HomeMy WebLinkAbout920551.tiff AR2 3D 1,55 3 RESOLUTION RE: APPROVE VACATION OF MINOR SUBDIVISION S-291 GRANTED TO DON AND CAROLYN BRAZELTON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a Minor Subdivision (S-291) for six lots in the R-1 (Low Density Residential) Zone District was granted by resolution dated March 23, 1988, to Don and Carolyn Brazelton, and WHEREAS, said Minor Subdivision was granted for property described as: Part of the NEI of Section 32, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Don and Carolyn Brazelton have requested vacation of said Minor Subdivision, since they have decided not to develop the property into six lots, but instead to request a recorded exemption for two lots in its place, and WHEREAS, after study and review, the Board deems it advisable to approve vacation of said Minor Subdivision. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Minor Subdivision (S-291) for six lots in the R-1 (Low Density Residential) Zone District, granted by resolution dated March 23, 1988, to Don and Carolyn Brazelton be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted b the following vote on the 17th day of June, A.D. , 1992. Application for Recorded Exemption 2 . Power of Attorney 3 . $750 . 00 application fee 4 . Copy of Deed showing ownership 5 . Map of subject property and proposed division A certificate of Conveyances has been requested, and will be submitted to you when we receive it. On March 23 , 1988 the Board of County Commissioners adopted a resolution approving Minor Subdivision S-291 for Don and Carolyn Brazelton. This Minor Subdivision was for six lots in the R-1 (low density residential) zone on the west side of 1st Avenue north of Greeley. Mr. and Mrs . Brazelton have not pursued development of the Minor Subdivision, and no plat for the subdivision has been recorded. The Brazeltons no longer want to develop the property into six lots, but instead want to divide it into two lots. One lot, which has no improvements on it at the present time, will contain approximately six acres, and the other lot, which is the location of the Brazeltons ' home, will contain approximately seven acres. Both lots will be used for residential purposes. In approving the Minor Subdivision, the County Commissioners have already determined that division of this property is compatible with the surrounding area and uses, is not inconsistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and is consistent with provisions of the Weld County Zoning Ordinance. The Commissioners have further found that water taps are available from North Weld County Water District, that use of individual sewage disposal systems has been approved, that there is no danger from soil erosion or instability, Weld County Department of Planning Services May 13 , 1992 Page 2 that no unreasonable congestion or unsafe conditions will be placed on existing highways, that there will not be a burden placed upon school districts or local governments in providing services, and that there will be no undue adverse effects on scenic, historical or natural areas, wildlife habitat or surrounding residential properties. I therefore request that the Brazeltons ' Application be approved, and that as part of such approval, the prior approval of the Minor Subdivision S-291 be withdrawn.
