RE: APPROVE AUTHORIZATION FOR PEST INSPECTOR TO HAVE DUTCH ELM
DISEASED TREE REMOVED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Pest Inspector has advised the Board that
Phillip and Reba Lukas , owners of certain property described as
the SE} SEi of Section 35 , Township 7 North, Range 67 West of the
6th P.M. , Weld County, Colorado, have been notified by letter that
a tree infected with Dutch Elm Disease has been found on said
property, and
WHEREAS, property owners have been contacted, but they have
taken no action to remove said tree, and
WHEREAS, the Pest Inspector has requested that the Board
authorize him to have said Dutch Elm diseased tree removed from
the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Pest Inspector
be, and hereby is, authorized to have said Dutch Elm diseased tree
removed.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd. day of
July, A.D. , 1990 .

Dear Weld County Commissioners,
I am seeking your approval under the Pest Control Law, CRS
35-4-107(1) , to enter upon the land listed below, to remove a Dutch Elm
Diseased tree. The diseased tree is located at:
Phillip & Reba Lukas
T7N R67W SEC 35 SE4 SE4
Parcel $07053540011 and 070535400005
I personally contacted the landowner three (3) times in the Fall of
1989 and no action was taken by the landowner. A notice for removal of the
tree has since been sent to the landowner and again no action has been
taken. If this tree is allowed to stand it will be a source of infection
for other elms in northern Weld County. I wish to have this tree removed
at the landowners expense, pursuant to CRS 35-4-107(3) .
