Box 5714 Denver, Colorado 80217 Subject: Retention pond, USR #481 located in part of Section 33, Township 3 North and part ofSection 4, Township 2 North, all in Range 62 West of the 6th P.M. , Weld County, Colorado. Dear Mr. Cervi: Thank you for your letter of April 15. The Department of Planning Services' staff and the Environmental Protection Services' staff have reviewed your request to construct a third retention pond, 4.36 acres in size, on the property described as USR #481. The Planning Department staff has determined that the 4.36 acre pond would not be considered a material deviation from the approved plans of USR #481. This determination is based on compliance with the following: 1. Building permits being applied for and approved. 2. Bench marks of 1 inch intervals being added to the concrete pad for a permanent pond measuring device. 3. All construction on the pond will be supervised by a• responsible registered professional engineer. 4. A complete as-constructed plat with an engineer's certification that the pond is constructed as proposed and has an infiltration rate of less than or equal to 1 x 10 -7 cm/sec as specified in the proposal, is submitted to the Environmental Protection Services. 5. Prior to the use of the newly constructed pond, the Environmental Protection Service shall conduct an on-site inspection and provide you with a letter of authorization. -pi_014 11 °I17-0114 i t April 26, 1991 Page 2 6. Upon completion and approval of the newly constructed pond, the water from Pond C is to be transferred to the new pond again. 7. Upon completion of the new pond and the transfer of water, the facility is not to use Ponds A or C until sufficient certification and documentation assuring the integrity of those ponds has been submitted to and approved in writing by the Environmental Protection Services. Special use permit for the facility authorizes the construction of four (4) ponds. At present there are two (2) ponds constructed on the site. Since the permit clearly authorizes four (4) ponds the proposal is consistent with the existing permit. The staff approves of the proposal as submitted with the condition that all construction of the ponds will be supervised by a responsible, Registered Professional Engineer. Mr. Cervi will be responsible to submit a complete as-constructed plat with an engineers' certification that the pond is constructed as proposed and has an infiltration rate of less than or equal to 1 x 10 -7 cm/sec as specified in the proposal. Upon completion and approval of the new constructed pond, the water from pond C is to be transferred to the new pond and pond C is to be evaluated by a registered professional engineer to certify its integrity before it is used. Upon completion of the new pond and the transfer of water, the facility is not to use ponds A or C until sufficient certification has been submitted and approved by the department assuring the integrity of those ponds.
