RESOLUTION
RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL) TO I-3 (INDUSTRIAL) FOR CHARLES
AND BARBARA PATTERSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 21st day of August, 1991, at
10:00 a.m. for the purpose of hearing the application of Charles and Barbara
Patterson, 5198 Weld County Road 49, Hudson, Colorado 80642, requesting a Change
of Zone from A (Agricultural) to I-3 (Industrial) for a parcel of land located
on the following described real estate, to-wit:
Part of the Si SE4 of Section 19, Township 1 North,
Range 66 West of the 6th P.M. , Weld County, Colorado
WHEREAS, the applicants were represented by Fred Otis, Attorney, and
WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides
standards for review of such a Change of Zone, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and, having been fully
informed, finds that this request shall be approved for the following reasons:
1. The applicant has complied with all the application requirements
listed in Section 21.7 et seq. , of the Weld County Zoning Ordinance.
2. The request is in conformance with Section 21.6 of the Weld County
Zoning Ordinance as follows:
A. The proposal is consistent with the policies of the Weld
County Comprehensive Plan, and the overall Plans of Brighton
and Fort Lupton area.
B. The original Zoning was not faulty; however, it is no longer
valid as changing conditions in the area warrant a Change of
Zone.
C. The uses allowed on the property will be compatible with the
surrounding land uses.
D. There is adequate water for the proposed use.

RE: CHANGE OF ZONE - PATTERSON
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Charles and Barbara Patterson for a
Change of Zone from A (Agricultural) to I-3 (Industrial) on the above referenced
parcel of land be, and hereby is, granted subject to the following conditions:
1. The following notes shall be placed on the Change of Zone plat,
prior to recording:
A. This Change of Zone site shall be maintained in compliance
with the Flood Hazard Overlay District Requirements as stated
in the Weld County zoning Oridnance.
B. A site plan review is required in accordance with Section 23
of the Weld County Zoning Ordinance.
2. The Change of Zone plat shall be amended to show:
A. The present zone of the property as A (Agricultural) .
B. A right-of-way reservation of forty feet north of the
centerline of Weld County Road 6.
3. Within 30 days of approval by the Board of County Commissioners, the
mobile home on the property shall be brought into compliance with
the Weld County Zoning Ordinance.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21st day of August, A.D. , 1991.

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE DENIED
FOR THE FOLLOWING REASONS:
1. The request is not in conformance with Section 21.5 of the Weld County
Zoning Ordinance as follows:
- The proposal is not consistent with the Urban Growth Boundary Goals
and Policies of the Weld County Comprehensive Plan. The Urban
Growth Boundary goals provide that urban development should be
concentrated in or adjacent to existing municipalities. The Urban
Growth Boundary policies provide that land-use development proposals
shall be encouraged as long as they conform to the desires of the
municipality within whose urban growth boundary the use is located.
The City of Brighton Planning Department, in its May 31 referral
response, has stated that their comprehensive plan calls for the
Platte River Valley to be low density residential development and
large open space areas, but that the comprehensive plan also
identifies U.S. Highway 85 as a potential mixed use commercial and
industrial corridor as well. It is the opinion of the Department of
Planning Services' staff that the concerns raised by the City of
Brighton Planning Department regarding maintaining an overall
aesthetic environment in this area, could not be satisfactorily
mitigated with the uses which could be allowed in the proposed zone
district. The purpose of the I-3 District is to provide a zone to
accommodate industrial uses which may create adverse visual impacts
for adjacent uses. The Weld County Zoning Ordinance states that
such uses may require locations relatively isolated from other land
use types. Although screening is required for any storage areas in
the I-3 zone district, the location and elevation of the proposed
rezoning property prohibits adequate screening of storage areas from
adjacent uses.

