WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of October, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Associated Natural Gas, Inc. , 900 Republic Plaza, Denver, Colorado 80217, for a Site Specific Development Plan and Special Review Permit for a hydrocarbon rail loading facility in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE'„ of Section 2, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, at said hearing on October 6, 1993, the Board deemed it advisable to continue said matter to October 20, 1993, at 10:00 a.m. , to allow the applicant to post the necessary sign, and WHEREAS, at said hearing on October 20, 1993, said applicant was represented by Jim Kirkpatrick, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance. 2. The uses which would be permitted would not be compatible with the existing surrounding land uses. 3. The proposed facility represents a use more intense than was intended in the Agricultural Zone District. A public hearing was conducted on October 20, 1993, at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated September 15, 1993, and duly published September 23, 1993, in the Windsor Beacon, a public hearing was conducted on October 6, 1993, to consider the request of Associated Natural Gas, Inc. for a Site Specific Development Plan and Special Review Permit for a hydrocarbon rail loading facility in the A (Agricultural) Zone District. At said hearing on October 6, 1993, the Board deemed it advisable to continue said matter to October 20, 1993, to allow the applicant to post the necessary sign. At said hearing on October 20, 1993, Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. He noted an Emergency Action Plan draft has been received from Associated Natural Gas, Inc. , and the Union Ditch Company no longer has a conflict with this application. James Kirkpatrick, Associated Natural Gas, Inc. , hereafter referred to as ANGI, stated the application is to locate a rail loading facility on a secluded, 17-acre site with an existing 4" gas line which can easily be switched to a propane line. He pointed out that, besides having to comply with rules and regulations enacted by Colorado Department of Transportation and other State and local entities, Union Pacific Railroad requires compliance with ITS stringent safety rules. Mr. Kirkpatrick stated ANGI is very concerned about safety issues and plans to use state-of-the-art devices as far as safety and filling the rail cars are concerned. He stated ANGI does have a contract on the property, and the railroad has agreed to allow them drive on the right-of-way for access. To help with the engineering on the project, ANGI has agreed to pave the area at least 200' from Weld County Road 35 to the east, to eliminate any dirt or gravel getting onto the highway. Mr. Kirkpatrick said ANGI plans to load only one or two times per week. He also stated water is available through Central Weld Water, and ANGI has received verbal approval from the Colorado Division of Water Resources concerning the well permit. Mr. Kirkpatrick reviewed concerns of the LaSalle Fire Department and explained how those are being handled. In order for the neighbors to enjoy the esthetics of the area, ANGI, after meeting with the landowners in the area, agreed to keep the level of lighting to a minimum and provide landscaping for the facility. Mr. Kirkpatrick explained the Emergency Action Plan draft has provided plans for any emergency situation that might arise, such as fire, bomb threat, and gas or vapor release. In response to Commissioner Baxter, Mr. Kirkpatrick presented a map, marked as Exhibit 0, showing the distance of each residence in the area from the site. He also presented maps showing the general area around the site, marked as Exhibit P and Q, respectively. PAGE 2 Mr. Kirkpatrick answered that several sites were considered; however, this site had the fewest houses within the immediate area. Responding to other inquiries from the Board, Mr. Kirkpatrick offered further information regarding ANGI's plans not to expand in the future, maintenance of the ditch, selection of the site, and safety issues addressed in the emergency plan. He stated the facility is equipped with an automatic shutdown whenever pressure changes. He reiterated propane is not stored at the facility, it is only present during the process of filling the railcars. To clarify for Commissioners Baxter and Hall, Scott Reinick, also from ANGI, said propane is a liquid until it comes into contact with air, at which time it vaporizes. In the event of a spill, Mr. Reinick said the propane will vaporize, not accumulate. The reason the berm was included was to cover the possibility of a fire which necessitated the use of water to cool the tanks. The water would then be contained within the bermed area. Mr. Reinick then answered further questions from Commissioners Kirkmeyer and Hall regarding the location of chemicals and responsibilities for having the appropriate chemicals available on site. Commissioner Kirkmeyer requested two additional Development Standards: one to require the Emergency Action Plan be kept on file and updated every six months, and the second to require ANGI to cooperate with the Union Ditch Company by having standby personnel available on site. Mr. Reinick responded to Mr. Morrison's question by explaining that distributing lines are regulated by DOT; however, gathering system lines are not. This facility is using distributing lines and, therefore, is regulated by DOT. Orlando Mestas, surrounding property owner who was speaking for many of his neighbors, talked about having this type of facility close to their residences and their concerns regarding safety issues. He displayed an overhead of the area around the facility, marked as Exhibit R, showing the close vicinity of residences to the facility. He presented a letter to the Board, marked as Exhibit S, signed by 66 nearby residents who are opposed to the facility at this location. In response to