I 3 �3 o I RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1651 - LORENZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1651, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1651 was submitted by J. Oliver Lorenz, 15614 Weld County Road 42, LaSalle, Colorado 80645, for property which is located in part of the SW** of Section 35, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 149 acres and 2.169 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1651 submitted by J. Oliver Lorenz be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Residential accesses to Lot A and Lot B shall be by access points which currently exist and shall be limited to one per legal lot. All access to Lot B shall be from Weld County Road 33. Lot A and the property located west of Lot A shall use the same access to Weld County Road 38. Prior to recording the plat, the applicant shall show on the plat an easement over Lot A leading to the property located to the west of Lot A. Said plat shall include a dedication of said easement by the applicant for the purposes shown using the language set forth in Section 11.7.12.5 of the Weld County Subdivision Ordinance. Dear Commissioners: This request for a recorded exemption is submitted by J. Oliver Lorenz. The parcel of land on which this request is being made is described as a part of the SW/4 of Section 35, T4N, R66W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent to Weld County Road 38 right-of-way and east of and adjacent to Weld County Road 33. This request is to divide the property into two parcels of 149 acres and 2.169 acres, more or less. A well is serving proposed Lot B and a well is proposed for Lot A for water service. A septic system provides proposed Lot B with sewage disposal and is proposed for Lot A. The applicant wishes to retain proposed Lot B and sell proposed Lot A as a buildable lot. A residence is located on proposed Lot B and access is from Weld County Road 33. Access to proposed Lot A would be from WCR 38 right-of-way. The property under consideration has had 3 lots divided from it by SE-68 in 1978. Each lot has an existing residence and accesses onto Weld County Road 38 right-of-way, which is not a county maintained road. Two of the existing lots lie west of and adjacent and one lies east of and adjacent to proposed Lot A. The Department of Planning Service's Staff recommends denial of this proposal based on the lack of efficient and orderly development, noncompliance with the agricultural goals and policies, and noncompliance with the transportation goals and policies, as stated in the Weld County Comprehensive Plan. 945 963 940925 The applicant has not demonstrated that this request is consistent with efficient and orderly development and is evading the purpose of the recorded exemption process by creating multiple lots without utilizing the subdivision process. Two (2) recorded exemptions have been approved in the S/2 of Section 32, T5N, R64W and both were applied for by Mr. Lorenz. This type of subdivision creates a piecemeal,row type development that is in conflict with the intent of the A (Agricultural) zone district, the Subdivision Ordinance, and the Weld County Comprehensive Plan. This request, if approved, would allow for the addition of a dwelling on proposed Lot A; further intensifying the residential uses on the property, adding to the piecemeal and row type development of the area, and further reduction of open space.