- The property is currently zoned Agricultural. The Agricultural
section of the Weld County Comprehensive Plan states: "Individuals
who find themselves with land designated and zoned in a manner that
does not accommodate their intended use should consider seeking
other more suitable land; such a transition will be to the long-term
benefit of both the individual and the public. "
- The application has not adequately shown that the zoning of the
property is faulty or that changing conditions in the area warrant
a change of zone. The Industrial zoning to the south and to the
northeast of this site was granted prior to the adoption of the Weld
County Comprehensive Plan. The Comprehensive Plan discourages uses
other than park, recreation, and open space areas in floodplains.
- The uses which would be allowed on the subject property by granting
the change of zone will not be compatible with the surrounding land
uses. Uses allowed by right in the I-3 (Industrial) zone district
include any use of a research, repairing, manufacturing,
fabricating, processing, assembling, or storage nature. The site
proposed to be rezoned is bordered on the east by U.S. Highway 85.
Immediately east of the highway is a mobile home park. Potential
industrial uses allowed by the I-3 (Industrial) zone district are
not compatible with existing uses.

Dear Mr. and Mrs. Patterson:
Your application and related materials for the request described above are
complete and in order at the present time. I have scheduled a meeting with
the Weld County Planning Commission for July 2, 1991, at 1:30 p.m. This
meeting will take place in the County Commissioners' Hearing Room, first
floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance to
answer any questions the Planning Commission members might have with
respect to your application.
It is the policy of Weld County to refer an application of this nature to
any town or municipality lying within three miles of the property in
question or if the property under consideration is location within the
comprehensive planning area of a town or municipality. Therefore, our
office has forwarded a copy of the submitted materials cto the Brighton and
Ft. Lupton Planning Commissions for their review and comments. Please call
Jim Sayre, City of Brighton at 654-1638, and Tracy Reynolds, City of Ft.
Lupton at 857-6667 for further details regarding the date, time, and place
of these meetings. It is recommended that you and/or a representative be
in attendance at the Brighton and Ft. Lupton Planning Commission Meetings
to answer any questions the Commission members may have with respect to
your application.
It is the responsibility of an applicant to see that a sign is posted on
the property under consideration at least 10 days preceding the hearing
date. Sometime prior to June 20, 1991, you or a representative should call
me to obtain a sign to be posted on the site no later than June 22, 1991.

Dear Commissioners:
Please be advised that I represent the interests of Barbara
and Charles Patterson with regard to the attached Rezoning
Application. Barbara and Charles Patterson are the major
shareholders of C-MEC Oilfield Construction, Inc. Mr. and
Mrs. Patterson have contracted to purchase the property which
is the subject matter of this Application from the now owners
of such property, Joseph F. Mollendor and Sandra L. Mollendor.
The purchase contract is contingent on approval of the
Rezoning Application. If the Rezoning Application is ap-
proved, Barbara and Charles Patterson will lease the property
to C-MEC Oilfield Construction, Inc.
The below-numbered paragraphs are responses to the Rezoning
Procedural Guide and Section 21 .7, et seq. , of the Weld County
Zoning Ordinance.
1 . A completed Application form is attached.
2 . The subject property is presently zoned "Agricultural"
despite the fact that it is only 9 .955 acres and, therefore,
not an economically farmable unit. It is further not suitable
as agricultural land because it is situated between U. S.
Highway 85 and the South Platte River. The property is not
presently being farmed. The only improvements on the property
are a mobile home and a three-stall garage. The properties
surrounding the subject property are generally in commercial
and industrial uses compatible with the proposed rezoning of
the subject property. Numerous changes have occurred along
the Highway 85 corridor and in the immediate area of the
subject property that justify the rezoning of the subject
property. Further, in view of the small size of the parcel ,
the fact that it is not, nor has it in the recent past been
farmed, the flood zone and location of the property and
surrounding uses indicate that there was faulty zoning when
the property was originally classified as agricultural .

3 . The proposed usage of the subject property by the
Applicant is I-3 and the specific use by the Applicant is as
an office for an oilfield construction company; i.e. , C-MEC
Oil Field Construction, Inc. , and attendant storage of the
company' s equipment.
The properties immediately adjacent to the subject property
are as follows :
(a) West and across the river is agricultural .
(b) East and across Highway 85 is a mobile home park/oilfield
construction and storage.
(c) South and across Road 6 is a cement plant.
(d) North is residential (sign says they make horse blan-
kets) .
4. The water service for the property is presently supplied
by a domestic well . Applicant will apply for an exempt
commercial well . The only usage of water will be for indoor
use and will consume less than 1/3 acre foot of water. The
sewer is provided by septic.
5 . A soil survey and study of the site proposed for the
change of zone with a statement of the suitability of soils
to support all uses allowed in the proposed zone is attached.
6 . The road and/or highway facilities accessing the property
are excellent. The property is serviced by Highway 85 on the
east and Road 6 on the south. Access directly onto the
property is from Road 6 .
7 . The Weld County Department of Planning Services has
advised that there appear to be sand, gravel or other mineral
resources on or under the subject property and, accordingly,
a mineral resource statement is attached.
8 . The subject property is not in the geologic hazard and/or
Weld County Airport Overlay District. The property is in the
flood plain as shown on the attached rezoning map.
9 . A copy of the Deed showing the ownership of Joseph and
Sandra Mollendor in the property is attached. Barbara and
Charles Patterson are the contract purchasers of such pro-
perty. A letter granting power of attorney to Barbara and
Charles Patterson from Joseph and Sandra Mollendor is at-
tached.

10 . Attached is a certified list of the names, addresses and
the corresponding parcel identification numbers assigned by
the Weld County Assessor of the owners of property (the
surface estate) within 500 feet of the property subject to the

Environmental Protection Services has reviewed this proposal and recommends for
approval, subject to the following conditions:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. Any required Emissions Permit is obtained from the Air Pollution Control
Division, Colorado Department of Health for fugitive dust and odors.
3. No permanent disposal of wastes shall be permitted at this site.
4. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
5. Fugitive dust shall be controlled on this site.
6. The maximum permissible noise level shall not exceed the industrial limit
of SO dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
7. An I.S.D.S. Evaluation on any existing septic systems will be necessary,
prior to issuing the required septic permits on the existing systems.
S. A bathroom with adequate toilet facilities served by an individual sewage
disposal system, may be required for the proposed facility and shall be
installed according to the Weld County Individual Sewage Disposal
Regulations.

The only concern that I would like to address with this zone change is the flood
plain. FEMA's Flood Insurance Rate Map panel 080266 0983 C revised September 28,
1982 indicates, as shown in the application, that about 50% of the proposed zone
change land is in the 100 year flood plain. My concern would be the placement
of a structure or equipment or some other type of water flow restriction in the
known flood plain. There is no indication from the application where the
structure will be located. There is no indication if the equipment will be
stored inside of a security type fenced area that may be damaged by a flood or
change the flow of the water during a flood.
I have no other concerns or conflicts with this application.

Dear Keith:
Please be advised that the City of Brighton has some concerns and would
like some additional information, concerning the Application for rezoning
of the above-referenced property from agricultural to industrial. The
Community Development Department feels that the application is very
inadequate in the detail provided in several key areas of concern:
1 . Proposed Use - there is no site plan detailing how C-MEC Oil Field
Construction, Inc. will improve the site for the intended purpose of
office and equipment storage. Where will the off-street parking for
the office staff and visitors be located? Will there be paved parking
and screening for stored vehicles and equipment. We would like to have
some detail about the operation i .e. , hours of operation, days per
week, potential amount and type of equipment and trucks to be stored,
and in what manner (no junkyard) , etc.
2. Drainage Report - it is extremely difficult to assess storm water
runoff impacts without an engineer's drainage report, showing historic
on-site and off-site storm water flows and the impact of the proposed
site improvements on these flows. Has the applicant or the county made
a determination that the impact of the site improvements on drainage
will be "insignificant" and if so, how can this be done without a
drainage study to support this?
3. Landscape Requirement - we feel that an adequate landscape buffer
along US 85 is required for such a heavily traveled corridor. This is
an important travel corridor for Weld County and needs to be
maintained as an important entry statement for the area. We feel that
screening of this site should be done with ample landscaping adjacent
to US 85. Due to the difference in elevation, traffic traveling south
on US 85 has a clear view down into this site. Landscaping in the form
of a row of 8 foot to 10 foot tall evergreens planted every 5 feet to
10 feet along the highway would help to screen off the industrial
activity from the view of motorists. There also needs to be detailed
landscaping plan as to precise type and caliper of the trees and
shrubs to be used, any grass to be planted and the maintenance of any
"native vegetation" to remain. ,� ,�2

4. Traffic Impact - has consideration been given to the traffic
impact of this change in use upon Weld County Road 6? Is there a
traffic impact analysis being done by the applicant?
5. Flood Plain - is this use compatible with the 100 year flood plain
which has been identified as passing through the middle of this site.
Are there adequate safeguards against flooding? What are the
potential downstream impacts from this proposed development? Will any
impacts be mitigated by the applicant?
The Brighton Comprehensive Land Use Plan calls for the Platte River Valley
to be low density residential development and large open space areas. It
also, states the need for greenbelt trails connecting Brighton and other
Weld County communities with the natural amenities along the Platte River.
The Comprehensive Plan identifies US 35 as a potential mixed use commercial
and industrial corridor, as well . The County must work to protect
aesthetically pleasing areas such as the Platte River Valley, while
balancing the need for economic development along this important travel
corridor. Weld County needs to maintain an overall aesthetic environment of
the type necessary to attract upscale development, expected to be generated
by the new international airport by insuring quality development along
important travel corridors, especially where they come close to
environmentally sensitive areas.

Re: Patterson Rezoning (your case number Z-461)
Gentlemen:
At your request and in accordance with S.B. 35 (1972) we have reviewed the materials
submitted for and made a field inspection on June 3, 1991, of the area of the proposed
rezoning referenced above. The following comments summarize our findings.
(1) Because part of the property lies within the 100-yr floodplain of the South Platte River,
we recommend that, after the area is rezoned industrial, this part be used only for parking
and storage of equipment, not for construction of permanent buildings. Similarly, utilities
and a septic-system leach field should not be placed in this area.
(2) The proximity of the property to US Hwy 85 and Weld County Road 6 and the situation
where the property is below the grade of both roads probably will make it advisable to
control drainage runoff from the roadways onto the property. Properly sloped interceptor
ditches will be the most economical and probably the most effective way to do this.
(3) Although the quality of gravel beneath this site is high, the effectively mineable parcel
is so small that mining gravel under current economic conditions is not feasible.
(4)A septic-system leach field will have to be engineered to maintain acceptable percolation
rate(s). In the long term, periodic replacement of it probably will be necessary.

Dear Ms. Swanson:
We have reviewed the above referenced proposal to rezone a 9.995 acre parcel to
allow use as an office and equipment storage facility. A mobile home is currently located
on the property and utilizes an unregistered well as its water supply. The proposed water
supply is to be from the existing well, which is proposed to divert water under a new small
capacity commercial well permit.
If the applicant can document that the existing well was constructed and put to use
for domestic purposes prior to May 8, 1972, then the well may be late registered for that
use . After a well permit is obtained, the applicant may apply to change the use to exempt
commercial use under Section 37-92-602 (1) (c), C.R.S. (1973). The new permit will limit
use to drinking and sanitary use inside one individual business. No outside use for
irrigation or vehicle washing will be permitted. If the conditions stated above can be met,
then we have no objection to the proposal and recommend approval. If you have any

to I-3 for part of the South one-half of the Southeast one-quarter
of Section 19, Township 1 North, Range 66 West of the 6th Principal
Meridian, Weld County, Colorado as shown on the proposed re-zoning
map.
Dear Ms. Swanson:
The following soil survey information and discussion are hereby
being submitted in support of the referenced zone change submittal.
Soils contained on the site are shown and described on the included
site map, narrative, and tables from the Soil Survey of Weld County,
Colorado, published by the United States Department of Agriculture,
Soil Conservation Service. Soils on the site consist of two types:
Soil Unit 3, Aquolls and Aquents, and Soil Unit 68, Ustic
Torriorthents.
With regard to Soil Unit 3, Aquolls and Aquents, the included
information indicates that there would be problems associated with
zone I-3 uses of this soil type primarily because of its
susceptibity to flooding and wetness. However, a comparison of the
proposed re-zoning map and the site plan map shows that the 100 year
flood plain and the boundary of Soil Unit 3 approximately coincide
as the two limits cross the property. Therefore, structures would
need to be elevated if constructed over soil unit 3, and problems
due to the wetness could be solved with the use of proper
engineering design for drainage and structures.
With regard to soil unit 68, Ustic Torriorthents, the included
information indicates that there may be moderate to severe problems
with the construction of sanitary facilities and moderate problems
with building site development because of slope. However, these
problems could be overcome with proper design of septic facilities
and drainage for roadways and building sites. Building foundations
are commonly designed for all types of soil situations, and designs
for structures on soil unit 68 would work very well because of
excellent bearing capacity of the under laying gravel material.

of the subject property are suitable to support all uses allowed in
the proposed I-3 zone.

Dear Ms. Swanson:
I have reviewed the referenced property with regard to the economic
feasibility of extracting gravel. This property contains an
:...pderlaying gravel deposit of 12 to 20 feet thick for an approximate
total deposit of 190, 000 to 325,000 cubic yards. However, the
dimensions of the property, approximately 1278 feet in the North-
South direction, 245 feet accross the North boundary, and 381 feet
accross the South boundary would make the digging of gravel pits
with sloped side slopes and adjacent access highly impractical.
Also, engineering and permitting costs would be very high relative
to the value of the deposit assuming the total deposit could be
recovered, which is not a possibility. For these reasons, it is my
opinion that the recovery of gravel now or in the forseeable future

would not be economically feasible.

NEW BUSINESS
Weld County Referral : Z-461, Zone Change from A to I-3,
Application by Charles & Barbara Patterson.
There was discussion on this application regarding the
appropriateness of extending industrial use into an
agricultural area. The applicants stated that the use would
not be negative since they would only be using it for office
space and storage of their equipment . Looking at Weld
County's zoning book, a special use application was mentioned
as an alternative to rezoning, but the applicant felt that
this would reduce the resale value of the land and therefore
did not wish to pursue that option. Appearance on the Highway
85 corridor approach was a priority to the commission members .
They felt that screening was important. Because of the
elevation (depth) of the site in relation to the highway, tree
planting was recommended, understanding that it would take
considerable time for the trees to reach a height that would
screen the site . The applicant stated that they would try to
maintain the current level of landscaping, but that they would
be limited because of the change in water rights resulting
from the change in use (purchase of additional water for
augmentation would be required) .
Board Action: It was moved by Bernie Schmanski and seconded
by Gene Reynolds that the commission recommend approval of the
zone change with the condition that trees be planted for the
eventual screening of the site. The motion passed
unanimously.

Replat of Tract A, Mountview Subdivision
The Commissioners discussed the "greenbelt" area (Tract A) of
the Mountview Subdivision which had never been developed
according to the Annexation-Utility Extension Agreement, and
which was becoming a City maintenance liability.
Commissioners initially discussed the possiblity of deeding
the land to all adjacent property owners . However, there was
concern that green area for the neighborhood as well as
considerable real estate cost would be sacrificed . Gene
Reynolds proposed that the city look at an exchange of several
of the undeveloped lots for the required landscaping. Such an
option would provide a larger, more accessible and usable park
area than the original belt concept.
Board Action: The commission recommended that the City write
a letter to the original developer, Rennoc Corporation,
proposing that they obtain lots 4 through 9 of Block 3 to be
given to the City. The City would then assume responsibility
for development of the green area and the developer would be
relieved of the obligation of the sprinkler system and
landscaping requirements that were required in the original
annexation agreement.
There being no further business, the meeting was adjourned .

