This letter is to confirm our telephone conversation of Tuesday, December 13, 1994 in which you
requested an extension of approximately 60 days in which to submit the application materials for the
necessary permits for Rex Hiner. The violation (VI-2120) was continued for hearing to
December 13, 1994. By oversight it was not on the Board of County Commissioners' Violation
Hearing Agenda.
I spoke with Todd Hodges and Barry Kramer about the case. They have agreed to the continuance
of the violation hearing to February 14, 1995. You have agreed, on behalf of Mr. Hiner, to put
together the applications for the permits necessary to bring the Hiner property into compliance with
the Weld County Zoning Ordinance. The applications will be submitted to the Department of
Planning Services prior to February 14, 1995.

Subject: SUP-423, on-site visit of August 11, 1994, to determine compliance
with approved permit.
On August 11, 1994, I conducted a site visit with you. We drove around the
subject property and discussed several items concerning the site, what
constitutes a violation of the approved Special Use permit, and solutions for the
violations.
The first item we discussed was material storage within the 100 year floodplain.
Section 53. 7. 1.2 of the Weld County Zoning Ordinance indicates, "any use which
results in an alteration or relocation of a watercourse within the Floodprone
districts shall apply for and receive-approval of a Flood Hazard Overlay District
Development Permit. " To determine if material was stored within the Floodprone
district, I utilized a copy of the plat for this case which was recorded August
8, 1989, and confirmed the location of the Floodprone district with Floodway map
- -- Community #080266, Panel #0003, which was revised September 28, 1990.
The second issue we discussed concerns the oil and gas business operating from
- this- site. The use of this site° for an oil and gas support and service facility
requires an amendment to the approved special use permit, because this use is not
a use allowed by right in the A (Agricultural) zone district.

We also talked about the water ski use on one of the on-site lakes. This use is
classified as a recreational facility which also requires an amendment to the
special use permit, because recreational facilities are not a use allowed by
right in the A (Agricultural) zone district. As I understood from our
discussions, the people using the lakes for waterskiing are not associated with
the gravel mining operation.

Finally-, you- indicated to me• a desire to keep the uses which are already
approved,. including gravel mining, and concrete and asphalt batch plants, •and _
- would like to add water skiing and an oil and gas support and service facility.
- - ' To accomplish this,- an amended- special. use permit could be applied for which
would add both uses.
The materials stored within the Floodprone areas on-site would either need to be
removed, 'or a Flood Hazard Development permit would need to be applied for the
materials. If you determine the materials which are stored on-site will remain,
- staff- would need to evaluate whether the storage of materials at this site would -- -
constitute a material deviation from the Special Use permit which was approved
in 1980. Staff would evaluate impacts to determine if an amended special use
permit would be required for the material storage.

Structures, Inc. in regard to the SUP-423;80;13,
Precision Cast Structures, Inc. has purchased from Curtis
Strong, DBA, Strong Farms P. O. Box 10 Platteville, Colorado, the
following property:

Legal: A part of the N. W. 1/4 of Sec. 31 T.6N., R.65W. and a
part of N. E. 1/4 of Sec. 36, T.6N. R.66W. of the 6th P. M. Weld
County, Colorado. This property is zoned Agriculture with
SUP *2. 423 80 13.
In our review of the Special Use Permit, we have found that the
previous mining operator has mined to a location very close to the
location designated on the permit for the asphalt batch plant. We
also found that the previous operator has placed an asphalt plant on
the location designated for the concrete batch plant. We would ask
the Weld County Department of Planning Service's staff to consider
allowing Precision Cast Structures, Inc. to leave the existing asphalt
plant where it has been placed, with required County permits, and
allow Precision Cast Structures, Inc. to adjust the location for the
concrete batch plant to an area just north of the previously
designated area, please refer to the red line on the accompanying plot
plan. Precision will apply for all necessary permits for the concrete
batch plant to be placed on the location as well as the mining
equipment that will be set up on the location. With your staff
approval Precision Cast Structures, Inc. will make necessary
corrections on the original plot plan, sign and record them with Weld
County. Thank you for your cooperation in this manner.

Dear Mr. McConnel:
Thank you for your letter of June 8. The Department of Planning Services'
staff has reviewed your request. The Staff has determined that a concrete
batch plant, asphalt plant, and a sand and gravel operation could be
operated under a new owner provided that the special review plat map is
recorded as approved on April 20, 1980, and all building inspection and
State Health Department requirements are met.
To locate the concrete ready-mix batch plant, or the asphalt plant in a
location other than shown on the special review plat map, would be
considered a major change to the approved site plan review. A major change
to the approved plan would require the approval of an amended spacial review
permit.
Please call or write if you have any questions or need additional
information.

aggregate mining, and the asphalt production operations, at the
site as well as the addition of a concrete ready-mix batch plant
facility. Precision Cast Structures, Inc. needs a letter from your
office stating the requirements of Weld County for the specific use
and conditions of the property described above.
The discussion on the requirements for a Flood Hazard
Development permit concerning the concrete ready-mix batch
plant facility, was very helpful. After reviewing the proposed site
for the batch plant operation we found it to be located outside of
the designated flood plain on the map, (Firm Flood Insurance Rate
Map, Weld County, Colorado unincorporated Panel 628 of 1075
revised September 28, 1982 Community Panel # 080266-0628-C).
Please see attached maps for approximate location of the concrete
batch plant facility which will be on the property. Thank you for
