RE: APPROVE AMENDMENT TO INTERGOVERNMENTAL AGREEMENT WITH CITY OF GREELEY AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution on April 3, 1991, the Board did enter into an
Intergovernmental Agreement with the City of Greeley, concerning Weld County
Bridge 60.5/29A, also known as the 4th Street Bridge over Sheep Draw, and
WHEREAS, the Board has been presented with an amended Intergovernmental
Agreement to replace the aforementioned Intergovernmental Agreement, with the
terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the amended Intergovernmental Agreement with the City of
Greeley concerning Weld County Bridge 60.5/29A be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 14th day of July, A.D. , 1993.

INTERGOVERNMENTAL AGREEMENT
/THIS AGREEMENT, made and entered into this 7- - day of
, 1993 , by and between the COUNTY OF WELD, State of
Colo ado, hereinafter called "County" , and the CITY OF GREELEY,
Colorado, hereinafter called"City" .
WHEREAS, County Bridge 60. 5/29A, also known as the 4th Street
Bridge over Sheep Draw, is located one-half in the City and one-
half in the County; and,
WHEREAS, the load-carrying capacity of the bridge should be
upgraded; and,
WHEREAS, on October 18, 1990, Two Hundred Eighty-Eight
Thousand, Eight-Hundred Dollars ($288, 800) in State Special Bridge
Funds was granted; and,
WHEREAS, the County and the City entered into an
Intergovernmental Agreement on April 3, 1991, that provided for the
sharing of costs between the County and the City; and,
WHEREAS, preliminary engineering for a two-lane bridge has
been completed, and the estimated construction cost is Two Hundred
Ninety-Six Thousand, One-Hundred Dollars ($296, 100) ; and,
WHEREAS, after the costs of engineering, construction, and
right-of-way, there would be approximately Sixty-Five Thousand
Dollars ($65, 000) of grant money unused; and,
WHEREAS, the City plans to upgrade 4th Street to a four-lane
arterial in the immediate future; and,
WHEREAS, it would cost up to One Hundred Fifty Thousand
Dollars ($150, 000) to widen a two-lane bridge to a four-lane bridge
in the future and the four-lane bridge could be constructed now for
approximately Ninety-Five Thousand Dollars ($95, 000) in additional
cost; and,
WHEREAS, the County and the City agree it would be
advantageous to use all grant monies available and construct the
four-lane bridge at this time.
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and City mutually
agree as follows:
1. The County will provide all of the Two Hundred Eighty-
Eight Thousand, Eight Hundred Dollars ($288,800) in grant
money, as well as, Weld County's anticipated match of
Thirty-Six Thousand, One Hundred Dollars ($36, 100) , in
addition to an amount of $6, 582 overrun of quantities for
a two-lane structure for a total of Forty-two Thousand,
Six Hundred Eighty-two Dollars ($42, 682) for cash

payments towards construction, engineering contracts, and
right-of-way costs.
2 . The City will provide the funds required to make cash
payments for construction, engineering contracts, and
right-of-way beyond the grant amount, and the County's
budgeted match as identified in Paragraph 1 above. The
City's match is estimated to be One Hundred Twenty-Seven
Thousand, Five Hundred Seventy-Nine Dollars and Forty-
Eight Cents ($127, 579.48) .
3 . The County shall be the lead agency and have jurisdiction
over the structure upon execution of this Agreement,
allowing for full authority in contractual agreements
during the prosecution of the project.
4 . The County shall be responsible for the design,
construction, and administration of the project, without
charging expenses against the grant amount.
5. The County will inspect and maintain the new bridge
subsequent to construction of the new bridge and include
it in any required bridge inventory.
6. If the City annexes the portion of the bridge presently
in the County, the City assumes responsibility for
maintenance, inspection, and inventory.
7 . The amended Intergovernmental Agreement replaces the
Intergovernmental Agreement between the County and City
dated April 3 , 1991.

Agreement the day and year first-above written.

RESOLUTION NO . 51 , 1992
A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AMENDED
INTERGOVERNMENTAL AGREEMENT WITH WELD COUNTY FOR THE REPLACEMENT
OF THE 4TH STREET SHEEP DRAW BRIDGE .
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GREELEY, COLORADO :
Section 1 . The Mayor cf the City cf Greeley is hereby
authorized to sign , on behalf of the City of Greeley, an amended
intergovernmental agreement (a copy of which is attached hereto
and incorporated herein ) with Weld County , Colorado , for the
replacement of the 4th Street bridge over Sheep Draw.
Section 2 . This intergovernmental agreement is in the best
interests of the health , safety, and welfare of the citizens of
Greeley, Colorado .
Section 3. This resolution will replace ordinance No . 60 ,
1991 .
PASSED AND ADOPTED , SIGNED AND APPROVED this 15th day of
December , 1992 .

Dear Bill:
The Board of Weld County Commissioners held a work session on January 22, 1993, to consider
your request for additional county match on our 4th Street bridge project as outlined in
your letter of January 7, 1993.
The Commissioners considered the fact that approximately $13,500 in overruns would have
occurred for a two lane structure as opposed to a four lane structure. Also, the
Commissioners discussed the issue the City of Greeley requested expansion of the project and
that our original agreement limits Weld County's cash funding at $36,100. It was the
Commissioners decision to provide additional funding in the amount of $6,750, which would
be a fifty/fifty sharing of the overruns for a two lane structure which was our original
intent when we applied for State Special Bridge Funds. The revised funding breakdown would
be as follows:
ESTIMATED TOTAL PROJECT COST $456,232
State Grant (288,800)
Weld County Cash Funding ( 36,100)
City of Greeley Cash Funding (118,000)
Additional Weld County Cash Funding ( 6.750)
PRESENT UNFUNDED BALANCE $ 6,582
Thank you for your cooperation in this matter. Although there have been difficulties in
construction and funding, the cooperation between the City of Greeley and Weld County has
been outstanding. I am sure we will all be proud of the final product we deliver for the
use of our citizens.

Dear Steve:
Enclosed is the billing for work accomplished in completing the construction
of Bridge Wel 060.5-029.OA between December 31, 1992, and May 25, 1993. This
bridge is located on 4th Street over Sheep Draw.
I am also enclosing a copy of the final change order explaining the project
over and under-runs. A summary of the costs and payments follows:
