RE: APPROVE AMENDMENT NO. 1 TO ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT
WITH ED LOLOFF CONSTRUCTION, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment No. 1 to the Road
Improvements and Maintenance Agreement between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Weld County Public Works Department, and Ed Loloff Construction,
Inc. , with terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said
amendment, a copy of which is attached hereto and incorporated herein by
reference. ,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amendment No. 1 to the Road Improvements and Maintenance
Agreement between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Weld County Public Works
Department, and Ed Loloff Construction, Inc. , be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 3rd day of October, A.D. , 1994.

* AMENDMENT NO. 1
To Road Improvements and Maintenance Agreement, dated
October 15 , 1985 , between County of Weld, State of Colorado and
Ed Loloff Construction, for Weld County USR No. 690 and attach-
ment to Amended USR-690 .
Paragraph 2 of USR No. 690 Road Improvments Agreement shall
"c) be amended to read as follows :
2 . The road improvements specified herein will be achieved
when the daily average of sand and gravel and/or recycled
materials transported from the site exceeds an average
of 400 tons/day for any 30 day period. The Operator
will be responsible for dust control on the road from
the time sand and gravel and/or recycled materials
begins to be transported from the site until the road
improvements are complete.

Please add the following to the Board's agenda:
Approval of Amendment No. 1 to Road Improvements and Maintenance Agreement with Ed
Loloff Construction, Inc.
An agreement was made with Loloff on October 18, 1985, for maintenance and improvements on
WCR 41.5 (Balsam Avenue) in conjunction with a use by special review permit. The USR is
being amended to allow the stockpiling and recycling of asphalt and concrete. The attached
proposed Amendment No. 1 clarifies that the improvements are to take place when sand and
gravel and/or recycled materials hauled from the pit averages 400 tons per day for a 30 day
period.
A copy of the original Agreement and the proposed Amendment No. 1 is attached.
