HomeMy WebLinkAbout930788.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN FAMILY EDUCATIONAL NETWORK OF WELD COUNTY (FENWC) AND WELD COUNTY SCHOOL DISTRICT RE-5J AND AUTHORIZE CHAIRMAN TO SIGN - PRESCHOOL SERVICES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Purchase of Services Agreement between FENWC and Weld County School District RE-5J for Head Start Preschool Services, commencing October 1, 1993, and ending May 31, 1994, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Purchase of Services Agreement between FENWC and Weld County School District RE-5J for Head Start Preschool Services be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Kirkmeyer 930788 � 0"61 cc: N%', �'L , PURCHASE OF SERVICES AGREEMENT THIS AGREEMENT, made and entered into this j/ -€ of Aala l , 1993, by and between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Division of Human Resources' Family Educational Network of Weld County, hereinafter referred to as "FENWC" , and the Weld School District RE-5J, hereinafter referred to as "School District". WITNESSETH THAT FOR AND IN CONSIDERATION OF the covenants herein agreed to be kept and performed, the School District and FENWC hereby agree unto the following described premises and services based upon the following terms and conditions: 1. TERM: The term of this agreement between FENWC and the School District shall be for the period beginning October 1, 1993 and ending May 31, 1994. 2. FENWC RESPONSIBILITIES: a. FENWC will implement preschool services for the School Districts Pre-school Program. Services will be provided for a maximum of forty (40) children. Two sessions will be held; one Monday/Wednesday session, and one session Tuesday/Thursday from 8:00 a.m. to 11:30 a.m. b. FENWC agrees to provide a teacher and teacher aide for the classroom, which includes salary and benefits, employee supervision and evaluation, and training and technical assistance. Supervision of the FENWC staff is the ultimate responsibility of FENWC. The School District elementary principal will participate in the hiring process of staff to be located at the elementary school site. FENWC has the final authority in the hiring/firing process of staff. c. FEWNC will charge the School District $30.00 per month per student not to exceed $1,200.00 per month, or $10,800 per contract year. A bill will be submitted by FENWC to the School District by the 10th of each month for the previous months charges, to be paid by the School District by the 30th of each month. d. FENWC will coordinate efforts among the School District staff, FENWC staff and parents to maximize the opportunities for a successful transition of students and parents into the public school system. e. FENWC will provide adequate insurance for the purpose of program operation, to include; child liability insurance. 930784 3. SCHOOL DISTRICT RESPONSIBILITIES: a. The School District will provide custodial services for the Milliken Elementary School Classrooms. b. The School District will make payment for FENWC's services by the 30th of the month for the previous month's charges. Payment will be sent to: Weld County Division of Human Resources Attention: Fiscal Department P.O. Box 1805 Greeley, Colorado 80632 c. The School District will recruit students for the District Preschool Program. d. The School District will be responsible to collect payment from the participants of the program and remit to FENWC as stated in sections 2.c. and 3.b. e. Transportation for the preschool children will be provided by the School District. 12. Assurances: a. The Weld School District RE-5J agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. b. FENWC, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Weld School District RE- 5J, its employees, volunteers, or agents while performing this Agreement. The Weld School District RE-5J, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of FENWC, or its employees, volunteers, or agents while performing functions as described in this Agreement. The Weld School District RE-5J shall provide adequate liability and worker's compensation insurance for all of its employees, volunteers agents engaged in the performance of this Agreement, as required by the Colorado Worker's Compensation Act. Likewise, FENWC, by and through the Board of Weld County Commissioners, shall provide adequate liability and workers' compensation insurance for all employees of FENWC engaged in the performance of this Agreement. c. No officer, member, or employee of Weld County and no member of their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. 930789 d. The Weld School District RE-5J understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Division of Human Resources and the results provided to the Weld County Board of Commissioners. e. The Weld County School District RE-5J and FENWC assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, handicap, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. IN WITNESS WHEREOF, the parties hereunto have caused this Agreement to be duly executed as of the day and year first hereinabove set forth.
