RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1252 - CITY OF THORNTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended , did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1252 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 1252 was submitted by the City of Thornton for property which is located in part of the SW* , Section 7, Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 87 acres and 2 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . APPROVED WITH CONDITIONS The Department of Planning Services has determined through the review that the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 900447 RE-1252 City of Thornton - Farm 11115 Page 2 Prior to recording, the applicant shall furnish a written statement to the Department of Planning Services that the well on the 1 .69 acre parcel has been used since prior to 1972 for fire fighting, drinking, and sanitary purposes inside a single-family dwelling, the watering of domestic animals, and irrigation of not more than one acre of home lawn or garden. Prior to recording, the Recorded Exemption plat shall be amended to show: - A 75 foot right-of-way reservation north of the centerline of State Highway 14; and - the 20 foot access easement enlarged to 30 feet. The 30 foot access easement shall serve as the only access to the property. The second access shall be removed. The removal of the second access shall be coordinated with the Department of Highways. The parcels of land on which these requests are being made are described above and recorded exemption plats submitted by the applicant are attached. These requests have been approved administratively by the Department of Planning Services' staff with certain conditions. Each of these applications has shown a twenty foot access easement across the proposed smaller lot for the benefit of the proposed larger lot. The Department of Planning Services has approved these applications with the condition that the access easements be shown as thirty feet. Other conditions of approval apply to each recorded exemption. 30447 Board of County Commissioners May 23, 1990 Page 2 Landmark Engineering, who prepared these applications for the City of Thornton, has submitted a letter, dated May 9, 1990, objecting to the condition requiring a thirty foot access easement. Their letter is attached. It has been the policy of the Board of County Commissioners to require easements for access to be a minimum of thirty feet in width. This policy has been based upon the requirements of some of the Fire Protection Districts in Weld County. In addition, these access easements are expected to be used by farm implements which require a wider roadway than other vehicles. The staff requests that the Board of County Commissioners consider these applications and determine if the standards of Section 9-2 E. About 1-1/2 years ago we prepared several exemptions for the City of Thornton , and they were approved with 20 ' access easements. It has been our experience that 20 ' wide is the standard that has been accepted by area cities and counties. The basis for this comes from Fire Safety Standards for fire trucks. We have also failed to find in the Weld County Standards that a 20 ' easement is not acceptable. We thank you for your consideration of the above.