the purchase of the property by the Pattersons depends on approval of the
application by the Planning Commission. The Patterson's service oil fields.
Pick-up trucks will be parked on the property at night only. They will employ
2 secretaries during the day using the mobile home presently located on the
property.
Mike Patterson, representative for Charles and Barbara Patterson, presented
photographs (Exhibits A through I) of surrounding properties zoned Industrial.
Ann Garrison asked about the source of water to the property. Mike Patterson
said they have a well on the property for in-house use only. Fred Otis explained
that water could be trucked in to provide an additional source for landscaping.
Jerry Kiefer asked about the floodplain issue. Lanell Swanson explained that new
structures will have to be within code requirements for floodplain areas.
Fred Otis discussed the problem the surrounding town and city governments have
in understanding the Change of Zone issue.
The Chairman asked if there was anyone in the audience who wished to speak for
or against this application.
John Nolan, surrounding property owner, said he had no objection to the zoning
change but 2 nearby properties have been for sale for a considerable time. What
about using existing Industrial property instead of converting more. Ann
Garrison asked if this property has been used recently as zoned. John Nolan said
there had been no cultivation in years, but occasionally horses graze it.

T5N, R65W of the 6th P.M. , Weld County, Colorado.
LOCATION: East of Balsam Avenue; approximately 300 feet south of East 18th
Street (Highway 34) .
Fred Otis, Attorney, representative for Gerrity Oil and Gas Corporation,
explained this property is a non-conforming use under present zoning code.
Gerrity Oil and Gas Corporation plans to use the facility as an office with
vehicle traffic heavier in the morning and afternoons. There will be indoor
parking for vehicles stored overnight. East Greeley is a mixed-use area and at
the present time this facility is not being used. It could be productive if the
Planning Commission would recognize this and allow a change of zone.
Wendell Jamison, Manager, Gerrity Oil and Gas Corporation, gave an overview of
the screening that now exists and future plans for more extensive screening if
the application is approved. Photographs (Exhibits A through L) were shown of
similar uses of property in the immediate area.
Robert See, Owner, explained that quality of life is important and this area is
definitely not a residential area. The facility is a steel building with 5
offices that was developed in the early 1960's. It has been used by a trucking
company, irrigation equipment company, excavating company, and finally a marble
company. The property directly across the street, same distance from the church
and school, was granted C-3 zoning. This property was mis-zoned originally.

A public hearing was conducted on August 21, 1991, at 10:00 A.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 15, 1991, and duly
published July 18, 1991, in The New News, a public hearing was conducted
to consider the request of Charles and Barbara Patterson for a Change of
Zone from A (Agricultural) to I-3 (Industrial) . Lee Morrison, Assistant
County Attorney, made this a matter of record. Lanell Swanson, Planning
Department representative, recommended the Resolution of the Planning
Commission and the Planning staff's recommendation be entered into the
record as written. Fred Otis, Attorney, represented the applicant, and
stated they were agreeable to this. Mr. Otis explained that the
Pattersons are going to buy this property if their request is approved
today. They will be storing equipment used in their oil business on said
property, which already has a mobile home and a three-car garage on it.
He said the mobile home would be used as an office, and the property is
not currently being used, nor has it been recently, for agricultural
purposes. Mike Patterson spoke on the uses of the surrounding properties,
which are mainly zoned Industrial. The Board looked at some pictures of
said properties, which were presented at the Planning Commission hearing.
Mr. Patterson answered questions of the Board concerning the size and use
of their equipment and the well, which Ms. Swanson stated is commercial
exempt. After further discussion, Mr. Otis made closing comments and said
a site plan had been prepared and presented to the Planning Commission.
There was no public testimony concerning said matter. Commissioner
Webster questioned whether the applicant had a problem with the
recommendation from the City of Fort Lupton concerning the screening. Mr.
Otis said there was somewhat of a problem because of the lack of water and

Swanson explained that the screening would be handled when the site plan
is reviewed. Mr. Patterson stated there are some mature trees there now,
and they will be planting more. Commissioner Kennedy moved to approve the
request of Charles and Barbara Patterson for a Change of Zone from A
(Agricultural) to I-3 (Industrial) , and stated the consistency with the
Standards for said request. Commissioner Kirby seconded the motion. Mr.
Otis stated the applicant had no objections to the Conditions of Approval.
Commissioners Kennedy and Kirby agreed to the inclusion of the Conditions
of Approval in the motion, which carried unanimously.