questions from Commissioner Hall, Mr. Mestas stated there are many uncertainties regarding this facility since it is the first of its kind. He pointed out that the Weld County Comprehensive Plan states the focus in Weld County is on agriculture and ag-related business, and he spoke of the conflict arising from trying to maintain urban and rural neighborhoods. A recess was taken at this time. Upon reconvening, Mr. Mestas responded to questions from Commissioners Hall and Kirkmeyer regarding the land in that area being highly productive farmland and the negative long-term implications of a facility of this type. Gloria Mestas, surrounding property owner, stated this facility would disrupt the lifestyle of nearby residents, create unforeseen economic difficulties, destroy farmlands and wetlands, and produce safety hazards of an extreme magnitude in a populated rural agricultural region. She raised a number of questions revolving around these issues for clarification by ANGI. Ms. Mestas said some individuals in the area have already had some verbal responses indicating their insurance policies would have premiums increased or may not be rewritten due to this type of facility being nearby. Glenn Werning, surrounding property owner, among other concerns, stated this type of facility is not consistent with the Comprehensive Plan; the area is not secluded; access could be blocked in the case of a "gas cloud" over the one access road; the value of land will decline; and ANGI appears to be the only one who will benefit from this facility. James E. Miller, adjacent property owner, pointed out this was productive farm land until the last year or two. He raised the issues of why ANGI needs three sidings if they are only going to fill eight to ten cars, and whether ANGI has adequate liability insurance in the event of a catastrophe in the area. In response to a question from Commissioner Kirkmeyer, Mr. Kirkpatrick stated they have applied for a permit from Central Weld Water, but have only received a verbal response. He said there is far more danger in the extraction process than in filling tanks for transport, and he feels loading railroad cars takes many tankers off the roads and is, therefore, a benefit to all citizens. Belinda Hungenberg, surrounding property owner, stated she is against the exception to the Agricultural Zone District. Mr. Kirkpatrick presented an insurance binder proving Excess Liability Insurance from Lloyd's of London, pictures of the site, and a sketch plan map showing proposed landscaping, all marked as Exhibits T through Y. He answered concerns of the residents regarding available water and safety, and stated the operation would be restricted to ten cars per week which, at most, would operate one or two days per week. Mr. Kirkpatrick also pointed out the good safety record of ANGI. Pete Dokkens, ANGI, reviewed the process followed by ANGI in locating a site. He pointed out the facility will be regulated by DOT, the railroad, and LaSalle Fire Department, as well as any other local regulator. He explained, in further detail the mechanics of the automatic shut-down system, and how the actual loading process is completed. As clarification for Commissioner Baxter, Mr. Kirkpatrick reiterated the process as propane will be piped into the tank from gathering lines; the tanks will be emptied into the railroad cars, with propane flowing in and out at the same time; the railroad cars will be transported by rail; and any remaining propane will be loaded onto trucks and hauled away. Bill Dickey, ANGI, reiterated the amount of propane allowed by limiting the company to ten railcars per week. In response to Commissioner Webster, Mr. Dickey said an alternate pipeline could be installed; however, the cost would increase commensurate with the distance to the new location. He also noted ANGI does not have available land or purchase options in other locations. When queried by Commissioner Hall, Mr. Dickey noted that, although ANGI does not have another rail loading facility anywhere in the country, they do operate many other types of plants and facilities, including fractionation plants which are far more sophisticated that this one. Mr. Dickey pointed out that this facility would transport the propane from their nearby fractionation plant that is now being transported by 30 to 50 tanker trucks per day across County roads and State highways. After further discussion, Commissioner Hall moved to deny the request of Associated Natural Gas, Inc. , for a Site Specific Development Plan and Special Review Permit for a hydrocarbon rail loading facility in the A (Agricultural) Zone District because this facility represents a more intense use than was intended for the Agricultural Zone District. The motion was seconded by Commissioner Webster and, on a roll call vote, carried four to one, with Commissioner Baxter voting against the motion. As residents of this area we have asked many questions and have studied the various aspects of the proposal; however, we still have concerns about the potential for expansion and the effect on the quality of the lives of the residents of the surrounding area. Associated Natural Gas has indicated that they are aware of the number of problems that this facility may bring to this area, and have been forthright in their attempts to deal with questions and clarify aspects which were of pertinent interest to the residents. This sharing of information, however, is not a guarantee for the quality of life that we now enjoy. Their answers and plans will be in our "backyard" for years to come and all the unforseen problems will be ours. At this time there are still too many uncertainties that exist in correlation with the implementation of this facility for us to give approval for its construction. The issues of safety, health, pollution, traffic, water damage, land damage, injury, and loss of quality of life are too significant to those of us who make our homes in this area to feel comfortable