There are a number of items which must be addressed before the Division can act on the application. 1. The current Memorandum of Understanding (MOU) between the Colorado Department of Health, Hazardous Materials and Waste Management Division (CDOH) and the Division specifies that any facility which imports waste from off-site locations must obtain a Certificate of Designation (CD) under the Solid Waste Disposal Facilities Act (SWDFA) . A draft guidance document circulated by CDOH indicates that a CD may not be required at mine sites permitted by the Division for inert fill in areas less than 20 acres or less than 1, 000 , 000 cubic yards of fill, however, the MOU has not been modified to incorporate this proposed policy. As a result, the Division will require that the applicant obtain a CD from CDOH, or documentation that the need for a CD has been waived, prior to importation of inert fill onto the permit area. The applicant must provide a copy of the CD or waiver for the Division' s files . 2 . The Division has been in contact with Weld County Planning and Engineering, and they have expressed an interest in this technical revision application. The Division is forwarding a copy of the application, and of this letter, to Weld County, and soliciting their comments . This is in accordance with the CDOH draft guidance document which states "All proposed inert disposal sites must be reviewed by the local governing land use and zoning authority" . 4 . The Division will require that certain controls be put in place for a gravel pit that will be accepting inert backfill . If these requirements are in any way duplicated or superseded by the requirements of a CD obtained for the site, the applicant may propose modifications to the Reclamation Permit requirements to bring them in line with the terms of the CD. 51-1113 IL03 - Letter to John Jordan 2 August 1, 1994 a) The applicant must commit to specific site access restrictions . Locking gates must be installed at all access points and the gates must be securely locked when mine personnel are not on site. The applicant must commit to placing "No Unauthorized Dumping" and "No Trespassing" signs at 100 foot intervals along the fence. The gates, fence, and signs must be maintained in good condition throughout the life of the mine. b) A groundwater monitoring program will be required in order to permit disposal of inert fill at this site. At a minimum, a sufficient number of up gradient and down gradient monitoring wells must be installed in the alluvial aquifer to assure that degradation has not occurred across the permit area. Prior to approval of the technical revision TR-001, the applicant must submit: i) A map that accurately locates all proposed groundwater sample points and any locations that are proposed as points of compliance. ii) A proposal for method of sampling, and frequency of sampling and reporting to the Division. iii) A proposal for parameters to be analyzed, and a description of water quality analysis methods to be utilized as well as quality control and quality assurance methods. iv) A description formations, aquifers or strata to be sampled. v) Identify the locations proposed for inert fill disposal in relation to the locations proposed for down gradient monitoring. The nature of the local hydraulic gradient must be quantified through piezometric data from the wells once there locations have been approved and the wells have been installed. Additional wells may be required based on the piezometric data if pre-installation assumptions about hydraulic gradient are not upheld by the data. The Division will require that boring profiles and well completion schematics be provided as they become available, and will require that sufficient groundwater baseline information be collected prior to placement of off-site inert fill. The wells would have to be monitored for a minimum of five years after final placement of the fill, and if analysis suggests that the inert fill operation has contaminated groundwater, the source of contamination would have to be located and eliminated. Letter to John Jordan 3 August 1 , 1994 5 . The applicant must commit to placement of only well graded fill into the pits. An adequate degree of compaction must be provided to assure long-term stability of the back -filled slopes. It may be necessary to windrow and blend the fill materials, particularly when concrete or asphalt rubble is included, in order to assure that the fill is well graded. Please address each item on the foregoing list prior to the September 15, 1994 decision date as granted as an extention date by the Division for technical revision TR- 004 . If you are unable to comply with this time constraint, a written request for an additional decision date extension would be required to. avoid revision denial . ',•In order to for avoid a Certificate of Designation, Andesite wilI stay within the limits described by policies of the Colorado Department Of Health.. The revision involves the adjustment to Exhibit D (Mining Plan) in the mining permit. The following should be inserted in Exhibit D of the Del Camino permit application: Material of an "inert nature" will be disposed of into the pit to backfill slopes and • complete the reclamation plan. Inert material will be classified as non-water soluble and nonputrescible solids together with such minor amounts and types of other materials as will not significantly affect the inert nature of such solids according to rules and regulations of the Colorado Department of Health and the Board of Health. Inert material includes, but is not limited to, earth, sand, gravel, rock, concrete which has been in an hardened state for at least 60 days, masonry, asphalt paving fragments, and other inert solids including those the Board of Health may identify in regulation. Inert fill material will also be restricted to area and volume as described by the Colorado Department of Health.
