BOGOTT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1493, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1493 was submitted by Gary L. and Tina J. Bogott for property which is located in part of the NW* of Section 31, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 84.5 acres and 2.7 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. Within 30 days of approval by the Board of County Commissioners, the applicants shall apply for a new well permit for the larger lot to indicate the revised tract size. 3. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 930412 pP1C19- CC ; �� APPd. Prior to recording the plat, the applicant shall submit evidence to the Department of Planning Services that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 5. The Recorded Exemption plat shall show a 60-foot right-of-way reservation east from the centerline of Weld County Road 1. 6. The following note shall be placed on the Recorded Exemption plat prior to recording: a. Any use of the shore and the Union Reservoir is subject to the City of Longmont's rules and regulations. 7. Prior to issuance of a building permit for the new home on Lot B, the applicants shall eliminate the north access on Lot A. The parcel of land on which this request is being made is described as part of the northwest quarter of Section 31, T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located east of Weld County Road 1, and approximately 1 mile south of Highway 66. The parcel under consideration is the total contiguous land holdings of the applicants. The request is to divide an 87.2 acre parcel into two parcels of 84.5 and 2.7 acres, more or less. The applicants want to sell the 2.7 acre site to provide the capital necessary to establish the St. Vrain Simmental operation on the remaining acreage. Longs Peak Water District serves the habitable dwelling on the proposed 2.7 acre lot. The applicants propose serving the remaining property with a domestic well. Septic systems would provide sewage disposal. The staff is concerned about the level of development in the area, specifically along Weld County Road 1 and around the Union Reservoir. As shown on the attached aerial photograph, twelve parcels of land currently access onto Weld County Road 1 within a one mile section. Five of the parcels were created using the recorded exemption process. The other lots were divided prior to August 30, 1972, the date the County's subdivision regulations became effective. The effect of these land divisions has been to create a linear subdivision, which is not consistent with efficient and orderly development and which also creates a demand for more services from the County and other service entities. Application for Recorded Exemption Gary & Tina Bogott Weld County Item 6 - Water Supply The existing residential unit on proposed Lot "A" of the subject property includes one Longs Peak Water District domestic water tap. The proposed residential unit on proposed Lot "B" will have domestic water from a ground water well . Please see the attached "Permit to Construct a Well" issued by the Colorado Division of Water Resources. All conditions of approval stipulated by the well permit will be complied with. The attached letter from Longs Peak Water District explains that a water tap is not available from the existing 1-1/4 inch water line. It is not economically feasible for one homeowner to bear the cost of extension of that line. Item 7 - Sewage Disposal The existing residential unit on the proposed Lot "A" is serviced by an existing septic tank and leach field. The Weld County Health Department booklet, "Individual Sewage Disposal System" has been reviewed. This guidance will be followed for permitting and installation of the new septic system required for the proposed residential unit on proposed Lot "B" . Item 8 - Property Usage The entire 87 .2 acre site is considered irrigated crop land. Currently approximately 31 acres is planted in alfalfa and harvested for approximately 950 bales of hay per year. The remaining 65% of the land is weeds, natural grasses, and prairie dogs, which do not contribute productively. In January, 1993 approximately 44 head of pure-bred Simmental cattle were introduced to this site. It is planned to use the 84 . 5 acres of Lot "B" for winter pasture and summer alfalfa and grass hay production. Lot "A" consists of 2 .7 acres of pasture including an existing 1500 square foot principle residence, an old labor' s house and a 3-sided 6 930412 f shed (labeled "barn" on the attached map) . See the attached map in Item 17 . Several irrigation ditches cross the property and a gas and oil production operation is located on the east side of the property. Item 9 - Purpose This request for a recorded exemption is being made to allow St. Vrain Simmentals to establish a base of operations in Weld County. This proposal calls for dividing the existing 87 .2 acre lot into one 2 .7 acre site (Lot "A") with a house and two outbuildings, and one 84 . 5 acre site (Lot "B") . The house is currently a rental property in relatively poor condition. The 2.7 acre site and the existing structures will be sold to provide the capital necessary to establish the St. Vrain Simmental operation on the remaining 84 .5 acres. Item 10 - Location The site of this proposal is located in the Northwest Quarter of Section 31, Township 3 North, Range 68 West, of the 6th Principal Meridian, Weld County Colorado. This site is approximately 1 mile south of Highway 66, east of Weld County Road 1 and identified as address 12922 Weld County Road 1 . This parcel is 87 .2 acres and is used for agricultural purposes . Item 11 - Consistent with WCCP This proposal is consistent with the policies of the Weld County Comprehensive Plan (WCCP) . The Plan promotes agricultural productivity. This proposal enhances the agricultural use of the subject property. Currently approximately 31 acres of the 87 acres is planted in alfalfa and harvested for approximately 950 bales of hay per year. The remaining 65% of the land is weeds, natural grasses, and prairie dogs, which do not contribute productively. This proposal 7 930412 will maintain the alfalfa production while establishing a grass hay crop. In addition the introduction of livestock to this property will complete the agricultural cycle. This proposal will contribute substantially to the economy of Weld County. Approximately 45% of the hay production from this land will be available for sale to other livestock owners in Weld and Boulder Counties. The livestock produced will be sold in accordance with