RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1673 - LIND FARMS, INCORPORATED
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1673, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1673 was submitted by Lind Farms,
Incorporated, 38241 Weld County Road 23, Eaton, Colorado 80615, for property being described
as Lot B of Amended RE #309, located in part of the NE 1/4 of Section 23, Township 7 North,
Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
76.6 acres and 1.4 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1673 submitted by
Lind Farms, Incorporated, be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. An ISDS permit shall be finalized and approved by an Environmental Protection
Specialist within one (1) year of the application date.
3. Prior to recording the plat:
a. The applicant shall submit evidence that an ISDS evaluation has been
completed by the Weld County Health Department on all existing septic
systems.
b. A 30-foot access easement across Lot B for the benefit of Lot A to Weld
County Road 23 shall be shown on the plat. The access easement shall be
dedicated on the plat for the use as shown using the language set forth in
Section 11.7.12.5 of the Weld County Subdivision Ordinance.

SEPTIC SYSTEM EASEMENT ON LOT B FOR
INSTALLATION AND MAINTENANCE OF THE SEPTIC
SYSTEM."
4. No accesses to Lots A and B shall be allowed other than those which are presently
existing.
5. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23rd day of November, A.D., 1994.

one-half acre in size. If the Recorded Exemption is granted with or without the shelter belt, a

This request for a recorded exemption is submitted by Lind Farms, Incorporated. The parcel of
land under consideration is described as Lot B of Amended Recorded Exemption-309, being in
part of the NE4 of Section 23, T7N, R67W of the 6th P.M., Weld County, Colorado. The
property lies within the urban growth boundary of the Town of Severance. The existing land
uses on proposed Lot B include a residence and agricultural production. Proposed Lot A is
vacant ground.
North Weld County Water District provides proposed Lot B with water and has indicated it is
able to serve Lot A as well. A septic system provides Lot B with sewage disposal and is
proposed for Lot A. Two accesses are existing to the parcel from Weld County Road 23, one is
residential and one is agricultural. The applicant is willing to allow the residential access to be
shared between proposed Lots A and B. The Weld County Public Works Department has no
conflict with the request. The Weld County Health Department recommends conditional
approval.
Recorded Exemption 309, approved by the Board of County Commissioners in 1978, divided a
78 acre parcel into 76.6 and 1.4 acres, more or less. An amendment to the recorded exemption
was administratively approved in 1988, altering the two lot sizes to 67 and 11 acres, more or less.
The applicant is now requesting to further subdivide Lot B of the property into two parcels of
65.5 and 1.5 acres, more or less. The applicant wishes to create a separate parcel on which a
family member who is involved with the farming operation may construct a residence. It is the
staffs understanding that the applicant is including the 560 foot by 30 foot shelter belt/wind
break area within proposed Lot A in order to meet the one-acre requirement for recorded
exemptions (Section 11.8.5, Weld County Subdivision Ordinance)

The Department of Planning Services' staff has concerns that the proposed division is
inconsistent with efficient and orderly development due to the configuration of Lot A. It is the
staffs opinion that a preferred alternative to this request is an exemption from the minimum one-
acre lot size, which would allow Lot A to take on a typical rectangular configuration. While the
proposed shelter belt may be a desirable addition to the site, staff would prefer to see this area of
the property remain with Lot B.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this request and determine if the standards of Sections 11.5.1 through 11.5.7 of the
Weld County Subdivision Ordinance have been met.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for any proposed home septic
system. The septic system shall be installed according to the Weld County
Individual Sewage Disposal System Regulations.
2. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s) . In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
3. The smaller parcel indicated in this Recorded Exemption is greater than
one (1) acre, however, due to limitations resulting from the parcel shape
only approximately 1/2 an acre would be available for a home site and
septic system. The policy of the Division is not to recommend approval of
any lot less than one (1) acre. While this parcel meets the Division's
criteria, the Division recommends that a easement be obtained by the
parcel owner in the event the septic system needs replacement in the
future.

