VENDENA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 25, 1991, a Show Cause Hearing was conducted to consider revocation of Special Use Permit 0654, issued to Permagreen, c/o Roxy F. Vendena, and WHEREAS, at the meeting of September 25, 1991, the Board deemed it advisable to continue said matter to November 6, 1991, at 10:00 a.m. , and WHEREAS, Roxy F. Vendena is the President of Permagreen, said facility being located on property described as part of the NE'-, of Section 24, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, at the meeting of November 4, 1991, Mr. Vendena and Kurt Rollin, Engineer from Rocky Mountain Consultants, were present, and WHEREAS, the Department of Planning Services informed the Board that Mr. Vendena is in compliance with Special Use Permit 0654, and said matter should be dismissed, and WHEREAS, the Board deemed it advisable to dismiss said Show Cause Hearing for Permagreen, c/o Roxy F. Vendena. Keith Schuett, Planning Department representative, said the Health and Planning staffs have inspected the facility, and all issues have been brought into compliance; therefore, he recommended closing the violations. Environmental Protection .Servir es subwct: Permagreen - Inspection for Compliance On October 18, 1991, staff of the Environmental Protection Division conducted an inspection of the permagreen composting facility at the north quarter of Section 24, Township 01 North, Range 65 West, south of Dacono, Colorado. This inspection was conducted to evaluate construction completed pursuant to show cause action initiated by Weld County for violations of the Special Use Permit. Permagreen has completed an extensive stormwater retention facility at the composting site to control stormwater run-off. This construction will control stormwater that occurs on the site and will also route off-site flows through the composting facility so that it is not contaminated by the compost material. The staff finds that the construction is completed and the facility is constructed as proposed. All berms, dikes, impoundments, ponds, and run-off areas have been completed in a satisfactory manner. The flow-through stormwater diversion is constructed as proposed and appears adequate to handle the flow through as proposed. Schuett : I am writing this letter in response to the complaints outlined in our "Show and Cause" hearing on September 25 , 1991 . I hope this reply will be helpful to you in reviewing our case and making recommendations to the Board of Commissioners . Operation Standard #4 - The design that we submitted on September 25th for your approval is the plan that would be implemented with one exception - the culvert system that was designed for us to have access to areas B and C would prove to be dangerous for our composting ma- chinery to cross over . We would like to eliminate this culvert system entirely and leave the swale com- pletely open . At this time , we would also like to request another driveway that would enter into areas B and C from Weld County Road 13 so that we can bring our composting machinery into that area in a more effi- cient and safe manner . Depending on weather conditions , this project will be completed and ready for your inspec- tion on or before November 1st . Operation Standard #5 - With the ponding and berm design laid out in our plan , the area should be more than adequate for a 100-year event . Operation Standard #6 - Observing the height of the weeds adjacent to us , including weeds in the ditches , we felt thatthis might be a requirement that , generally speaking , didn ' t affect anyone . Keith Schuett Page 2 Operation Standard #7 - The Weld County Planning Depart- ment and/or Weld County Department has never been denied access to our site . Operation Standard #8 - All materials have been removed from the South property line. New materials brought into the area will always be kept within boundaries . The effluent that is accumulated in the ponds during a rain- fall runoff event , will be pumped from the accumulating ponds by a gas-driven pump . The accumulator from the pump will be submerged into the water . The effluent will then be broad- casted back into the compost . Mr . Schuett , we have been doing business on this particu- lar property since 1984 with little or no complaints . We have tried to be a good neighbor by being sensitive to our neigh- bors ' concerns , whether real or unfounded . If you have any questions regarding this matter , please feel free to contact me . To be able to have a uniform consistency , we would be grateful if the City of Dacono would maintain a weed level below 12 inches in the ditches , along Road 13 and 8 which was recently annexed by your city . Also , in observing the adjacent annexed property, we have noticed extensive areas of very tall weed growth . If you have an ordinance addressing that problem, we would certainly appreciate it if enforcement was carried out . Secondly, we would like to see the ditches cut deeper North to South and East to West to more favorably accommodate some of the larger rain storms . Vendena ADDRESS: 5520 Harlan Arvada, CO 80002 LEGAL DESCRIPTION: Part of the NE4 of Section 24, T1N, R68W of the 6th P.M. , Weld County, Colorado. It is the opinion of the Department of Planning Services staff, that the following Standards as approved for USR / 654 are not in compliance: The property is not in compliance with Operation Standards 4, 5 , 6, 7 , 8 , and 9 . Operation Standard #4 states: The applicant and/or operator shall implement a runoff containment program for the Use by Special Review are as approved by the Department of Planning Services . The property is not in compliance with runoff containment. The design and materials of the new berms appear to be inadequate to contain runoff. An engineered runoff containment plan is needed. Operation Standard #5 states: The applicant shall comply with the design standards for the Use by Special Review, Section 24. 