APPROVED WITH CONDITIONS
RE-1418 is approved in conjunction with SE-432.
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.
Prior to recording, the following note shall be shown on the plat:
No structures shall be constructed within 25 feet of the top
portion of the berm, along either side of the Larimer and Weld

Your recorded exemption application is complete and in order and will be processed
on or before June 7 , 1992. If it is determined that the application meets the
approval criteria of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations, you will be notified that the recorded exemption is
approved. If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date prior
to the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the the Town of Severence Planning Commission for its review and

regarding the date, time, and place of this meeting. It is recommended that you
and/or a representative be in attendance at the Severence Planning Commission meeting
to answer any questions the Commission members may have with respect to your

Item 4. We have our farm for sale and have entered into contracts
to sell the farm in three separate parcels to 3 separate
buyers. We are requesting this division in conjunction with
a subdivision exemption.
Our farm has been on the market for the past six months , and
we have been unable to obtain an offer as a unit. We now
own a ranch in Wyoming, and it is our intent to relocate our
entire operation there.
The large parcel will be purchased by a neighbor who will
continue to use the property for farming and a livestock
operation. The other 2 parcels will be used as rural
residences as they are now being used .
The general configuration of the property will not change
except for ownership.
Item 5. This proposal is consistent with the policies of the Weld
County Comprehensive Plan because :
A. No lot has been created by a recorded exemption within
the last 5 years.
B. There will be no land taken out of production .
C. The parcels will have access from Weld Co. Rd . 76
which is a county road right of way .
Item 6. This proposal is consistent with the intent of the Zone
District which is agriculture , and will remain as such .
Item 7. The use of the property will remain as irrigated farming ,
and the grass portion will be used for grazing livestock .
Item 8. The uses permitted will be compatible with future
development, because there has been no lot split within the
last 5 years. The land is surrounded by irrigated farmland
and rural residences . It is unlikely that there would be
any major future development in the area other than that
approved by the Planning & Zoning regulations of Weld
County . The location of this property will not affect any
master plan of any municipality.
Item 9. This proposal is not inconsistent with the efficient
and orderly development of the county, as there is no
future development contemplated. We are splitting off the
existing improvements, and will not be creating new lots
for future development.
Item 10. Domestic water for the proposed Lot A is now
being serviced by North Weld Water District. The domestic
water for the Subdivision Exemption and Lot B will be
serviced by North Weld Water District ( letter attached) .
Item 11 . The property under consideration is not located in a
flood plain or the Weld Co. Airport Overlay District.