with an industrial + EXHIBIT I5 r tl$Q (6.N facility of this nature. We feel that the blueprints simply cannot show the negative possibilities of the future, and we do not want to risk our homes, land, livestock, and families to what looks good on paper and to what will ultimately be left to time, nature, and politics. Most of us plan to live out our lives in this area, and we don't want to lose that expectation because "the plan didn't consider something as a possibility." Eventhough the issues have been discussed in detail, as residents of the Godfrey Bottom area, we are submitting this statement as our official record of opposition to the construction and implementation of the proposed hydrocarbon loading/transfer facility. Greeley- Rail Car Loading Facility Deployment of Personnel The primary responsibility and consideration of the supervisor is to ascertain the location and condition of His/Her personnel. After all personnel have been accounted for and This information has been reported, efforts can be directed to controlling the emergency. Following, is a brief description of personnel deployment in a contingency. 1. Contractors - evacuate to the front entrance of the facility and stand by. The contract supervisor(if applicable) should account for His/Her personnel. 2. Operations-after all personnel have been accounted for, isolation of the affected area or shutdowns of the facility should be initiated. Operations personnel should gather at the front entrance of the facility. 3. Maintenance -report to the gathering point at the front entrance of the facility and stand by for deployment. 4. Visitors - all visitors should gather at the front entrance. A visitor is defined as all non-ANGI personnel and any ANGI person that does not normally report to the Greeley Rail Car Loading Facility on a daily basis. Alternate Gathering Point Should conditions preclude gathering at the front entrance of the facility, for the head count, - the alternative gathering point will be at the West end of the facility at the gate. If the entire facility area must be vacated -the gathering point will be at Road_WCR 33 and WCR 35 The Facility Supervisor will designate the gathering point to be used. Nieht Shift. Weekend, and Holiday Contingency Response and Facility Evacuation During these abnormal working hours, there is a minimal amount of manpower on site -possibly only one operator. Upon activation of a contingency, all personnel should be accounted for first and the appropriate actions taken such as the emergency calling sequence. Greeley- Rail Car Loading Facility Any contractors on site during an abnormal hours contingency shall immediately evacuate to the front facility entrance and await further instructions. If evacuation is necessary, the ESD should be activated. Field Facility Contingency Response Personnel will extinguish incipient stage fires, control disaster situations, and perform or assist in rescue operations. This philosophy will be adhered to at our field facilities as well. Upon initial communication of an emergency situation at a field facility, the individual should notify the supervisor-in-charge. The supervisor-in-charge will proceed to the scene, assess the situation, and relay information to the remaining Facility supervisors. Upon assessment of the situation, the supervisor-in-charge will contact (or have the remaining Facility supervisors contact) additional personnel support services such as local fire departments or water and pump truck support. Each incident will be reviewed prior to commencing post-emergency cleanup to determine the presence of new hazards not normally present in the employee's workplace. This review and any employee training done in response to This review prior to commencing work must be documented. At field locations, any individual discovering a fire should assess the situation as to its severity. Before any action is taken, This individual should contact the Facility via radio and describe the situation. After contacting the Facility, isolation should be considered first. If isolation of the fuel source is accomplished, extinguishing the fire may be possible. Personnel safety should be considered the top priority. Greeley- Rail Car Loading Facility CONTINGENCY RESPONSE DUTIES Following is a description of key personnel responsibilities for incident response. Facility Supervisor: His/Her primary initial responsibility is to assist in evacuation and control of emergency incidents. Additionally, he is responsible for contacts with the Denver office, the media, the Environmental manager and the Safety Director. He is also responsible for notifying other ANGI personnel within the Operations area if their assistance is needed and for all documentation. Facility Foreman: His/Her primary duty is to direct the actions of all personnel (ANGI and non-ANGI) and to make tactical decisions. He is directly responsible for accounting for all operations and contract personnel. He will act as a coordinator of all personnel accounting. The Facility Foreman will decide if a total evacuation is necessary and designate the gathering point. He will also determine when an emergency is considered over. In His/Her absence the Facility Operator will assume these duties. Facility Operator: He is responsible for notifying the Plant Foreman of the contingency and will designate the employees that will report to the scene of the incident and those who will support the incident personnel. If evacuation of the community is deemed necessary, he will make the necessary calls to advise "our neighbors". He is responsible for advising other outside interests of the contingency, and the Operations Supervisor. During abnormal hours he will call off-duty operators. He is responsible for sounding the Facility emergency alarm system, activating the emergency shutdown, and de pressurizing the Facility if possible. He is also responsible for notifying the local fire department and Field Supervisor of the