RESOLUTION RE: RELEASE COLLATERAL FOR PHASE 1; ACCEPT COLLATERAL FOR PHASE 2; ACCEPT WARRANTY COLLATERAL FOR PHASE 1; EXECUTE RELEASE OF LOT SALE RESTRICTION FOR PHASE 2; AND AUTHORIZE CHAIRMAN TO SIGN NECESSARY DOCUMENTS - HARRISON RESOURCE CORPORATION/VALLEY VIEW RANCH P.U.D. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated March 25, 1992, the Board granted Final Planned Unit Development (P.U.D. ) Plan approval, Planning case number S-319, to Harrison Resource Corporation, and WHEREAS, Phase 1 consists of Lots 1, 2, 3, 4, and 5 of Valley View Ranch Planned Unit Development (P.U.D. ) and Phase 2 consists of Lots 6, 7, 8, 9, 10, and 11 of Valley View Ranch P.U.D. , and WHEREAS, Letter of Credit #659, issued by the First Interstate Bank, is acknowledged to cover Phase 2 of the Valley View Ranch P.U.D. , and the Board finds that it is adequate and acceptable to cover the estimated costs of improvements, and WHEREAS, adequate and acceptable warranty collateral, in the amount of $1,324.00 in cash, has been posted to cover 10% of the value of the improvements in Phase 1, less the improvements accepted by North Weld County Water District for a period of one year from June 16, 1992. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that collateral be, and hereby is, accepted and approved for Phase 2 of Valley View Ranch P.U.D. BE IT FURTHER RESOLVED by the Board that warranty collateral be, and hereby is, accepted and approved for Phase 1 of Valley View Ranch P.U.D. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign the Release of Lot Sale Restriction for Phase 2 of Valley View Ranch P.U.D. My understanding is that you will be asking the Weld County Commissioners to approve the revised Phase II construction cost estimates and to execute a Release of Lot Restriction on Lots 6, 7, 8, 9, 10, and 11. All work, in connection with water service by our district, has been completed to our specifications in Phase I of the Valley View Ranch, which is located in part of Section 5, Township 6 North, Range 67 West of the 6th P.M. The work was completed by Schmidt Earth Builders of Fort Collins and is ready for service at this time. As planned, perspective customers will have to purchase a domestic water tap prior to actual service being installed to each new home. Harrison Resource Corporation has also completed the installation of the fire hydrant to our specifications at the intersection of Weld County Road #74 and State Highway #257. We have accepted for ownership and maintenance the fire hydrant and water line as constructed in Phase I, serving Lots 2, 3, 4, and 5 of the Valley View Ranch. In reviewing Paragraph 9.8, it tallcs about the 10% warranty collateral which would not include improvements fully accepted for maintenance by the responsible government entity, special district or utility company. It would appear that those items meeting that criteria would be the water mains for $4,400 and the fire hydrants for $2,800. That totals $7,200. My other assumption would be that since the engineering and supervision costs have been completed at $1,500 that no warranty collateral would be needed for these items. That would result in the items needing warranty of $13,236. It would appear that a Certificate of Deposit in the amount of$1,324 should be sufficient to cover the remaining items. I am in the process of getting a letter from North Weld County Water District regarding their acceptance of all the water work in the project. Please let me know if you have any questions. County Engineer Subject: Valley View Ranch PUD Phase 1 Collateral S-319 I have inspected the Phase 1 improvements in Valley View Ranch PUD as outlined in our improvements agreements with Harrison Resource Corporation. The utilities have been installed, and the street construction and landscaping are complete. The road is a gravel surface and will not be maintained by Weld County. Therefore, the one-year warranty period for the road is not applicable. The collateral for the Phase 1 improvements may be released or transferred to the Phase 2 improvements. The amount of the collateral for Phase 1 was $21,936. The amount of the collateral for Phase 2 should be $24,502.
