RE: GRANT CHANGE OF ZONE FROM C-3 (COMMERCIAL) TO R-1 (LOW DENSITY
RESIDENTIAL) FOR WELD COUNTY BOARD OF COUNTY COMMISSIONERS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 8th day of July, 1992, at 10:00
a.m. for the purpose of hearing the application of the Weld County Board of
o U County Commissioners, 915 10th Street, Greeley, Colorado 80631, requesting a
Change of Zone from C-3 (Commercial) to R-1 (Low Density Residential) for a

commercial development within the urban growth boundaries of

zoned R-1. The property is presently undeveloped. This

zoning, and realign the zoning district boundary to coincide

with water and sewer providing the conditions of the district
are met.

The following business was transacted:
I hereby certify that pursuant to a notice dated June 1, 1992, and duly
published June 4, 1992, in the Windsor Beacon, a public hearing was
conducted to consider the request of the Weld County Board of County
Commissioners, 915 10th Street, Greeley, Colorado 80631, requesting a
Change of Zone from C-3 (Commercial) to R-1 (Low Density Residential) .
Lee Morrison, Assistant County Attorney, made this a matter of record.
Lanell Swanson, Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record. There was no
public testimony offered concerning this matter. Commissioner Lacy moved
to approve the request of the Weld County Board of County Commissioners,
915 10th Street, Greeley, Colorado 80631, requesting a Change of Zone
from C-3 (Commercial) to R-1 (Low Density Residential) , based on the
recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval as entered into the record. Commissioner Lacy
said this would bring the zoning into proper perspective with the
surrounding properties. The motion was seconded by Commissioner Kirby,
and it carried unanimously.
This Certification was approved on the 13th day of July, 1992.

The Chairman explained the County is the applicant in this case. He asked if
there was anyone in the audience who wished to speak for or against this
application.
Lanell Swanson explained this request will be to align zoning with the property
boundaries in this area.
Joe Kuettel, surrounding property owners asked what R-1 (Low Density Residential)
zoning means.
Lanell Swanson explained R-1 zoning means one home per legal lot.
Jean Hoffman moved Case Number Z-470, with the Conditions of Approval, be
forwarded to the Board of County Commissioners with the Planning Commissions'
recommendation for approval based on the staff' s recommendation. Judy Yamaguchi
seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission
for their decision. Richard Kimmel - yes; Jean Hoffman - yes; Tom Rulon - yes;
Bill O'Hare - yes; Judy Yamaguchi - yes; Don Feldhaus - yes; Shirley Camenisch -

Kuettel Change of Zone
This proposal is to change the existing C-3 Zoning in the northeast corner
of this property to R-1. The property owner does not have a local address
but has been notified by mail.
In 1981 when the County's redistricting was implemented, a 200' strip
along Highway 34 was zoned C-3. This zoning change took place without
regard for the existing property boundaries or the current use of the
property.
It is the request of the Board that the zoning district be changed to
reflect the property boundaries and the existing use of the property.
This parcel is vacant at this time and it is the opinion of the Department
of Planning Services' staff that an R-1 designation is more appropriate.
This parcel lacks sufficient frontage along Highway 34 to justify the
current zoning and does not currently have access to 34.
The proposed zone change will make the subject parcel more compatible with
other properties that access onto East 20th Street which are also zoned
R-1.
Water service is available from the City of Greeley. Individual septic
systems will provide sewage disposal.
There are no known soil conditions that would limit the development of
this property for residential purposes.
According to maps available to the Department of Planning Services, there
are no known mineral resources that are feasible to recover.
This property is not in the flood plain or geologic hazard overlay zone.
It is located in the airport overlay district but is not in conflict with
the requirements of the district.

Access to the state highway from the affected area will be controlled by
the application of the State Highway Access Code. At such time that there

must be issued by this office. That permit must be in reasonable conformance
with the State Highway Access Code.