emergency. In some cases, he must radio the pumpers in the field. Maintenance Supervisor: During abnormal hours contingencies he will call off- duty maintenance personnel. He is responsible for the management of additional fire fighting resources if needed. He will also monitor the fire fighting efforts and direct outside parties to the Field Supervisor. Deployment of maintenance personnel to extinguish fires (if safe) is also His/Her responsibility. Level II/ Significant • Owner of adjacent compression facility is a target of violence by outside group. The violence carries over to ANGI's facility. • Incident results in grass fire which spreads to adjoining property owners pasture and requires mobilization of local volunteer fire department. Level III/Major • Contractor is killed when crane rigging falls on him at facility site. • Tank rupture results in large gas cloud which travels toward neighboring industries. • Local elections which were scheduled for the next day are canceled and an abnormal concentration of military personnel are noticed on the streets. Greeley- Rail Car Loading Facility APPENDIX E Types of Emergencies and Response Actions An emergency action response has been developed for each of the following contingency situations. It should be understood that This list is not all-inclusive, but the overall plan will assist in addressing similar incidents. 1. Facility Fires or Explosions: A. Fire Fighting Philosophy 1. Local Support - The facility will extinguish incipient or first stage fires, control disaster or potential disaster situations, and perform or assist in rescue operations. These activities will be carried out in conjunction with local fire and medical departments should their services be needed. The local fire department will not attempt to fight any fire on an ANGI location without an ANGI representative coordinating the fire control effort. 2. Fire Fighting - ANGI employees may be expected to perform incipient or first stage fire fighting. Incipient fire fighting is defined as: a). extinguishment with portable dry chemical extinguishers; b). extinguishment with 150 pound wheeled unit dry chemical extinguishers; B. Contract and ANGI Personnel Deployment The primary responsibility for all contractors during a fire situation is to evacuate and to report to the designated gathering point at the front entrance. Upon reporting to the designated point, each person must report to the contract supervisor and assist ANGI personnel if requested. Greeley- Rail Car Loading Facility Any contract personnel on site during a night, holiday, or weekend contingency situation will proceed immediately to the gathering point and await further instructions. The primary responsibility of each ANGI supervisor in a fire situation is to ascertain the location and condition of His/Her personnel. This information should be relayed to the Facility / Field Foreman immediately. The safety of personnel and care for the injured will take precedence over any other action taken. After all personnel have been accounted for, they will be given instructions by the supervisors in charge. C. Contingency Situation 1. Fire- A fire that cannot be immediately extinguished, or a potentially large fire hazard, should be communicated by activating the Emergency Horn. Activation of the horn will be used to alert personnel of an emergency situation. All personnel will report to the gathering point for personnel accounting. The Facility Foreman will account for all operations and contract personnel. The information will be relayed to the Facility Operator. The Facility Operator will implement isolation of affected areas and/or Facility shutdown. All contract personnel should evacuate the Facility site and exit to the designated gathering point at the front entrance of the facility. Each contractor supervisor should account for His/Her people and report this information to the Facility Foreman. If the Facility Foreman determines that the primary gathering point is unsafe, he will instruct personnel at the gathering point to proceed to either the West exit gate or roads 33 and 35. For example, flame impingement on one of the product tanks would constitute a potential BLEVE (Boiling Liquid Evaporative Vapor Emergency) situation and employees would gather at roads 35 and 394. If evacuation of the Facility is warranted and access to the Facility must be controlled, ANGI employees may initiate road blocks at the following intersections: 1. Road 35 & Road 394 to the North 2. Road 33 & Road 46 to the South 2. Weekday Daylight Shifts Emergency Action/ Preparedness Plan 921050 Associated Natural Gas, Inc. Greeley- Rail Car Loading Facility The facility is fully staffed during loading operations occurring during these normal working hours. There should be adequate personnel on site to man all positions and functions of the emergency. 3. Night Shift. Weekends, Holidays Operation of the facility occurs on a demand basis During these abnormal operating hours, there is a minimal amount of manpower on site - possibly only one man. Therefore, the following procedures should be implemented. As always, primary consideration will be given to the safety of personnel and care for the injured. If an incipient stage fire is in progress and can be handled by the available personnel, they should attempt to extinguish the fire. If the fire is not manageable, the emergency shutdown should be activated and the Facility de pressurized if required. Notifications should be made and the employees should evacuate as necessary. H. Bomb Threat In the event of a bomb threat, the person receiving the call should try to get as much information as possible from the caller. Use the bomb threat check list if possible (copy attached). The person receiving the call should immediately activate the emergency alarm and contact the supervisor-in-charge. Total evacuation of the facility should be initiated at This time. Road blocks may need to be set up at the intersections