RE: ACTION OF THE BOARD CONCERNING PETITION FOR LOCAL IMPROVEMENT
DISTRICT ALONG BASSWOOD AVENUE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , a Petition for a Local Improvement District was
submitted by owners of property in the area of East 19th Street
Road between Balsam Avenue and Basswood Avenue, and Basswood
Avenue between East 19th Street Road and East 20th Street, said
area being more particularly described in said Petition, and
WHEREAS, after review, the Board deems it advisable to accept
said Petition and schedule a Preliminary Hearing concerning this
matter for October 3 , 1990, at 10 :00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that a Preliminary Hearing
to consider the aforementioned Petition for a Local Improvement
District on the hereinabove described roads be, and hereby is,
scheduled for October 3 , 1990 , at 10 : 00 a.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day o£
September, A.D. , 1990 .

PETITION FOR LOCAL IMPROVEMENT DISTRICT

We, the undersigned citizens of Weld County, who are owners of record
of real property, propose to be assessed the costs for the entire project,
and which property will benefit from improvements in the area of:
East 19th Street Road between Balsam Avenue and Basswood Avenue,
and Basswood Avenue between East 19th Street Road and East 20th
Street;
situated in Weld County, Colorado, do hereby petition the Honorable Board
of County Commissioners of the County of Weld, State o£ Colorado, for the
formation of a local improvement district pursuant to CRS, 30-20-601, et
seq. We represent that the real property listed in this petition(s) will
be assessed more than one-half of the $12,000 in costs proposed to be
assessed to the local improvement district. Such improvement district is
for the purpose of:
Street paving;
The specific improvements we wish to have constructed are as follows:
Shape, grade, pave and shoulder the above described streets;
We request that the following materials be used:
Two inches of aggregate basecourse, 32' wide; and 2 inches
of asphalt pavement, 24' wide; and 2 inches of aggregate
shoulders, 4' wide;
The specific manner of assessments we recommend is as follows:
The property owners be assessed $1,000 per lot or parcel
of land described as follows: Lots 2 and 12 of Brenckle
Subdivision; Lots 10 and 11 of the First Addition to
Brenckle Subdivision; Lots 1, 4, 5, 6, 7, 8, and 9 of
the Second Addition to Brenckle Subdivision; and the
following described parcel of land conveyed to Jack T. ,
and Christine A. Fetig by Warranty Deed on July 23, 1979,
Reception No. 1797594:
All that part of the South Half (S1/2) of Lot Three (3)
of the Southwest Quarter (SW1/4) of the Southeast
Quarter (SE1/4) of Section 9, Township 5 North,
Range 65 West of the 6th P.M. , County of Weld, State
of Colorado, according to the subdivision of lands
by the Union Colony of Colorado, more particularly
described as follows, to wit:

Beginning at the South Quarter Corner (S1/4 Cor) of said
Section 9, Township 5 North, Range 65 West of the 6th
P.M. , which is located in the center of the road
intersection; thence North along the North-South
Quarter line, 110 feet to the True Point of Beginning;
thence East 132 feet parallel to the South line of
said Section 9; thence North 220 feet parallel to the
North-South Quarter line of said Section; thence West
132 feet parallel to the South line of said Section to
the North-South Quarter line of said Section; thence
South 220 feet along the said North-South Quarter
line of said Section to the True Point of Beginning.
We request that the cost of the improvements not exceed $12,000;
The specific manner of payment we recommend is as follows:
The $1,000.00 per lot or parcel of land would be paid
over a 10-year period, at an interest rate of 9%,
with the principal being divided into 10 equal annual
payments, and the interest computed to the unpaid
balance.
Do not sign this petition unless you are an "owner" of real property
benefitting from the project and requesting to be assessed costs of the
improvements. An owner is a person holding fee title to real property.
You are an "owner" if you hold a contract to purchase real property which
obligates you to pay general taxes on that property. In that instance, the
seller may not sign this petition. CRS, 30-20-602(3) and 603(3) .