Ladies & Gentlemen:
Attached to this letter are all documents necessary for a
completed Recorded Exemption application plus twelve copies . This
letter is additionally to provide to you supplemental information.
The exiting Lot "B" (now proposed to be divided) was created in
1978 and amended in 1987 . Existing Lot "B" is used for
agricultural purposes and also has an existing dwelling which is
used for accessory uses (farm labor) . The northeast corner of Lot
"B" is good agricultural soil but the same cannot be farmed due to
the location of the property, location of irrigation ditches and
the shape of the parcel which results in the proposed parcel lying
fallow. The proposed division and application is submitted on
behalf of Lind Farms, Inc . (the property owner) and the daughter of
the principal owners of the corporation (Janice Lind) . Janice Lind
provides services and care for a partially disabled member of the
family farm as well as employed to provide bookkeeping and
accounting services for the farm corporation.
The lot to be created will be the residence for Janice Lind
and the conveyance will be subject to the following requirements :
(1) A 560 foot by 30 foot shelter belt-wind break shall be
planted along the north end of the property which is immediately
south of Weld County Road 80 . The lot owner will be required to
plant said shelter belt within eighteen months of parcel approval
and shall also be required to maintain the shelter belt . This will
be a covenant running with the land;
(2) Lind Farms, Inc . shall have a first right of refusal to
re-purchase the lot for a period of twenty years after conveyance
at a price $8, 000 . 00 less than the appraised value or any purchase
and sale contract;
(3) The new lot will be conveyed an easement to use the
existing field and house access; and

(4) The deed shall also contain the following restrictive
language :
Subject to zoning restrictions and on-site and adjoining
existing and/or permitted uses including but not limited to:
(a) Irrigation ditches, ponds, pumps, sprinklers, underground
water and seep;
(b) Feedlot operations;
(c) All agricultural operations defined as agriculture under
C.R. S . 35-1-102 (1) and including the use of herbicides,
pesticides, fungicides, fertilizers and other chemicals and
the application thereof, including but not limited to
injection, aerial or ground operations .
The purpose of these covenants and restrictions is to make
sure that the property will maintain its rural character, that the
farm owner (Lind Farms, Inc . ) shall always have the right to
reacquire the property and use the same for employee housing, and
to restrict any new access onto Weld County Road 23 . The
restrictions should allow the property to be maintained for family
use but are not so restrictive as to be unenforceable .

RECORDED EXEMPTION OUESTIONNAIRE
1 . Explain the reason for the proposed recorded exemption and how
each proposed lot will be used.
Lot "B" is currently used for agricultural purposes and has an
accessory farm use dwelling for a farm employee . After
approval of the recorded exemption, the use for Lot "B" will
not change . Lot "A" is located in the Northeast corner of the
subject property and will be used for a rural residence and
shelter belt .
2 . Describe the location, size and present use of the area where
each proposed new lot will be created.
The new lot will be 1 . 5 acres in size, used for a rural
residence and shelter belt . The current use of the new
proposed lot is marginal farming. At the present time the
proposed parcel cannot be irrigated or properly farmed due to
the location of the existing labor home, the tree growth and
irrigation ditches . At the current time the proposed lot is
too short of a distance to irrigate and farm and has been used
for fallow land.
3 . Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if
applicable .
The proposed lot is three miles north of Severance and is not
inconsistent with any Severance Municipal Plan. The proposed
lot is consistent with the Weld County Comprehensive Plan as
it does not remove productive agricultural land from
production, utilizes existing waste ground and has access to
roads and domestic water.
4 . Explain how the uses permitted will be compatible with
existing uses surrounding the proposed recorded exemption.
Existing uses are agricultural and rural residential . The new
proposed lot will be both agricultural in nature (shelter
belt) and rural residential .
5 . Explain how the proposal is consistent with the intent of the
zoning district it is located within.
The proposal is consistent with the ag zoning district as it
does not remove productive agricultural land from production,
and utilizes existing wasteland. Additionally, the proposed
owner and occupant of the property is a family member who
provides care for a partially disabled family member as well
as provides bookkeeping services for the family farm
operation.

2, DESCRIPTION OF MONUMENT FOUND AND MONUMENT MARKINGS.found during field search. Found #4
rebar with illegible yellow plastic cap from Monument Record (PR) dated August 1991 by Joe Surprenant (LS 10740). The
PR dated June 1977 by Robert Short (IS 7242) indicates this corner to be monumented by a 3/4" pipe with plastic cap
stamped #4845 as does the PR dated March 1982 by Surprenant. I removed the found #4 rebar and found it to be only 11"
In lenght set on top of the 3/4" pipe with plastic cap stamped 4845, which is still in place and undistrubed. The
Plat of Survey prepared by Gerald McRae (PE/LS 6616) which was recorded November 20, 1987 in Book 1177 as Reception
!limber 02122057 indicates a found #4 rebar with cap stamped 1S 7242. Obviously at same point in time Mr. Short chose
not to recover the monument set by IS 4845 and reset a much short monument on top of the existing monument. I have
removed and destroyed the found #4 rebar and have left in place the found 3/4" pipe with yellow plastic cap stamped IS