noted above under Section C. 1. The supervisor-in- charge should make all appropriate contacts. Any person receiving a call off-site should get as much information as possible and immediately contact the Facility Foreman. The operator should activate the emergency alarm and ESD and evacuate the Facility site. The Supervisor contacted should: a). Realize that every bomb threat is serious. b). Inform Sheriffs Department. c). Inform Fire Department. d). Contact Facility/ Field Foreman (or His/Her designee) to organize search efforts under the direction of an outside professional agency. The Weld County Sheriffs office has professional explosives experts. The Facility Foreman (or Emergency Action/ Preparedness Plan 931050 Associated Natural Gas, Inc. Greeley- Rail Car Loading Facility III. Personal Injury or Death A. After notification of another individual, first aid for the victim should be addressed. This is everyone's responsibility. Treatment should be concentrated toward life - threatening conditions. 1 Airway is closed/breathing has stopped... open the airway and restore breathing. 2. Heartbeat and breathing has stopped - trained personnel will initiate CPR. 3. Excessive bleeding ... control bleeding with direct pressure and/or pressure points. 4. Shock ... lay the victim flat, keep the victim warm, and raise the feet slightly if no head injuries are present. Do not move the victim unless in an environment or situation which is in imminent danger to the victim or responders. These are only general guidelines, conditions and treatment will vary due to individual circumstances. An ambulance or AIRLIFE should be summoned for any questionable injury. B. Reporting -in the event of a serious injury or death the following procedure is to be followed: 1. Immediately report the accident to the senior supervisor-in-charge and the Safety Director. The Safety Director will respond to the scene as soon as possible, coordinate investigative efforts, and coordinate the appropriate contacts to the Senior Management Department and the Claims Attorney. The Safety Director should also be notified immediately of any serious accident involving contract personnel. 2. The Area Operations Supervisor or supervisor-in-charge will immediately notify the General Operations Manager, and Environmental and Safety, as necessary. The General Operations Manager will initiate the family contact process or designate someone to do so. The contact is not to be made by telephone; rather it should be in person. Natural Disasters A. Earthquakes If an earthquake occurs, the contingency plan should be activated using the best available means. Upon personnel accounting, the situation shall be evaluated for damage and the appropriate portions of the contingency plan initiated. The senior supervisor-in-charge is responsible to activate the applicable portions of the contingency plan. The contingency plan will remain in effect until damage is fully assessed and safe operation is assured. B. Tornadoes If a tornado is sighted, the Facility emergency alarm should be activated to warn employees. The supervisor-in-charge should designate an employee to observe the tornado for reporting of its path of travel. Depending on the path of the tornado, de pressurizing the Facility and evacuating all employees should be considered. Personnel should seek cover in a low-lying area away from power lines (e.g., ditch or culvert). After the tornado has passed, the supervisor-in-charge shall coordinate personnel accounting efforts and assess any damage that may have occurred. The contingency plan will remain in effect until safe operation is assured. V. Spills (Field and Facility) The Spills Contingency Plan or SPCC Plan should be referenced in the event of any spill occurrence. The Environmental Manager is to be immediately notified. A. Oil and Produced Water Spills In the event of an oil or produced water spill, the person discovering it should notify the appropriate Supervisor-in-charge immediately. This person should assess the situation and stop the source of the spill if it may be safely done. Steps to begin containment of the spill should be initiated immediately if it may be safely done. The Supervisor-in-charge should proceed to the spill site and direct control and containment activities. He should assess the need for additional assistance and equipment. Upon assessment the Supervisor-in-charge should immediately contact the Environmental Manager and the Area Operations Supervisor as appropriate. If the Environmental Manager is not available, refer to the Area Oil Spills Emergency Action/ Preparedness Plan 974050 Associated Natural Gas, Inc. Greeley- Rail Car Loading Facility Contingency Plan for reporting obligations. The Operations Supervisor will then contact the Safety Director as needed. B. Chemical Spills In the event of a chemical spill, the person discovering the spill should contact the appropriate supervisor to ascertain the proper identification of the chemical if it is not readily available from container labels. Upon proper identification of the chemical, the supervisor should consult the Material Safety Data sheet for hazardous characteristics and proper handling procedures. Chemtrec (1-800-424-9300) should be contacted with any questions concerning response or chemical hazards. The person discovering the release should not attempt any control and containment without the proper personal protective equipment. After proper handling procedures have been identified, control and containment should begin. The supervisor should proceed to the spill site and direct control and containment activities. He should assess the need for additional assistance and equipment. Upon assessment, the supervisor should immediately contact the Environmental Manager and the Operations Supervisor as appropriate. If the Environmental Manager is not available, refer to the Area Oil Spills Contingency Plan for reporting obligations. The Operations Supervisor will