W a, ZI q1/0101/3 I I RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1629 - ZIEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1629, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1629 was submitted by Kenneth Hauff and Karen Nelson, 36648 Weld County Road 15, Windsor, Colorado 80550, on behalf of Helmut and Arthur Ziel, 6166 Weld County Road 74, Windsor, Colorado 80550, for property which is otherwise known as Lot B of RE #918, located in part of the W; SW* of Section 32, Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 4.0 acres and 120.5 acres. The parcel of land is described as Lot B of RE-918 being a part of the W2 SW4 of Section 32, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property is located north of and adjacent to Weld County Road 74 and east of and adjacent to Weld County Road 15. The request is to divide a 124.5 acre parcel into two parcels of 4 acres and 120.5 acres, more or less. The applicants have indicated in the application materials that they wish to separate the existing improvements from the agricultural use; this would allow them to purchase the proposed Lot A with all existing improvements. Proposed Lot B will remain in agricultural production. There are two existing dwellings and other out buildings on proposed Lot A; proposed Lot B is vacant. North Weld County Water District is currently serving proposed Lot A and is available for proposed Lot B. A septic system provides sewage disposal on proposed Lot A and is proposed for Lot B. The Planning staff of the Town of Windsor has reviewed this request and has no concerns. The Weld County Health Department has also reviewed this request and finds no conflicts with its interests. The Department of Planning Services' staff has concerns that the proposed division will potentially remove prime agricultural ground from production. One hundred percent of this parcel is identified as prime farmland of national importance by the United States Department of Agricultural Soil Conservation Services and the Colorado State University experimental station. This request, if approved, would allow for the addition of a dwelling on Lot B, which would reduce the area for farm production and further intensify the residential density on the property. The Comprehensive Plan promotes preserving the agricultural use of prime agricultural ground. The Department of Planning Services' staff requests that the Board of County Commissioners consider this request and determine if the Standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.
