IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 119 , WELD COUNTY
BUILDING CODE ORDINANCE, REVISING CERTAIN PROCEDURES, TERMS,
REQUIREMENTS, AND INCORPORATING BY REFERENCE. CERTAIN PORTIONS OF
THE UNIFORM BUILDING CODE, 1988 EDITION; NATIONAL ELECTRICAL CODE,
1990 EDITION; AND APPENDICES TO ALL UNIFORM CODES.

WHEREAS, the Board of County Commissioners of Weld County,
w Colorado, pursuant to Colorado statute and the Weld County Home

o Rule Charter, is vested with the authority of administering the
ow affairs of Weld County, Colorado, and

a WHEREAS, the Board of County Commissioners has the power and
o authority under the Weld County Home Rule Charter and Article 28
w of Title 30 , CRS, to adopt building codes for the unincorporated

x WHEREAS, the Board of County Commissioners of Weld County,
w Colorado, adopted Ordinance No. 119 , Weld County Building Code
o v Ordinance, establishing a comprehensive revision of the building
code requirements for the unincorporated areas of the County of
o H Weld, and has adopted amendments in Ordinances 119-A through
o H 119-F, and

WHEREAS, said Ordinance No. 119 , as amended, is in need of
N revision, updating, and clarification with regard to procedures ,

N Z NOW, THEREFORE, BE IT ORDAINED by the Board of County
o Commissioners of Weld County, Colorado, that said Ordinance No.
• 119 , as amended, is amended by the addition and revision of

phrase of this Ordinance is for any reason held or decided to be
invalid or unconstitutional, such decision shall not affect the
validity of the remaining portion. The Board of County
Commissioners hereby declares that it would have passed the
Ordinance, and each and every section, subsection, paragraph,
sentence, clause and phrase thereof irrespective of the fact that
any one or more sections, subsections , paragraphs, sentences,
clauses, or phrases might be declared to be unconstitutional and
invalid.

A public hearing was conducted on August 29, 1990, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 18, 1990, and
duly published July 26, August 2, 9, and 16, 1990, in The New News, a
public hearing was conducted to consider amending certain sections of
the Weld County Building Code Ordinance. Chuck Cunliffe, Director of
the Department of Planning Services, made the proposed amendments of
record. Lee Morrison, Assistant County Attorney, read Ordinance No.
119-G, In The Matter of an Amendment to Ordinance No. 119, Weld County
Building Code Ordinance, Revising Certain Procedures, Terms,
Requirements, and Incorporating by Reference Certain Portions of the
Uniform Building Code, 1988 Edition; National Electrical Code, 1990
Edition; and Appendices to all Uniform Codes, into the record. There
was no public comment offered at this hearing. Commissioner Lacy moved
to approve the first reading of Ordinance No. 119-G. Commissioner
Kirby seconded the motion, and it carried unanimously.
This Certification was approved on the 5th day of September, 1990.

BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION
RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Bud Clemons that the following resolution be introduced for passage
by the Weld County Planning Commission. Be it Resolved by the Weld County
Planning Commission the proposed amendments to Sections 20. 1.3, 20.3,
20.3.1, and 30.2.9 of the Weld County Building Code Ordinance be approved.
The proposed amendments will clarify the requirements for dampproofing
foundation walls with metal wall ties, incorporate by reference the 1990
National Electrical Code with only one change to the text concerning
concrete-encased electrodes, and clarify the building permit requirements
for mobile homes no longer meeting the definition of mobile home in the Weld
County Zoning Ordinance.
The Weld County Building Trades Advisory Committee reviewed the proposed
amendments and recommended approval of them on April 19, 1990.

The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Jerry Kiefer - yes; Bud Clemons - yes; LeAnn
Reid - yes; Judy Yamaguchi - yes; Ann Garrison - yea; Ernie Ross - yes.
Motion carried unanimously.
MOTION:
Jerry Keifer moved the Planning Commission forward the Certificate of
Designation for Amended DSR-899, B L Ventures, for a livestock trailer wash
facility to the Board of County Commissioners with the Planning Commission's
recommendation for approval based upon the recommendation of the Department
of Planning Services staff and the testimony hoard by the Planning
Commission. Motion seconded by LeAnn Reid.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Jerry Kiefer - yes; Bud Clemons - yes; LeAnn
Raid - yes; Judy Yamaguchi - yes; Ann Garrison - yes; Ernie Ross - yes.
Motion carried unanimously.
ADDITIONAL BUSINESS:
Chuck Cunliffe asked the Planning Commission to consider amendments to
Sections 20. 1 .3, 20.3, 20.3.1, and 30.2.9 of the Weld County Building Code
Ordinance. The proposed amendments will clarify the requirements for
dampproofing foundation walls with metal wall ties, incorporate by reference
the 1990 National Electrical Coda with only one change to the text
concerning concrete—encased electrodes, and clarify the building permit
requirements for mobile homes no longer meeting the definition of mobile
home in the Weld County Zoning Ordinance.
The Weld County Building Trades Advisory Committee reviewed the proposed
amendments and recommended approval of them on April 19, 1990.