contact the Safety Director. VI. Toxic Vapor Releases There are no sources that would constitute a toxic vapor release at the Greeley Rail Car Loading Facility. VII. Hydrocarbons Gas / Vapor Release A. In Buildings The heater fuel gas supply is the only source found within the office building at the Greeley Rail Car Loading Facility. B. Hydrocarbon Vapor Clouds Incidents may occur which result in an unconfined hydrocarbon vapor cloud over all or a major portion of the Facility site, (e.g., discharge line rupture or vessel rupture). Upon detection of a combustible concentration of vapor in an ambient atmosphere, the Facility alarm system should be activated. The supervisor-in-charge should account for all personnel, initiate actions to isolate the release and extinguish ignition sources including vehicles. Depending upon the conditions, (e.g., wind direction, size of release) the supervisor-in-charge may initiate a total Facility evacuation. Portable combustible gas indicators (MSA 2A's) shall be utilized in determining safe evacuation routes and gathering points. If the release occurs outside the Facility site and impacts or threatens to impact the Facility, the Facility alarms should be activated. If the source of the release is unknown or uncontrollable, the supervisor-in-charge may initiate a total Facility evacuation. Portable combustible gas indicators shall be utilized in determining safe evacuation routes and gathering points. Upon identification of the source of release, the appropriate contact should be made to obtain assistance in isolating and controlling the release. 1. These alarms are visible on the control panel and the pump control panels. When activated an alarm is signaled by a visual alarm on the panel, and an audible alarm in the control room building. This is normally a non-emergency alarm. General Contingency Alarm In the event there is an emergency in the Facility, the first responder will activate the emergency alarm system by depressing one of the manual push buttons. In the event the Emergency Shutdown System is activated, initiation of the emergency alarm system is automatic. The emergency alarm sounds like a electric horn burst. These personnel will also be responsible for retraining upon significant plan changes. New employees and employees recently assigned to the Facility must receive detailed training of the Emergency Action Plan. All contract and visiting personnel receive specific instructions of their responsibilities during a contingency situation prior to entering the Facility. All personnel are currently trained in the following disciplines necessary for proper execution of the contingency responses for which This plan was developed: 1. Dry chemical fire extinguisher use (annual) 2. (If available at Facility) then Respiratory protection/use of self-contained breathing apparatus (annual) 3. Use of portable gas detection equipment (annual) 4. Proper use of personal protective equipment (ongoing) 5. Eight hour first aid (triennial) 6. Four hour CPR/first aid review (every 1 or 2 years) All training is documented with sign-off by all personnel in attendance, and satisfactory completion of assessment testing. Contingencies will be simulated to facilitate plan practice and critique. These drills will be closely observed, unannounced and post-appraised. The primary considerations in evaluating these drills shall be the performance of key personnel and response teams and the evacuation of contract and visiting personnel. Cooperation between the company's Corporate Public Affairs and the news media representatives is the most reliable guarantee that This objective will be met. This can best be accomplished by directing all media questions to the public relations Manager. Response to emergencies and oil or chemical spills in This manner: 1. This proposed facility is designed for the comfort, convenience , and profit of an industrial based organization. As usual, this does not take into consideration the quality of life of those individuals whose permanent homes are in the area. The implementation of this facility would add to an already overburdened traffic situation because of the feedlots, gas and oil well companies, and large farming operations in the designated locale. A loading facility of any type is also just another source of safety hazards and pollution problems that are already burdening the agricultural evnvironment of this section of Weld County. This segment of the county is struggling to maintain its agricultural environment at this time, and the erection of a facility such as the one proposed will give this area the look and feel of an industrial district in a large city. If this is such a "good idea" project, the proponents of this plan should plan to pay above market value prices for all surrounding lands and move the people out so they (the proponents) can turn this area into an industrial site and eliminate the farming, ranching, hunting, and fishing activities that are now supported. This site is also another danger area for local families. La Salle already has one railroad problem which is continually discussed as a hazard for children, school traffic, and general pedestrians. Why would it be sound judgement to create another such area in a heavily populated rural segment? Such construction is a blatant disregard of the rights and safety of the community. The Weld County Commissioners need to give careful consideration to this proposal. The only gain that is going to be made is that on the part of the large companies involved. Please give the farmers and local families who have children, animals, fish hatcheries, and crops a chance to keep their way of life intact. As Commissioners who have concern and insight, let the land keep its value for those who live here and eliminate the possibility of its becoming a low value industrial area and major safety hazard because of some company's financial idea. Your assistance is needed to divert this proposal