RESOLUTION
RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY JOHNSON SUBDIVISION
LOCAL IMPROVEMENT DISTRICT NO. 1993-2
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, in accordance with Section 30-20-607, Colorado Revised Statutes,
as amended, a Statement of Expenses and Apportionment has been filed with the
Weld County Clerk to the Board by the Weld County Engineer, which is attached
hereto as Exhibit A, and
WHEREAS, pursuant to Section 30-20-608, there has been proper notice of
this hearing and of the costs of the improvements, and the share to be assessed
to each lot, and
WHEREAS, the Board of County Commissioners finds that the properties
described herein, which includes all or portions of Lots 1 through 11, Lots 18
and 19, Lots 23 and 24, and Lots 37 through 43 of Johnson Subdivision as recorded
under Reception Number 1426164, and Lots 12 through 17, Lots 25 through 36 of
Johnson Subdivision, First Addition, as recorded under Reception Number 1540736,
all in relation to the 6th P.M. in an unincorporated portion of Weld County,
Colorado, (Lots 30 and 31 of Johnson Subdivision, First Addition, are within the
City of Greeley) , in an area generally known as Johnson Subdivision, an area
north of the City of Greeley, Colorado, have been specifically benefitted by the
construction of the improvements authorized under the Resolution of May 19, 1993,
for the following reasons:
A. The market value of each of the properties will increase;
B. The proposed improvements will adapt the property to a more
profitable use;
C. There will be an alleviation of fugitive dust, eliminating the
health hazards to the benefitted properties and to users of the
public roads to be improved;
D. The alleviation of fugitive dust will reduce maintenance costs to
the subject properties and paving will lessen the maintenance
required for a public road; and
E. The proposed improvements will facilitate access to each of the
properties and thereby increase the convenience of the use of said
property.
WHEREAS, copies of the resolution creating this local improvement district
have been provided to the Division of Local Government and the Weld County
Treasurer and Assessor, and

WHEREAS, the City of Greeley has consented to the inclusion of Lots 30 and
31 of Johnson Subdiivsion, First Addition, in this local improvement district,
and
WHEREAS, at the time and place set forth in the notice, the Board of County
Commissioners met in open session for the purpose of hearing and considering any
objections and protests that might be made against the proposed assessments, and
there being no protests, complaints, or objections, and
WHEREAS, this resolution shall be prima facie evidence of the fact that the
property assessed is benefitted, the amount of the assessment, and that the
assessment has been lawfully levied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado:
A. That a local improvement district for the construction and
installation of street improvements, to include shaping, grading,
drainage, preparation of the base and grading, compaction, and
paving, together with any necessary incidentals on certain County
roads as hereinafter described, was created and established in
accordance with the laws of the State of Colorado, and is known as
"Weld County Johnson Subdivision Local Improvement District No.
1993-2." All proceedings heretofore taken by the Board of County
Commissioners and the County staff and then adopted in connection
with the district are hereby ratified, approved and confirmed. This
proposal to create said district was initiated by the Board of
County Commissioners by Resolution of February 17, 1993, upon a
petition, proper in form, subscribed by a majority of the owners of
property who will bear the cost of more than one-half of the total
proposed assessment in the district and notice duly given as
heretofore stated.
B. That the property to be assessed for said improvements shall be the
properties specifically benefitted by said improvements and more
particularly described as follows:
The area to be included within the district includes
those properties described as all or portions of Lots 1
through 11, Lots 18 and 19, Lots 23 and 24, and Lots 37
through 43 of Johnson Subdivision as recorded under
Reception Number 1426164, and Lots 12 through 17, Lots
25 through 36 of Johnson Subdivision, First Addition, as
recorded under Reception Number 1540736, all in relation
to the 6th P.M. in an unincorporated portion of Weld
County, Colorado, (Lots 30 and 31 of Johnson