5 et seq. , of the Weld County Zoning Ordinance. 24. 5 . 1.5.1 Storm water retention facilities shall be provided on site which are designed to retain the storm water runoff from the fully developed site from a 100 year storm. Vendena Page 2 Operation Standard #6 states: The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 24.6.1.6 Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owner allow the growth of NOXIOUS WEEDS. Grasses and weeds on the property exceed 12 inches in height along the perimeter of the Special Review permit site. Operation Standard #7 states : Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations . The property is not in compliance with the Weld County Health Department Standards. (See Health Department Notice of Violation dated June 20, 1991) . Operation Standard #8 states: The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services . The Operation has expanded onto the adjacent property to the south and the property is not in compliance with Operation Standards 2, 4, 5 , 6 , 7 , and 9 , as approved and no amendments to the Operation Standards have been made. Operation Standard #9 states: The property owner and/or operator of this operation shall be responsible for complying with all of the above stated standards. More specifically, the site is located at the southwest corner of Weld County Roads 13 and 8. The site is now being used by Permagreen in developing their compost materials. The site contains 21.3 acres more or less. At this time, Weld County Planning Department has requested that Permagreen develop a storm water retention plan for the site's on-site storm runoff waters. This plan is being submitted for your review. The retention of on- site storm flows is part of the special use requirements of this site. All of the storm water retention facilities have been designed to retain the 100 year storm water runoff from the site. Calculations of these flows, along with pond sizing, and a plan showing the pond locations are included for your review. Also as part of this plan, the existing off site runoff that is generated east of the site will be routed through or around the site, and will be protected from the composting materials on the site. Typically, a detention volume must be calculated. The method for construction of a triangular hydrograph is an integral part of this calculation. A simple algorythm, the symmetrical triangular hydrograph, is most often used but is found to be inadequate. The graphic depiction of storm event as a stream-hydrograph appears curvilinear with a steep ascending limb and a tapering descending limb. The closest approximation is the asymmetrical tri- • angular hydrograph(l) . This is , reportedly, within 5% of the curvilinear hydro- graph volumes(2). The following methodology section will outline acceptable standards. Operation Standard #4 states: The applicant and/or operator shall implement a runoff containment program for the Use by Special Review are as approved by the Department of Planning Services. The property is not in compliance with runoff containment. Inadequate information is available to determine integrity of the new berms. The design and materials appear to be inadequate to contain runoff. An engineered runoff containment plan is needed. Operation Standard #5 states: The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 24.5. 1.5.1 Storm water retention facilities shall be provided on site which are designed to retain the storm water runoff from the fully developed site from a 100 year storm. The storm water retention facilities do not retain storm water runoff. Operation Standard #6 states: The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 24.6.1.6 Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owner allow the growth of NOXIOUS WEEDS. Grasses and weeds on the property exceed 12 inches in height. Operation Standard #7 states: Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. The property is not in compliance with the Weld County Health Department Standards. (See Health Department Notice of Violation dated June 20, 1991) Operation Standard #8 states: The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. It is recommended that two approaches be used to control the storm drainage problem. First, off-site drainage arising from lands not owned by you but coming onto your property from the north, east, and south must be controlled so that it does not enter the site. This drainage should be piped through your property to the unnamed gulch (natural drainageway) immediately west of your property or, if possible, directed around your property to the natural drainageway. The Weld County Road Maintenance Department and/or the appropriate officials from the Town of Dacono should be contacted with regard to the responsibility and how best to handle the off-site drainage. If you prefer, I can contact them on your behalf. Second, with respect to drainage on your property, it is recommended that you continue the current practice of detaining storm waters and reapplying the water to your land during dry periods. In this way the water will be consumed and will not come in contact with the surface water that is tributary to the natural drainageway west of your property. You have done a good job in constructing the berm and it is recommended that you continue the course of action that you have begun, i .e. , control of the water on your property in detention ponds and reapplying it to your land in order to assure total consumption of the water.
