. 02205008; and Peterson-Alexander Subdivision, excepting Lot 5 ,
Block 1 , as recorded at Book 918 , Reception No. 01840116 ; and for
each individual parcel of land adjoining 71st Avenue between U.S.
Highway 34 Business Route and U.S. Highway 34 Bypass have
specifically benefitted from the proposed improvements for the
following reasons:
a. The market value of each of the properties will
increase;
b. The proposed improvements will adapt the property to a
more profitable use;

c. There will be an alleviation of fugitive dust,
eliminating the health hazards to the benefitted
properties and to users of the public roads to be

for each individual parcel of land adjoining 71st Avenue
between U.S. Highway 34 Business Route and U.S. Highway
34 Bypass are assessed at the sum of $74 , 250 .00 to be
divided in the following fashion: All lots within Knaus

Subdivision, Second and Third Filings; and
Peterson-Alexander Subdivision, except for Lot 5 , Block
1 , shall be assessed $350. 00 and all other lots and
parcels adjoining 71st Avenue between U.S. Highway 34
Business Route and U.S. Highway 34 Bypass shall be hi IX
assessed $1,900 .00; in both cases the amounts exclude Fa
penalties and interest. The individual properties are N IQ
specifically listed in Exhibit "A" attached hereto and w to
incorporated herein by this reference.

Resolution of this Board on July 18 , 1990 . Said local z w
improvement district has been designated as "weld County w
71st Avenue Local Improvement District No. 1990-1" and hi al

all proceedings heretofore taken by the Board of County c• o
Commissioners and the County staff and adopted in w
connection with the District are hereby ratified, y ,~_,
approved, and confirmed. H F"

c. That the Statement of Expenses and Apportionment has n �
been submitted based upon the fact that there has been r o
completion of the entire local improvement as previously W
authorized. m I-

d. The total cost of the improvements included within the W N
District has been determined to be $291 , 285. 77 not m
including the cost borne by the County for improvements 0
to the gravel road, engineering, and administrative O
fees. The Statement of Expenses and Apportionment m `r

advises, and this Board ratifies the Finding that each • o
of the lots or parcels described belonging within the m o
Local Improvement District has been specifically o
benefitted at least in the amount to be assessed.

e. The assessment being levied for the improvements shall ` o
be due and payable within thirty (30) days after the n• a
effective date of this assessing Resolution. However,
all such assessments may be paid at the election of the
owner in ten (10) equal, annual installments of
principal, with installments of interest on unpaid
installments , at an interest rate of nine percent (98)
simple interest per annum. The first of said
installments of assessment shall be due and payable at
the same time and manner as 1990 property taxes pursuant
to C.R.S. , Section 39-10-104 (1) (a) , and the remainder of
the annual installments of assessments and annual

payments of interest shall be due and payable
successively in the same manner each year thereafter
until all are paid in full. Interest on installments
will accrue on January 1 of each year. .1a

columns , each parcel of land assessed, the total amount m n

Article 20 of Title 30 , Colorado Revised Statutes , the z la,
same is payable in installments , and the date when each w
installment will become due, with suitable columns for c cn

use in case of payment of the whole amount or of any
installment or penalty, and shall deliver the same, duly m r
certified, under the County seal, to the County H \
Treasurer for collection. m Fa

q. Failure to pay the whole assessment on or prior to 0kv
December 28 , 1990 , shall be a conclusive determination r o
interested, whether under disability or otherwise, to x
pay in such installments. All persons so electing to r
pay in installments shall be conclusively held and 'r o
considered as consenting to said improvements . Said Zi N
election shall be conclusively held and considered as a o
waiver of any right to question the power or O
jurisdiction of the County to construct the 0
improvements, the quality of the work, the regularity or ;d o
sufficiency of the proceedings, the validity or
correctness of the assessments, or the validity of the r o
lien thereof. O
h. That all Resolutions or parts thereof in conflict with o as

this Resolution are hereby repealed. o

i. Failure to pay any installment, whether principal or
interest, when due shall cause the whole of the unpaid
principal to become due and collectible immediately, and
the whole amount of the unpaid principal and accrued
interest shall thereafter draw penalty interest at the
rate of one percent per month in accordance with C.R.S. ,
Section 39-10-104 (2) - (5) , until the day of payment, or
until the day of sale . In computing the amount of
penalty interest due under this section, portions of
months shall be counted as whole months.