Subdivision, First Addition, are within the City of
Greeley), in an area generally known as Johnson
Subdivision, an area north of the City of Greeley,
Colorado. Also included within the district are the
rights-of-way for 38th Avenue between West 4th Street
and 40th Avenue, 40th Avenue between West 4th Street and
'B' Street, 'B' Street at its intersection with 40th
Avenue, and the 40th Avenue cul-de-sac north of West 4th
Street, all within Johnson Subdivision and Johnson
Subdivision First Addition, in an area north of the City
of Greeley, Colorado,
C. That the Statement of Expenses and Apportionment, attached hereto
and incorporated herein by this reference as Exhibit A, has been
submitted based upon the fact that there has been completion of the
entire local improvement as previously authorized.
D. That the assessment, as set forth in the attached Exhibit B, per lot
or parcel being levied for the improvements shall be due and payable
within thirty (30) days after the effective date of this assessing
resolution. However, all such assessments may be paid at the
election of the owner in ten (10) equal annual installments of
principal together with installments of interest on unpaid
installments at an interest rate of eight percent (8%) simple
interest per annum. The first of said installments of assessment
shall be due and payable at the same time as ad valorem property
taxes for the year 1993, due and payable in 1994, and similarly in
each successive year thereafter until all are paid in full.
E. That cost of the improvements assessed to property within the
district is $48,236.00.
F. That the Clerk to the Board shall prepare a local assessment roll,
in cooperation with the Weld County Treasurer and Accounting
Department, in a form showing in suitable columns, each parcel of
land assessed, the total amount of assessment, the amount of each
installment of principal and interest if, in pursuance of Part 6 of
Article 20 of Title 30, Colorado Revised Statutes, the same is
payable in installments, and the date when each installment will
become due, with suitable columns for use in case of payment of the
whole amount or of any installment or penalty, and shall deliver the
same, duly certified, under the County seal, to the County Treasurer
for collection.
G. That failure to pay the whole assessment prior to December 3, 1993,
shall be a conclusive determination and held to be an election on
the part of all persons interested, whether under disability or
otherwise, to pay in such installments. All persons so electing to
pay in installments shall be conclusively held and considered as

consenting to said improvements. Said election shall be
conclusively held and considered as a waiver of any right to
question the power or jurisdiction of the County to construct the
improvements, the quality of the work, the regularity or sufficiency
of the proceedings, the validity or correctness of the assessments,
or the validity of the lien thereof.
H. That failure to pay any installment, whether principal or interest,
when due shall cause the whole of the unpaid principal to become due
and collectible immediately, and the whole amount of the unpaid
principal and accrued interest shall thereafter draw penalty
interest at the rate of one percent per month from the first day of
May until the day of payment, or until the day of sale. In
computing the amount of penalty interest due under this section, any
portion of a month shall be counted a whole month.
I. That all resolutions or parts thereof in conflict with this
resolution are hereby repealed, but all portions of the resolution
indicating the intent to create the district not in conflict with
the provisions of this resolution are re-enacted as if set forth
herein.
J. That the effective date of the resolution shall be November 3, 1993.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the followin� vote on the 3rd day of November, A.D. , 1993.

Attached is a copy of the final receipt and guarantee which documents the
completion of the Johnson Subdivision Improvement District for the sum of
$48,236.00.
The petition requests the costs be spread evenly between the 40 lots in the
improvement district. That would make the assessment per lot $1,205.90.

19 93 , together with all amendments, change orders, and additions thereto,

FORTY-EIGHT THOUSAND. TWO HUNDRED AND THIRTY-SIX AND NO/100
Dollars ($ 48,236.00 )
by checking, being the remainder of the full amount accruing to the undersigned
by virtue of said Contract and extra work performed thereunder, said payment
covering and including full payment for the cost of all extra work and material
furnished by the undersigned in the construction of said improvements, and all
incidentals thereto, for the additional consideration of One Dollar ($1.00) for
the execution hereto, and the undersigned hereof releases THE BOARD OF WELD
COUNTY COMMISSIONERS from any and all claims whatsoever resulting from said
Contract and all work performed thereunder.
The undersigned by these presents certifies that all persons doing work upon
or furnishing materials for said improvements under the foregoing Contract and
all additions thereto have been paid in full. The undersigned further
certifies that all work has been completed in a workmanlike manner in
conformity with the plans and specifications. That should any portion of said
work or material prove defective within one (1) year from the date of final
acceptance of the entire project by the County, the undersigned shall replace
any such defective material and remedy any such defective work to the
satisfaction of THE BOARD OF WELD COUNTY COMMISSIONERS and shall defend,
indemnify, and save harmless THE BOARD OF WELD COUNTY COMMISSIONERS from all
damages, claims, demands, expenses and charge of every kind which may arise as
a result of any such defective material and workmanship during said period.
The Performance and Payment Bonds for this Contract shall remain in effect for
the period of the guarantee.

