L -- 900972 COUNTY OF WELD, STATE OF COLORADO ROAD IMPROVEMENTS AND MAINTENANCE AGEEMEN ' • W THIS AGREEMENT, by and between the COUNTY OF WELD, STATE OF COLORADO, r r In w hereinafter called "County", and Hall-Irwin Construction Company, in hereinafter called "Operator", is made and entered into this /7 ° J day of ©-(4045.[h, 19qO . d � n WHEREAS, Operator has been issued a Use By Special Review Permit for o an open-cut gravel mine located in Section 31, Township 6 North, Range 66 z w West of the 6th Principal Meridian; and z o ni op WHEREAS, the County and Operator have reviewed proposed improvements bia al- to the existing county road and acknowledged they will enhance the accessibility and safety of the haul route to the above-mentioned gravel y H pit. H r tIi HLn O NOW, THEREFORE, in consideration of the mutual covenants and z conditions hereinafter set forth, the County and Operator mutually agree to co as follows: x• r 1. Vehicular traffic shall ingress and egress onto Weld County Q ^' Road 62-1/4 as shown on the submitted Use By Special Review o plat. The haul route shall be from the point of ingress and • r egress east to Weld County Road 27 and south to U.S. Highway 34 OO or north to County Road 64. O tai u 2. The Operator will be responsible for controlling dust on the W O haul route that is created by hauling from the permit area. The o Operator is responsible for using materials and methods not t. inconsistent with any federal, state, or local laws, rules or Ci regulations pertaining to hazardous materials, health, or 0 N environmental protection. 0 (� o 3. The Operator will maintain the haul route by grading to keep the O w surface reasonably smooth when necessitated by hauling from the permit area. 4. The Operator will supply and haul Class 6 Aggregate Base Course to repair County Road 62-1/4. The County will provide a motor grader to place the Class 6 Aggregate Base. This repair will be performed as needed and will be coordinated between the Operator and the County Director of Road and Bridge. Road Maintenance Agreement Page 2 K] 0 r r Lew COLA 5. Currently, the Operator and the County are cooperating in the o �' formation of an improvement district to pave County Road 27 xf between U.S. Highway 34 and County Road 64.