as it has too many negative long term implications for this area. This is a "handy" proposal for someone which will result in more problems than the Weld County Commissioners will care to deal with in future years in regard to safety, railroad regulations, future highway planning, land right disputes, environmental issues, land values, water problems, tax proposals, and personal litigation. We do not need more of these problems in this area, and all of these things can be avoided by eliminating this facility in this particular area Thank you for any assistance that you can give the residents who live west of La Salle on this issue. We need the right decision to be made for our lifestyle on this proposal. Over ninety-seven percent of the residents of this area are actively opposed to this plan, and we feel that we have a voice that should be recognized on this issue. Jim Kirkpatrick, Right-of-Way Supervisor, Associated Natural Gas, introduced Dennis Olan and Travis Williams. He thanked the Planning Commission for their time and consideration in this matter. He explained they are proposing to construct a hydrocarbon rail loading facility. The proposed site will enable Associated to transport hydrocarbons and other rail car products to the available markets. The site will consist of three rail storage tracks connecting the Union Pacific main track with a rail car loading rack. Access to this site will be provided by Weld County Road 35 . north of the Union Pacific Railroad track and on the Union Pacific right-of-way. The haul road from weld County Road 35 will be paved into the site for 200 feet. Water and electricity are available to the site. Associated Natural Gas plans to introduce a landscaping plan with trees and shrubs, Aspens , Spruce, Russian Olives, Australian Pines, etc. . . to enhance the area. A drip system for watering will be included. Dennis Olan, Midwest Railroad Construction, explained they have been hired by Associated Natural Gas to be the prime contractor to design and construct the railroad facility, the track, and the out-loading ramp for the propane cars. At this time the design shows there will be a perimeter fence with a gate surrounding the process. The train service is one per day, one out and one back. Switching operation will take approximately 30 minutes . The Chairperson asked if there was anyone in the audience who wished to speak for or against this operation. Jerry Harris, surrounding property owner, said that Associated Natural Gas had gone to great lengths to provide them with letters of guarantee regarding the fence, landscaping, etc. . . and he would like to see these letters included in the Planning Commission' s recommendation. He would also like to see a standard that controlled lighting at the facility. Bill O'Hare asked what the site was used for originally. Jim Kirkpatrick said it was zoned Agricultural but no farming was taking place. Bill also asked if a lighting standard could be included in the recommendation. Jim said Associated would comply. Lee Morrison read Development Standard Number 23 , which refers to the Weld County Operations Standards, which include a regulation for noise, lighting, etc. . . Glen Werning, surrounding property owner, had two on-site meetings with Associated and referred to a letter circulated to all the neighbors. The letter was read into the record and placed as an exhibit. He still has concerns about possible future expansion and the dangers of propane. In an emergency (tank explosion) an evacuation of a 1/2 mile radius would be necessary. He also hunts in the general area and is concerned this will no longer be allowed. Jim Kirkpatrick explained there will be berms placed for possible spillage retention, an emergency action plan will go into effect, and Associated has no problems with hunting below the facility. Marie Koolstra asked if expansion was a possibility. Bill Dickey, Vice-President, Associated Natural Gas gave a detailed explanation of the process at this facility and said 10 rail tankers per week at this facility would be necessary. Tom Rulon changed the motion to include 10 rail tankers per week. Bill O'Hare seconded the motion. The Chairperson asked the secretary to poll the members of the Planning Commission for their decision. There are semi-trucks along the road all the time , feedlots , railroad crossings , and school bus traffic . These gas tanks will be very near their backyards . There are kids on horseback in the area. Orlando Maestas, surrounding property owners, said it has been his dream to live out in the country. Associated Natural Gas has been very cordial in their dealing with the property owners in the area. Why does the County publish notices in the Windsor Beacon. This does not help the people in their area of the County. Ava Small, surrounding property owner, said the local railmaster is not aware of this proposal. Greg Thompson read a letter from the railroad. Jim Miller, surrounding property owner, said the property owners should be made aware of the type of insurance Associated Natural Gas carries. Jim Kirkpatrick, said he does not personally know exact figures but this type of operation is required by law to carry alot. He would be happy to supply Mr. Miller with the information. Richard Kimmel asked about the placement of berms. Jim Kirkpatrick said it would be more feasible to place the berms around the tanks than around the perimeter of the facility. Richard Kimmel moved Case Number USR-1024, Associated Natural Gas, be forwarded with the amendments to Development Standards #1 and 5, and Condition of Approval #5, to the County Commissioners with the Planning Commission' s recommendation for approval. Russ Anson, Attorney, representative for Howard and Jeannine Enos explained this property is an entire 80 acre parcel. They want to divide it into two parcels of 42-1/2 acres and 37- 1/2 acres. They plan to place a single family dwelling on each parcel. When the property was purchased in 1991 