RE: APPROVE POLICY ENCOURAGING USE OF PORTABLE TANKS OR OTHER SEALED
CONTAINMENT VESSELS FOR OIL AND GAS EXPLORATION AND PRODUCTION ON
IRRIGATED FARMLANDS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Colorado Oil and Gas Conservation Commission has promulgated
regulations which encourage local governmental entities to participate in the
permitting process for oil and gas wells, pursuant to 2 CCR 404-1, Section 302,
and
WHEREAS, the Board of County Commissioners has determined that one of the
primary reasons for conflicts between surface owners and developers of mineral
estates is the use of earthen pits on irrigated parcels of agricultural lands for
the purpose of oil and gas exploration and production, which pits impair the
current and future use of the surface estate, and
WHEREAS, there are viable alternatives to the use of earthen pits for
exploration and production activities, which alternatives include portable tanks,
and
WHEREAS, the Board of County Commissioners deems it advisable to authorize
the Weld County Health Department to submit comments to the Oil and Gas
Conservation Commission, when solicited to do so, which encourage such use of
portable tanks or other sealed containment vessels.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Oil and Gas Conservation Commission in the State of
Colorado be respectfully requested not to grant any application to drill or
reenter on lands for the purpose of exploration and production of oil and gas
wells where the surface is used for irrigated farm land, unless said approval is
conditioned upon the use of portable tanks or other sealed containment vessels
rather than earthen pits.
BE IT FURTHER RESOLVED, that the Weld County Health Department is
authorized, on behalf of Weld County, to submit comments consistent with this
Resolution to the Oil and Gas Conservation Commission, upon solicitation,
pursuant to 2 CCR 404-1, Section 302.