St. Vrain Simmentals marketing strategies as breeding stock (see Item 18) . Over 80% of these sales will contribute to Weld County' s export income. The current plans for development of this property call for initial expenditures in excess of $100, 000. The expenditures will be for fencing products, the construction of a barn and corrals, and other agricultural capital items . In addition, annual operating costs are expected to exceed $15, 000, for fertilizer, grain, farming equipment, irrigation products, and fuel. Approximately 75% of these purchases will be made from local Weld County businesses. This 87 acre property is not located in an Urban Growth Boundary Area. It is understood that the addition of another residential unit along this stretch of Weld County Road 1 is not encouraged. However, this proposal will increase Weld County tax revenues without a proportional increase in demand for public services . The owner' s additional residential unit will not add children to the Mead school district, and the owners are both construction professionals who will install the appropriate systems to minimize the impact to local fire and police protection services . Weld County Road 1 is classified a "county arterial" which is sized to service 650 or greater vehicles per day. This arterial should not be adversely effected by an additional driveway. Provisions shall be made on the proposed driveway for forward entrance onto Weld County Road 1 . The Weld County Comprehensive Plan calls for agricultural goals and "institute policies that will encourage the agricultural uses in Weld County and promote the agricultural use of prime 8 930412 agricultural land" . This proposal increases the agricultural use of this prime irrigated land. The owners believe that this proposal provides for the most complete and beneficial use of this land. This proposal is in line with Weld County' s goal to provide land-use policies which foster economic health and the continuance of agriculture. Item 12 - Surrounding Land Uses This proposal calls for the land to be used for agricultural purposes, this is compatible with existing surrounding land uses . The land to the north is zoned R-1 but is currently planted in corn and harvested annually. Land to the West consists of Jim Hamm' s Nature Area operated by the Longmont Parks Department, and land owned by Hewlett-Packard, Inc. currently planted in corn. This land, to the west, is zoned "Major Industrial" by the Longmont Area Comprehensive Plan (LACP) . Land to the south is zoned agricultural with several single family residential units on lots ranging from 1/2 to 11 acres . East of the property is Union Reservoir. The City of Longmont owns controlling interest in this recreational and irrigation storage body of water. Item 13 - Consistent with Zoning The subject property is located in an "A" - Agricultural District. Section 31 of the Weld County Zoning Ordinance has been reviewed and this proposal is in accordance with these procedures . This proposal calls for plans to construct one single family dwelling unit, grazing of livestock, and animal boarding which does not exceed 4 animal units per acre or 60 vehicular traffic trips per day. All of these activities are within the requirements of Subsection 31 .2 "Uses by Right in the A District" . In addition, the owners propose the construction of a structure for storage of equipment and agricultural products, and buildings for the confinement or protection of livestock in accordance with Subsection 31 .3 "Accessory Uses in the A District" . Feedlot operations are not anticipated. 9 930412 Section 50 of the Weld County Zoning Ordinance has been reviewed and the subject property is not located in a geologic hazard, or Weld County Airport overlay district. The portion of the property immediately adjacent to Union Reservoir is in the 100- year floodplain. No development is planned for the floodplain area. Item 14 - Efficient and Orderly Development This proposal is consistent with efficient and orderly development. The plans as outlined above provides only minimal structural development while maximizing the agricultural use of the subject property. The agricultural uses associated with this proposal are compatible with the future development of the surrounding area. The owners are aware of future plans by the City of Longmont to expand Union Reservoir. The 20 to 30 year plans by the City of Longmont calls for an extension of the existing dam and enlargement of Union Reservoir which would submerge approximately 70% of the subject property. The new structures proposed are sited well above the planned shoreline, only fence materials will be sacrificed. All existing structures are well above the proposed shoreline. Union Reservoir expansion plans practically eliminate any plans for subdevelopment proposals on this site. The owners are not knowledgeable of Hewlett-Packard Inc. ' s plans for development on the land to the west. Land use of the lots located north and south of the subject property are currently agricultural and rural residential and are not expected to develop in the near future. Item 15 - Subdivision Ordinance Section 11 . 8 of the Weld County Subdivision Ordinance has been reviewed. This proposal is in compliance with the recorded exemption standards . 10 930412 Item 16 - Health, Safety, and Welfare This proposal is consistent with providing for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and Weld County. All applicable codes, standards, and regulations will be complied with during the operations associated with this proposal . Item 17 - Map See Attached Map. Item 18 - Other Information St. Vrain Simmentals Outline of Operation St. Vrain Simmentals is a wholly owned registered purebred cattle operation. SVS began in February, 1976 realizing the Simmental breed' s potential for commercial operators. The herd has grown through the years, with a severe reduction in 1980 due to a divorce and then a stable reintroduction of cattle since October 1988 . With a farming background, the focus of SVS is on producing registered bulls for commercial and seedstock operators . The major form of advertising and merchandising for SVS has been through consigning bull calves to the Colorado Simmental Association Bull Test, the Northeast Colorado Bull Test, and the Southeast Colorado Bull Test. These tests allow us to compare our herd to other breeders throughout the Rocky Mountain Region. We have kept the best producing heifers in our herd and culled individuals which have not met our high performance standards .