the seller told them they could build. When they tried to apply for a building permit they were denied. A substantial change hearing was scheduled with the Board of County Commissioners, and approved. Public utilities are available to both parcels. The gravel access road is in excellent shape. The property is not suited to farming due to the small size. This request is consistent with the Weld County Comprehensive Plan because it is within the outer portion of the Urban Growth Boundary. The Windsor Planning Commission unanimously approved this application. I strongly object to issuing a special use permit to Associated Natural Gas to build their hydrocarbon rail loading facility in our agriculturally zone district and backyard. I can't for the life of me believe that the planning commission would entertain, let alone approve, the development of such a monstrosity in our area. The industrialization of this agricultural area would totally destroy and spoil the tranquility and peace of our small community. The traffic, noise, and additional pollution this facility would bring is not welcomed or acceptable. When I first moved to this area it was because the area had low noise, traffic, and pollution. I certainly didn't want to move into an area that would quickly be turned into an industrial park. To issue this permit would be to negatively change the appeal and serenity of the area. For the commission to understand the upheaval , and pollution (light, noise, fumes, traffic) this project would bring I strongly recommend a field trip to the area. The visit would help the commission comprehend how this project would deteriorate the quality of life in this agricultural area. It's ok to let peace prevail, every square piece of land doesn't need to be developed. If there were ever a time when the planning commission could protect the citizen from a company this is it. This request for a special use permit is gluttonous. The gas companies already have a developed area less the 3 miles north of the proposed new area, which, by the way, I hear, and see daily. How can there be a need for another facility so close to another? It's overkill! It would seem much more feasible and cost effective for the company to coordinate these functions by building a railroad spur from their current spot in Evans and arrange to make maximum use of a facility that is already in place. There are many families that live and sleep in this area. How are we to protect ourselves from the hazardous materials that may be used? We all know that the company says it will take great pains to insure the safety of the area. We also know that when something goes wrong the inhabitants are somehow left fending for themselves. I have a neighbor whose water supply was contaminated by an oil company and everyone that he notified couldn't or wouldn't do anything about it. I don't want to be put in such an untenable position. I worked for many years to be able to afford to live in the country. If I should choose to sell my home I can't imagine that the presence of this industrialization would help me sell my home or get what I put into it. I doubt if anyone would step up to reimburse me for the lost revenue I would most assuredly lose. I don't want to believe that some monied interest can just push me aside while there is a commission given the responsibility of protecting the resources and citizens. This proposed facility is designed for the comfort and convenience of an industrial based organization. As usual, this does not take into consideration the quality of life of those individuals whose permanent homes are in the area. The implementation of this facility would add to an already overburdened traffic situation because of the feedlots, gas and oil well companies, and large farming operations in the area. A loading facility of any type is also just another source of the various kinds of pollution that now face the area. This segment of the county is struggling to maintain its agricultural environment at this time, and the erection of a facility such as the one proposed will give this area the look and feel of an industrial district in a large city. If this is such a "good idea" project, the proponents of this plan should plan to pay above market value prices for all surrounding lands and move the people out so they (the proponents) can turn this area into an industrial site. This site is also another danger area for local families. La Salle already has one railroad problem which is continually discussed as a hazard for children, school traffic, and general pedestrians. Why would it be sound judgement to create another such area in a heavily populated rural segment? 921.059 The Department of Planning Services needs to give careful consideration to this proposal. The only gain that is going to be made is that on the part of the large companies involved. Please give the farmers and local families who have children, animals, and crops a chance to keep their way of life intact. Also keep in mind that the majority of people do not hold the mineral rights for their places; thus, those who may be interested in a "lucrative" mineral deal do not even live here nor do they care about how the people who live here feel. As planners, let the land keep its value for those who live here and eliminate the possibility of its becoming a low value industrial area because of some company's idea for a "loading facility for hydrocarbons." Your assistance is needed to divert this proposal as it has too many negative long term implications for this area. This is a "handy" proposal for someone which will result in more problems than the Department of Planning Services will care to deal with in future years in regard to safety, land right disputes, environmental issues, land value, water problems, and personal litigation. We do not need more of these problems in this area. Thank you for any assistance that you can give the residents who live west of La Salle on this issue.
