RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A ROPING ARENA AND TRAINING FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - WAYNE AND MARIANNE WOLFE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of October, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Wayne and Marianne Wolfe, 6339 Weld County Road 98, Wellington, Colorado 80549, for a Site Specific Development Plan and Special Review Permit for a roping arena and training facility in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW'-!, Section 31, Township 9 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Dave Wolfe, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with Agricultural Policy 12 of the Weld County Comprehensive Plan in that the County encourages the location of recreational uses on nonproductive agricultural land. It is the opinion of the staff that the scope of this use makes this proposal consistent with other policies of the Comprehensive Plan. b. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The proposed use will be compatible with the future development of the area. The Special Review area is not located within the comprehensive planning area of any municipality and is not designated for future development by the County. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a roping arena and training facility in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to the use of the facility for public events: a. The property owner shall construct adequate sanitary facilities served by an individual sewage disposal system. This system shall be approved by Weld County Environmental Protection Services and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Portable toilets are not allowed. b. The property owner shall demonstrate that the facility has a water supply that is adequate in quantity and quality for the proposed use. The water supply shall be approved by Weld County Environmental Protection Services. The source shall be a public water supply or an individual well permitted by the State of Colorado, Division of Water Resources. Webster 920977 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS WAYNE AND MARIANNE WOLFE USR-977 1. The Site Specific Development Plan and Special Review Permit is for a roping arena and training facility in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. The facility shall be maintained in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. B. Fugitive dust shall be controlled on this site. 9. The approved water supply shall be tested annually for potability. It is the responsibility of the operator of the facility to maintain records demonstrating that these tests have been carried out. 10. The maximum number of animal units on the property shall not exceed the number allowed by right in the A (Agricultural) Zone District by the Weld County Zoning Ordinance. 11. The use of the roping arena by the public shall be limited to 52 days per year. 12. The use of the facility shall be limited to 200 people. 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 920977 DEVELOPMENT STANDARDS - WOLFE PAGE 2 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. any other changes shall be filed in the office of the Department of Planning Services. 18. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Harbert, Pro-Tem - Excused Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Chuck Cunliffe The following business was transacted: I hereby certify that pursuant to a notice dated September 16, 1992, and duly published September 24, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Wayne and Marianne Wolfe for a Site Specific Development Plan and Special Review Permit for a roping arena and training facility in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chuck Cunliffe, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Dave Wolfe, representing the applicants, stated he lives on the property and raises quarter horses. He said this facility would be an asset to marketing, and he is agreeable to the Planning Commission's recommendation. Commissioner Lacy asked Mr. Wolfe if Development Standards #11 and #12, concerning the limitation of operation to 52 days per year and 200 people, were agreeable. Mr. Cunliffe explained that was changed in the Planning Commission hearing, and Mr. Wolfe is agreeable. Mr. Wolfe said the sign posting certificate has been submitted. Mr. Cunliffe said he received two letters from Larimer County's Planning Division and Road and Bridge Department concerning impacts from the facility. He said the letters were received after the Planning Commission hearing; therefore, the Board needs to address them. Commissioner Lacy stated concerns with dust control. Mr. Wolfe explained that it is about 11 miles from the south on Highway 14; however, most of the traffic will be from the west on Larimer County Road 62, which is about 3 miles. He also said in reality, there will be less than 200 people, with the facility being operated approximately one night per week in the summer. Commissioner Kirby also stated concerns about dust control, and further discussion was held concerning the number of homes impacted. Mr. Cunliffe said Larimer County's traffic count from 1990 was 130 cars per day. Mr. Wolfe estimated 10 homes on the three mile stretch of Larimer County Road 62. Commissioner Lacy noted that Larimer County requested the matter be tabled until Weld County and Larimer County Engineering Departments are able to discuss the traffic impact. He said there is a need for dust control and the willingness to share costs. Mr. Wolfe said he has permission from all surrounding neighbors for this facility. He also noted that there are already three commercial operations in the area. Mr. Cunliffe said the Board could either continue the matter to allow a meeting between the two counties or approve the matter conditional upon a proposed road improvements agreement being submitted within 45 days. Commissioner Lacy said he feels 45 days would be reasonable, and the agreement should not be too restrictive. Mr. Cunliffe confirmed that the Board would determine whether the agreement was reasonable or not. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chairman asked the applicant if they agreed with the Department of Planning Services' recommendation. Dave Wolfe said they were not in agreement with Development Standards 11 and 12. They would like an increase in the number of people allowed and number of days in the year to operate increased. He explained the application was completed with low estimates regarding these items. Discussion followed on these requested concerns and also on run-off containment, water supply, and restroom facilities. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: This proposal is consistent with Agricultural Policy 12 of the Weld County Comprehensive Plan in that the County encourages the location of recreational uses on nonproductive agricultural land. It is the opinion of the staff that the scope of this use makes this proposal consistent with other policies of the Comprehensive Plan. