HomeMy WebLinkAbout930174.tiff 02322168 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1468 - SCHLAGEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption No. 1468, submitted by Richard Schlagel for property which is located in part of the E'-1SEg Section 18, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 70 acres and 10 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will create additional accesses onto State Highway 392 and will increase the density of the existing linear subdivision. 5. The Board feels this proposal increases the need for more urban-type services in the area. WHEREAS, the motion to approve Recorded Exemption No. 1468 received only two votes and, therefore, failed, the effect of the failure to obtain a majority vote is a denial of the motion. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption No. 1468, submitted by Richard Schlagel be, and hereby is, denied. The parcels of land are described as the east half of the southeast quarter and the west half of the southeast quarter of Section 18, T6N, R66W of the 6th P.M. , Weld County, Colorado. The properties are located north of Highway 392, west of Weld County Road 27. The requests are to divided two 80-acre parcels into 72 acres and 8 acres, more or less, and 70 acres and 10 acres, more or less. The proposed smaller lot of Recorded Exemption 1468 contains a residence. The residence is served by North Weld County Water District and a septic system. The proposed larger lot is in agricultural production and is proposed to be served by North Weld County Water District and a septic system. Both proposed lots of Recorded Exemption 1467 expect to use North Weld County Water District and a septic system. The City of Greeley and the Towns of Windsor and Severance have no conflicts with this proposal. The staff has concerns that the proposed divisions will be inconsistent with efficient and orderly development. As shown on the attached aerial photographs, the level of development in this area and the potential for continued divisions may evade the intent of the Weld County Subdivision Ordinance. Two subdivision exemptions and one recorded exemption have been approved on the property immediately adjacent to the west. Each of the three lots contains a dwelling. The continuation of development along this highway is creating a linear subdivision which is inconsistent with efficient and orderly development. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, police and fire protection and school busing. The service demands increase as the density is increased. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Board of County Commissioners. The applicants shall be responsible for paying the recording fees. 2. The recorded exemption plat shall show a 75 foot right-of-way reservation north from the centerline of Highway 392. 3. Weld County septic permits are required for the proposed homes and the septic systems shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 4. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 5. Prior to recording the recorded exemption plats, an easement agreement shall be submitted to the Department of Planning Services showing an access easement across Lot B of Recorded Exemption 1467 for the benefit of Lot B of Recorded Exemption 1468. The access easement shall be at least 30 feet in width and shall be shown on the recorded exemption plat. The access easement agreement shall be recorded with the recorded exemption plat. The applicant shall be responsible for paying the recording fees. 6. The following note shall be placed on the plat for Recorded Exemption 1468: Access to Lot B of Recorded Exemption 1468 is provided across Lot B of Recorded Exemption 1467. The highest and best use for the small parcel is a rural residence -small agriculture operation. The larger parcel will remain in agricultural use. Requirement No. 5: This proposal is consistent with the policies of the Weld County Comprehensive Plan due to the following factors: (1) Both lots created by this Recorded Exemption shall have access from State Highway 392 and the larger parcel will also have access from WCR 27 . This review is based upon this change and verbal information you provided stating that the two existing accesses shown along WCR 27 cannot be used for this parcel. We have the following comments: 1. Projected traffic on SH 392 indicates the need for a 150-foot total right of way, 75 feet each side of the highway centerline. ROW width is not indicated on the applications. If additional width is required to meet the projected need, this width should be protected by reservation or, preferably, dedication, as permitted by County regulations. The highway centerline and the section line are the same along this property. 2 . The site plan for the east parcel as revised (attached) shows two existing accesses along SH 392 entering Lot A, and no existing accesses entering Lot B. At such time in the future as development of lots occurs, a re- evaluation of access will be required. Access will then be dependant upon boundaries of new ownership and property use. The current owner requests subdivision in order to establish Lot A in the W 1/2 of the SE 1/4 due to the difficulty in irrigating this portion of land. If that property is used for another purpose in the future, reconstruction or relocation of the access in that corner may be necessary. This will require an access permit. It appears that access to the storage tanks in the NW corner of the property is currently being made through the west- most driveway.