Dear Mr. McCloskey:
The Board of Weld County Commissioners, on November 7, 1990,
approved the Weld County 71st Avenue Local Improvement District
No. 1990-1 . Pursuant to the Resolution, your lot or parcel has
been assessed $1 ,900 . 00 . You may pay this amount to the Weld
County Treasurer prior to December 28 , 1990. When making your
payment, please advise the Treasurer' s Office that the payment is
for the assessment concerning the 71st Avenue Local Improvement
District.
Should you choose not to pay in full by December 28 , 1990, you
will pay in ten (10) equal annual installments of principal along
with simple interest at a rate of nine (9) percent per annum.
This amount will be separately billed to you after January 1 ,
1991 , along with your property taxes. Please note that the
interest will accrue in full on January 1 of each year.

persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has received a Notice of
Completion, Statement of Expenses, and Apportionment regarding the
Local Improvement District within unincorporated Weld County, Colorado,
designated as 71st Avenue Local Improvement District No. 1990-1, all in
accordance with the laws of the State of Colorado. The property within
the Local Improvement District is described as follows:
Portions of Sections 8, 9, 16 and 17, Township 5 North, Range 66
West, in relation to the 6th Principal Meridian in an
unincorporated portion of Weld County, Colorado, in an area west
of Greeley, between U.S. Highway 34 Bypass, and U.S. Highway 34
Business Route, more particularly described as lots within the
Knaus Subdivision, Second Filing, as recorded at Book 741,
Reception No. 01662603; Knaus Subdivision, Third Filing, as
recorded at Book 741, Reception No. 01662604; Lots 1 and 2, 1st
Replat of Bird Subdivision, as recorded at Book 1255, Reception
No. 02205008; and Peterson-Alexander Subdivision, excepting Lot 5,
Block 1, as recorded at Book 918, Reception No. 01840116; and for
each individual parcel of land adjoining 71st Avenue between U.S.
Highway 34 Business Route and U.S. Highway 34 Bypass.
1. All persons are further notified that the whole cost of the
improvements that have been completed is $291,285.77, which
excludes any costs which have been assumed by the County in terms
of improvements to the gravel road, engineering, and
administrative fees. The costs to be apportioned to the
landowners are the costs of the labor and materials for
installation of the hot bituminous pavement and base preparation
and administrative costs. The district's petition indicated the
cost to the district should not exceed $74,250.00, which is to be
apportioned as follows: $350.00 per lot for all lots within Knaus
Subdivision 2nd and 3rd Filings, and Peterson-Alexander
Subdivision, excepting Lot 5, Block 1; and $1,900.00 per each
individual parcel of land adjoining 71st Avenue between U.S.
Highway 34 Business Route and U.S. Highway 34 Bypass, including
lots 1 and 2 of Bird Subdivision, 1st Replat.
2. Any owner of the affected lots may file a complaint or objection
in writing addressed to the Board of Weld County Commissioners,
915 Tenth Street, P.O. Box 758, Greeley, Colorado 80632, which
objection must be filed within twenty (20) days from the
publication date of this notice. Any complaint or objection
properly made will be heard and determined by the Board of County
Commissioners before the passage of any Resolution assessing the
costs of the improvements.
3. The hearing where such complaints or objections will be heard will
be on the 7th day of November, 1990, at or about 10:00 a.m. , in

80 years of age tha4w- that would be perty mean to try to force to
old people to pa* for a County road we dont need.
The road that would not benefit us, We are not aboute to pay

RE: Local Improvement District No. 1990-1
The construction and paving of 71st Avenue is completed but the road
is far from being finished. This road is fastly turning into a major
artery. The traffic has increased tremendously and the speed is
uncontrolled. The traffic using 71st Avenue appears to be mostly
non-resident. They are using 71st Avenue as a cut across road between
highways, and employee use from the industrial area, north 71st Avenue.
Also, when the golf course opens and more people learn about 71st
Avenue being paved, the traffic count will continue to increase. We
are not interested in paying our share of the improvement under the
present conditions. We would like to see the following done first:
1. Posted speed limit of 45 miles per hour. This is a populated
area with children and pets.
2. A four way stop on the corner of 71st Avenue and 20th Street.
This is a partically blind corner and needs the traffic control .
This will also help slow the traffic.
3. A determination and satisfactory answer as to why this improve-
ment should not be a total county expense. The road is a major
artery and most of the traffic is by non-residents of 71st
Avenue.

have no way to recover the money . I also have to contend with the
now e'i. cre that some of that property on 71st Avenue is part of
farms that consists of several hundred acres of road frontage . They
are paying a single assessment while my wife and I live on less
than two acres that ai e not even on the newly paved road and are
bein 17.,-.Ad that we must pay two assessments of $350 . 00 each. We
consider the two lots as one parcel . Our house and shop are ,,rn + ,,t.
# 8 . On 1 c t.. # 7 we put. in 27 trees and installed can undergr and
system to water them. Someday I would like to build a equipment
shed on lot. # 7 to store my farm tractor and equipment . We have
paid out a11oO. $5000 .00 for paving and reel that is enough .
We petition the Weld County Board Of County Commissioners
to declare our two adjoining lots (7 and 8, first filing, Knaus
subdivision) one parcel for the purpose of assessment and assess