RE: Weld County Johnson Subdivision Local Improvement District #1993-2
Dear Property Owner:
A mistake was made by our office in the material sent to you on November 10,
1993. The cover letter inadvertently listed 9% interest instead of 8% as the
percentage of interest. It should have corresponded with the 8% interest listed
in the Resolution. All the numbers showing principal and interest were generated
correctly, so the other documents sent to you are correct.
I apologize for any confusion this mistake may have caused. Please remember you
have until December 3, 1993 if you choose to pay the assessment in full to avoid
interest being charged.

Dear Property Owner:
The Board of Weld County Commissioners, on November 3, 1993, approved the
assessment of costs for the Weld County Johnson Subdivision Local Improvement
District No. 1993-2. Pursuant to the Resolution, your lot or parcel has been
assessed $1205.90. You may pay this amount in full, to the Weld County Treasurer
prior to December 3, 1993. When making your payment, please advise the
Treasurer's Office that the payment is for the assessment concerning the Weld
County Johnson Subdivision Local Improvement District No. 1993-2. If paying by
mail, please send your payment to the following address:

Should you choose not to pay in full by December 3, 1993, you may pay in ten (10)

AN ORDINANCE AUTHORIZING CITY OF GREELEY CONSENT FOR INCLUSION OF
TWO CITY LOTS FOR ASSESSMENT IN WELD COUNTY JOHNSON SUBDIVX@ION
LOCAL IMPROVEMENT DISTRICT NO. 1993-2.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado Statute and Weld County Home Rule
Charter, has authorized the County to create a local improvement
district known as Weld County Johnson Subdivision Local Improvement
District No. 1993-2; and
WHEREAS, all the local improvements are to be constructed and
located within boundaries of the County of Weld; however, two lots
to be assessed for the improvements are located within the City of
Greeley, Colorado; and
WHEREAS, in accordance with §30-20-603, C.R.S. , consent of the
municipality is required when county local improvement districts
are wholly or partially located within municipal boundaries; and
WHEREAS, although the local improvements are to be constructed
and located outside of the City of Greeley boundaries, two lots
within the City of Greeley are to be assessed a portion of the cost
thereof; therefore, it is unclear whether or not consent is
required by City of Greeley for inclusion in the local improvement
district; and
WHEREAS, in order to avoid any misinterpretation or technical
violation of state statutes, Weld County has requested City Council
consent for assessment of the two lots within the local improvement
district named above, in the event said private lots within the
City technically require the City's consent.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY,
COLORADO:
Section 1. The City Council of the City of Greeley, Colorado
hereby consents that two lots located in the City of Greeley,
Colorado, namely Lots 30 and 31, Johnson Subdivision First
Addition, be included in and assessed their fair share of the
special improvements for Weld County Johnson Subdivision Local
Improvement District No. 1993-2. This consent is made pursuant to
and in accordance with the provisions of §30-20-603 (1) , C.R.S. , as
amended.
Section 2. The assessments and collections to said lots shall
be the sole responsibility of the owners of said lots and Weld
County, Colorado, respectively.
Section 3. This ordinance shall become effective five days
following its final publication, as provided by the Greeley City
Charter.

