HomeMy WebLinkAbout911030.tiff RESOLUTION RE: DECLARING INTENT TO CREATE THE WELD COUNTY WINDSOR SHORES LAW ENFORCEMENT AUTHORITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 30-11-401, et seq. , CRS, the Law Enforcement Authority Act of 1969, provides the authority to create law enforcement authorities and directs the procedures for establishment thereof, and WHEREAS, a Condition of Approval of Use by Special Review (USR) #943, for a private recreational facility, approved by Resolution dated May 15, 1991, was the requirement that the applicant request the Board of County Commissioners to create a law enforcement authority for the proposed USR 11943, and WHEREAS, said requirement was intended to insure the provision of more intensive law enforcement required for a recreational development in an unincorporated area of the County located away from existing municipalities, and WHEREAS, after discussions between the applicant, the Weld County Sheriff's Office, the Weld County Attorney's Office, and the Director of Finance, it appears from the legal and fiscal standpoint that the creation of a law enforcement authority is necessary and appropriate in order to provide adequate law enforcement for the activity pursuant to USR 11943, and WHEREAS, the area to be included within the law enforcement authority is as follows: All of the property owned by the Windsor Reservoir and Canal Company and located in Sections 21, 27, 28, 33, and 34, Township 7 North, Range 67 West, and parts of Sections 3 and 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, as described in the deeds listed in the attached Exhibit "A", excluding the area known as "Thompson Lake" and excluding all property lying southwest of the New Windsor Reservoir Dam and access road in the Southeast Quarter (SE,'-,) of said Section 33, Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, use of the Law Enforcement Authority for Windsor Shores USR will provide more adequate law enforcement for persons residing in developed or developing unincorporated areas of Weld County, will prevent the crime rate from rising therein and will better assist police, sheriff, and other law enforcement agencies in prevention of crime and in the detection and apprehension of criminal offenders, and WHEREAS, the procedural requirements of Section 30-11-401, CRS, have been met, including publication in a newspaper of general circulation in the area of authority once a week, for at least three consecutive weeks, of notice of the date, time, and place of the meeting whereby this Board considered the action contemplated herein, and 911030 Page 2 RE: CREATION OF WINDSOR SHORES LEA WHEREAS, the Board of County Commissioners finds it has jurisdiction herein. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, hereby declares its intent to create an Authority pursuant to Section 30-11-401, et seq. , CRS, which shall be known as the Weld County Windsor Shores Law Enforcement Authority (hereinafter referred to as Windsor Shores LEA) . The territory of Windsor Shores LEA shall generally include parts of Sections 21, 27, 28, 33, and 34, Township 7 North, Range 67 West, and parts of Sections 3 and 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, excluding the area known as "Thompson Lake", and is more particularly described in Exhibit "A," excepting all interests in the mineral estate. BE IT FURTHER RESOLVED that the Board of County Commissioners, as the ex-officio governing Board of the Windsor Shores LEA, shall have all such powers and duties granted or imposed under Section 30-11-401, et seq. , CRS, and any further powers and duties which may hereinafter be granted and imposed by statute. BE IT FURTHER RESOLVED that the Windsor Shores LEA shall be deemed created thirty days following the canvass of votes cast at the election indicating approval of the creation of the Authority, which election shall be held on the 29th day of October, 1991, and shall be conducted pursuant to the Mail Ballot Election Act. BE IT FURTHER RESOLVED that the precinct shall be designated as follows: All of the property owned by the Windsor Reservoir and Canal Company and located in Sections 21, 27, 28, 33, and 34, Township 7 North, Range 67 West, and parts of Sections 3 and 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, excluding the area known as "Thompson Lake", which is more particularly described in Exhibit "A". BE IT FURTHER RESOLVED that the question put forth to the electors at the election to be held on the 29th day of October, 1991, is as follows: "Should the property owned by the Windsor Reservoir and Canal Company, commonly known as the 'New Windsor Reservoir' and generally located in parts of Sections 21, 27, 28, 33, and 34, Township 7 North, Range 67 West, and parts of Sections 3 and 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, comprise a law enforcement authority pursuant to the Law Enforcement Authority Act of 1969 to be known as the 'Windsor Shores Law Enforcement Authority' ?" After I spoke with you on the morning of September 20, 1991, I called