RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 1308 - RYDGREN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1308 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1308 was
submitted by Jon A. and Carolyn S. Rydgren for property which is
located in part of the SW} , Section 8 , Township 4 North, Range 64
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 24 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicants submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within sixty days from the date of approval by the Board of County
Commissioners. The applicants shall be responsible for paying the
recording fees.

Dear Commissioners:
This request for a recorded exemption is submitted by Jon A. and Carolyn S.
Rydgren. The parcel of land is described as part of the southwest 1/4
of Section 8, T4N, R64W of the 6th P.M. , Weld County, Colorado. The
property is located east of Weld County Road 51 and north of Weld County
Road 46. This request is to divide a 29 acre parcel of ground, into two
lots of 24 acres and 5 acres, more or less . The applicants also own a
22 acre parcel directly south of this property. The two properties are
divided by the Neres Canal . The applicants' home is on the 22 acre parcel.
The applicants propose using Central Weld County Water District as the water
source for both lots. Septic systems will provide sewage disposal. The
applicants' daughter and her family propose building a home on the 5 acre
parcel. The remaining 24 acres is proposed to remain as nonproductive
farmground and oil and gas production.
The staff has concerns that the proposed division will be inconsistent with
efficient and orderly development. The applicants currently have two
legal building sites on approximately 51 acres. Approval of this recorded
exemption request will create an additional building site, for a total of
three building sites on 51 acres. Residential development in rural areas
necessitates an increased demand for road maintenance, police and fire
protection, school busing, snow removal, utilities, and other urban services.
As density increases, so do service demands.
The staff requests that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2 E. (1) (a)
through (m) of the Weld County Subdivision Regulations have been met.

The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plats shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within 60 days from the date of approval by the
Board of County Commissioners. The applicant shall be responsible for
paying the recording fees.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld CountyIndividual
Sewage Disposal System (ISDS) regulations.
The following note shall be placed on the Recorded Exemption Plat prior
to recording:
No structure or other encroachment shall be permitted within the 55 foot
right-of-way of the Neres Canal.

To Whom It May Concern:
I am giving my daughter and son-in-law five (5) acres of land
for the purpose of placing a home on said land. The reason for
dividing this lot into two (2) seperate lots is because we feel
that if this land were to be legally divided off and deeded to
them, that in the event that either of us would wish to sell ,
we are not legally bound to each other.
This proposal is consistent with the policies of the Weld County
Comprehensive plan in the sense that this is dry land pasture
and has never been farmed or irrigated. There are no improve-
ments on the parcel , or access to this five (5) acres of land.
This proposal is consistent with the intent of zone district in
which the property is located. This land will go from unimprov-
ed dryland pasture to an improved dryland pasture. The use of
this land will be consistent with other homes in this area which
are on various sizes of property. The land will be compatible
with the future development because it will remain agricultural
dryland with the addition of a residential home. The proposal
will not be inconsistent with efficient and orderly development
because there is no further development taking place in the
area nearby, therefore, the entrance to the proposed five (5)
acres will be for their personal residence.
Water will be served to this property from a tap purchased from
Central Weld County Water District. A septic system will be
installed according to Health Department regulations.
