This agreement is required by the Freeway law whenever a State highway is made a Freeway. I think the terms of the proposed agreement explain themselves; they should do so, of course. Will all three members of the Board kindly sign at the place indicated, and have the signatures attested by the County Clerk, with the County seal, and return the three copies to this office for completion, after which one fully executed copy will be returned to you for your files. Div. re FAP 204(2) (Weld County) AGREEMENT al THIS AGREEMENT, dated this Aid/ Q day of , A.D. 1947, by and between the STATE HIGHWAY DEPARTMKN f the State of Colorado, hereinafter called the "Department, " and the COUNTY OF WELD, State of Colorado, hereinafter called the "County, " WITNESSETH: WHEREAS, under authority of the laws of the United States and of the State of Colorado, by and with the concurrence and approval of the United States Public Roads Administration of the Federal Works Agency, certain Federal and State Funds have been allocated for the purpose of improving a portion of State Highway No. 3 which passes through the County, said improvement being known as Project FAP 204(2) , which project is partially within the Town of Evans, the route and general plan of such project being shown on Exhibit"A" which is at- tached hereto and by reference incorporated as a part hereof, and 'SREAS, in accordance with the laws of the State of Colorado, said portion of State Highway No. 3 in said County as so improved, will be designated a Freeway, and WHEREAS, the parties hereto desire to agree upon the location of said portion of State Highway No. 3 through the County, and also desire to agree, as required by the Freeway law of the State of Colorado, upon the extent to which egress and ingress from and to said portion of said State Highway No. 3 will be permitted, NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements herein contained and the faithful performance thereof, the parties hereto promise and agree as follows: 1. The Department will make all plans and specifica- tions for the project and will let the contract for and /u^/ / -'/:? -1- supervise the construction of the project, all with funds allocated by the Federal and State Governments and without any expense to the County for such construction. 2. The County agrees to the general location of said portion of State Highway No. 3, as such location is shown on Exhibit "A". 3. The County agrees, as and when requested by the De- partment, to assist the Department in procuring the necessary right of ways required for the project, following the pro- cedure set forth in General Memorandum No. 149 of the Public Roads Administration, payment for said right of ways to be made from the balance in Weld County's share of the Special 3% Motor Fuel Fund on March 31, 1947. 4. The County and the Department agree that egress and ingress from and to said Freeway shall be permitted only at the following locations as shown on Exhibit "A": C. On both sides of the Freeway at its intersection with the north boundary of the Town of Evans. D. On the West side of the Freeway, at 24th Street in the City of Greeley. E. On both sides of the Freeway at its junction with 8th Avenue at 22nd Street in the City of Greeley. The present highway will be used as a service road from 22nd Street in Greeley southerly to the Town limits of Evans. A service road will be built on the easterly side of the Freeway from 24th Street in Greeley, southerly to the Town limits of Evans. Both service roads are shown on Exhibit "A". 5. The County and the Department agree that no ingress or egress to or from said Freeway shall be permitted, except as provided in Paragraph 4 above, and in connection therewith the County agrees if and when, and to the extent requested by the Department, to prevent and prohibit ingress and egress to and from said Freeway, and from and to all streets, avenues, boulevards, alleys and other public ways, except as provided in Paragraph 4 above; provided, however, that points of ingress -2- and egress to and from said Freeway may be changed or altered from time to time by mutual agreement of the parties hereto with the concurrence of the U.S.Public Roads ridministration. 6. This agreement may be modified at any time by the mutual consent of the parties hereto, as may become necessary for the best accomplishment through State and County coopera- tion of the whole Freeway project for the benefit of the traveling public . All of the covenants and agreements herein contained shall be binding upon and inure to the benefit of the suc- cessors and assigns of the parties hereto respectively.