Larry Eckel concerning his house which lies on the property to be included in the Windsor Shores Law Enforcement Authority. Mr. Eckel told me that no caretaker has lived in the house this year. The caretaker will move into the house on April 1, 1992 . Therefore, the only two people who will be electors for the Windsor Shores Law Enforcement Authority will be Larry Eckel and his wife. Mr. Eckel also told me about a house occupied by the caretaker for the Windsor Reservoir and Canal Company. That caretaker is a residence of a house located on W.C.R. 74 in the SE corner of Section 33, T7N, R67W of the 6th P.M. , Weld County, Colorado. Mr. Eckel said that the Windsor Reservoir and Canal Company caretaker lives there all year. After speaking with Mr. Eckel, I made the determination that my previous precinct description may need to be amended so as to exclude the Windsor Reservoir and Canal Company caretaker ' s residence. That property was intended to be excluded from the law enforcement authority by the County Commissioners . I therefore propose the following amended election precinct: "All of the property owned by the Windsor Reservoir and Canal Company and located in Sections 21, 27, 28, 33, and 34 , T7N, R67W, parts of Section 3 and 4, T6N, R67W of the 6th P.M. , Weld County, Colorado, excluding the area known as 'Thompson Lake' and excluding all property lying southwest of the New Windsor Reservoir Dam and access road in the SE4 of said Section 33, T7N, R67W of the 6th P.M. , Weld County, Colorado. You asked me to pay particular attention to the language for the "Question Presented. " Attached is a draft copy of the Notice of Special Election. I believe that the description of the area to be included in the law enforcement authority is incorrect, given the decision by the Board of County Commissioners on Wednesday, September 18, 1991, to include all of the shore lines and the body of water at the Windsor Reservoir in the Law Enforcement Authority. It appears to me that the Board now wishes to include only those areas at the new Windsor Reservoir which are owned by the Windsor Reservoir and Canal Company. Therefore, I would suggest the following to be the "Question Presented" in the Notice of Special Election: "Should the property owned by the Windsor Reservoir and Canal Company, commonly known as the 'New Windsor Reservoir' and generally located in parts of Sections 21, 27 , 28, 33, and 34, Township 7 North, Range 67 West, and parts of Sections 3 and 4 , Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, comprise a law enforcement authority pursuant to the Law Enforcement Authority Act of 1969, to be known as the 'Windsor Shores Law Enforcement Authority' ?" The election precinct will also need to be changed. I would suggest that we say that the precinct area includes the following: "All of the property owned by the Windsor Reservoir and Canal Company and located in Sections 21, 27, 28, 33, and 34, Township 7 North, Range 67 West, parts of Sections 3 and 4 , Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, excluding the area known as 'Thompson Lake. '" I have reviewed the definition of "elector" as found in Section 30-11-403, C.R.S. A copy of that Section is attached. the definition states that the elector is a person who, at the designated time or event (October 29 , 1991) , is qualified to vote in the general elections of the state, and has either been a resident of the authority for not less than 32 days, or who or Mary Ann Feuerstein RE: Windsor Shores Page 2 September 20, 1991 whose spouse owns taxable real or personal property within the authority, whether or not the person resides within the authority. I do not believe that this definition provides as opportunity for a corporation to vote in the election. The term "person" is not defined; however, a corporation generally cannot be qualified to vote in general elections in the State of Colorado and a corporation cannot have a spouse. Thus, corporations that own property within the law enforcement authority are not "electors" as per the statute. In addition, any person who leases property within the authority, but is not a resident, is not an elector. Going through the list of electors, I find only three. The Windsor Reservoir and Canal Company is a corporation, and therefore, is eliminated. Windsor Shores, Inc . , is also a corporation, and is eliminated because it is not a person and because it is a leasee of the property and not a resident. The Board has decided not to include Steven Weddle. The only electors who are left is the caretaker for Windsor Shores, Inc . , who is now living in the house owned by Larry Eckle and located on the south shore of the Reservoir, and Larry Eckle as owner of the house. If Mr. Eckle is married, his wife may also be an elector. I do not know the name of the caretaker. I will call Larry Eckle to find out his name and to make sure that he will be a resident of the authority area for at least 32 days . He and Larry will also need to be qualified to vote in general elections in the State of Colorado.