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a use by special review. The attached development standards and conditions of approval will make the proposed use compatible with existing surrounding land uses which include dryland pasture and rural residences. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission' s recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. Portable toilets are not allowed. b. the property owner shall demonstrate that the facility has a water supply that is adequate in quantity and quality for the proposed use. The water supply shall be approved by Weld County Environmental Protection Services. The source shall be a public water supply or an individual well permitted by the State of Colorado, Division of Water Resources. In visiting with several members of your staff and following the recommendations made at the Department of Planning hearing, I am requesting your approval on the following conditions. 1. This facility will be a roping arena. There will be no permanent care or feeding of livestock at this arena. Cattle will be hauled in for an event and they will depart following the event. There will be no accumulation of manure under these conditions. However, in an effort to comply with any feedlot regulations and to keep the weeds down, the holding pens will be cleaned and any manure will be spread on my pasture for fertilizer. 2. It was requested that public water be furnished for events. We have no access to a public water supply. Our well water is potable, however it tastes bad. We buy bottled water for our use and through the recommendation of the Planning Commission and your staff, we have agreed to provide bottled drinking water for all events at the arena. 3. We were informed that portable toilets were not allowed for this purpose and we needed a vaulted septic system. Therefore, we will get a permit and install a vaulted tank with His and Hers restrooms. It will be pumped regularly as needed. There will be no running water at this arena, therefore a septic system with leach lines would not work. Please review and accept these conditions so they can be submitted for final approval before the Board of County Commissioners. As presented to us, the proposal would allow riding events to occur up to 20 days per year, with 50-60 participants . I understand that the request is now to allow operation up to 50 days per year, with up to 200 participants . As I indicated to you in my previous correspondence, our experience with these types of facilities indicate they do create problems, particularly regarding access, noise, lighting, utilities, emergency response, and compatibility. Enclosed is a staff report for a similar facility in the same area as the Wolfe request; this application has been denied twice by the Larimer County Board of Adjustment because of the planning issues mentioned above. The Weld County proposal is significantly larger than the one denied by Larimer County. It would seem reasonable to assume that most, if not all, of the vehicular traffic to this site would utilize three miles of Larimer County Road 62, from Interstate Highway 25 . This is a rural, gravel road with a 1990 traffic count of 130 ADT. The proposed riding arena could double the traffic on this road. If this proposal were to be considered for approval within Larimer County, we would ask that the developer address the road impacts through improvements which might include reconstruction, paving, etc. Our Engineering Department informs me there may be structures on this road that would restrict traffic or have a weight limit. 9:70z,-17 BOARD OF COUNTY COMMISSIONERS Courtlyn W. PROJECT DESCRIPTION: The applicant proposed to conduct team roping and barrel racing events on Friday nights, May through October 15 (25 days) and the last Sunday of each month,May through October(6 days). IV. MAJOR ISSUES AND CONCERN: 1. Access: The subject property is adjacent to County Road 60,which is a typical graveled County Road extending east from the I-25 frontage road, approximately .8 of a mile to the property. Any increase in vehicular traffic will proportionally increase problems associated with traffic, i.e. dust, noise, and overall traffic safety. The traffic situation is farther compounded since the vehicles are generally pulling a horse trailer, which adds to the number of tires on the ground. The number of vehicles for each event could number 50 or more. A similar request was considered by the Board 7-23-91, and was denied. One change that has occurred is that the site for the arena has been moved approximately 1,500 feet from the south central portion of the property to the northwest corner. This would appear to cause more of the trucks and trailers to drive a greater distance, resulting in even more dust and associated problems. Noise: The roping arena is totally open with limited, if any, sound attenuation from natural topography or landscaping. The events are generally accompanied by cheering and yelling for all participants, a public address system to announce the schedule of participants, and metal gates opening and closing. The arena operates into some fairly late night hours, which would certainly have a significant effect on the residential uses in the immediate area, even though an attempt has been made to move the arena farther from the houses. The nearest house is now approximately 100 feet from the arena and the other three about 2,000 feet. 3. Lighting: Since a considerable amount of activities take place after dark, it is necessary to provide adequate lighting. In the past,the high intensity lighting has been a significant disturbance to the residents of the neighborhood, even those some distance away. Moving the arena to the new location may reduce the overall impacts on those residential uses that were close to the arena,but it certainly does not eliminate the problem. 4. Water/Sewer/Emergency Response: With a significant number of people involved in the roping and racing activities, it would be necessary to provide minimum facilities for on-site sanitary and potable water. Generally, the Larimer County Health Department can make suggestions and recommendations for such facility requirements when they know the number of people and length of the activities. The facility is located approximately 9 miles from Poudre Valley Hospital and approximately 7 miles from the nearest fire station, where an emergency response could be initiated. Based on the nature of the sport, it would appear that there could be an occasional need for emergency medical help. 5. Compatibility: The predominant uses in the surrounding neighborhood are farming on fairly large tracts. There are,however, several smaller,rural residential tracts that are immediately adjacent to the property, which make up a smaller,more compact neighborhood. It is these smaller residential tracts that are most affected by the dust,noise, lighting, and traffic that is generated by the roping and racing arena use. With more and more large tract division going on in the outlying areas, the degree of incompatibility increases with the "urbanization." V. STAFF FINDINGS: 1. The subject property is zoned O-Open. 2. The O-Open District does not permit commercial rodeo arenas or places of amusement and recreation.