Dear George :
On April 23, 1993 we discussed the provisions of C.R.S. 5 30-20-603
which might be construed to require the City of Greeley' s consent
for the creation of the County local improvement district because
two of the lots proposed to be assessed lie within the municipal
limits of the City. It is my opinion that consent is only required
where the actual improvements lie within the municipality and our
Engineering Department has confirmed that none of the improvements
are found within the City. However, to avoid creating an issue
unnecessarily, I am respectfully requesting that your council
consider consenting to the inclusion of Lots 30 and 31 of Johnson
Subdivision First Addition in the County local improvement district
at their earliest possible convenience.
I have included copies of the petitions, which indicate that the
owners of the subject lots are requesting inclusion within the
local improvement district, along with the preliminary Resolution
and Notice of Hearing.

Dear Mrs. Harbert:
We would like to express our opinion concerning the proposed
Improvement district from 4th St. to B St. on 38th Ave. &
40th Ave.
We have lived in this area for quite some time, amd do
not consider this dirt road to be a problem. I believe
the road deters unnecessary traffic as some people don 't
like to drive where their cars might get dirty.
We moved to this area due to the fact that it was light
development with large acre or more lots. The dirt road
does not deter from this, but adds to it.
We have practically no road maintenance in this area, and,
during the winter, we usually remove snow on the road
ourselves. If these roads were paved, there would not be
a difference in maintenance. I would rather plow a gravel
road than a paved road.
In short, we are opposed to an Improvement District for
this area.
We hope you will take our remarks into consideration when
discussing this issue.

This is to notify you that a meeting with the Board of County Commissioners
concerning the Local Improvement District will be held at 10:00 a.m. on
Wednesday, April 7, 1993, in the First Floor Hearing Room, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado. The purpose of this meeting will
be to consider the adoption of a preliminary order and preliminary plans and
specifications, which would describe the materials to be used, the number of
installments and the period of time in which the cost of improvements shall be
payable and the property to be assessed. The preliminary order will also contain
the cost estimates and approximate amount to be assessed on each property. A
great deal of this information is now contained in your petition.
You are encouraged to make your feelings known either through your appearance at

DISTRICT NO. 1993-2; STATEMENT OF COST; AND PORTION
TO BE ASSESSED UPON EACH LOT

All owners of real estate and property hereinafter described and all persons
generally, are hereby notified that the Board of County Commissioners of Weld
County, Colorado, has received a Notice of Completion, Statement of Expenses, and
Apportionment regarding the Local Improvement District within unincorporated Weld
County, Colorado, designated as Weld County Johnson Subdivision Local Improvement
District No. 1993-2, all in accordance with the laws of the State of Colorado.
The property within the Local Improvement District is described as follows:
All or portions of Lots 1 through 11, Lots 18 and 19, Lots 23 and
24, and Lots 37 through 43 of Johnson Subdivision as recorded under
Reception Number 1426164, and Lots 12 through 17, Lots 25 through 35
of Johnson Subdivision, First Addition, as recorded under Reception
Number 1540736, all in relation to the 6th P.M. of Weld County,
Colorado, in an area generally known as Johnson Subdivision, an area
north of the City of Greeley, Colorado. Also included within the
district are the rights-of-way for 38th Avenue between West 4th
Street and 40th Avenue, 40th Avenue between West 4th Street and 'B'
Street, 'B' Street at its intersection with 40th Avenue, and the
40th Avenue cul-de-sac north of West 4th Street., all within Johnson
Subdivision and Johnson Subdivision First Addition.
1. All persons are further notified that the whole cost of the improvements
as has been completed is to be $48, 236.00, which excludes any costs which
have been assumed by the County in terms of engineering and administrative
fees. The costs to be apportioned to the landowners are the costs of the
labor and materials for installation of hot bituminous pavement and base
preparation, which is to be apportioned equally among the 40 lots and
tracts in an apportionment of $1,205.90 per let or tract. No portion of
the costs will be paid by a district-wide sales tax.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners, 915
10th Street, P.O. Box 758, Greeley, Colorado 80632, which objection must
be filed within twenty (20) days from the publication date of this notice.
Any complaint or objection properly made will be heard and determined by
the Board of County Commissioners before the passage of any Resolution
assessing the costs of the improvements.
3. The hearing where such complaints or objections will be heard will be on
the 3rd day of November, 1993, at or about 9:00 a.m. , in the First Floor
Meeting Room of the Centennial Center, 915 10th Street, Greeley, Colorado.
