RE: VIOLATIONS OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES
A public hearing was conducted on August 9, 1994, at 10:00 a.m. , with the
following present:

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether
to authorize the County Attorney to proceed with legal action against the
individuals named for violations of the Weld County Building Code and
Zoning Ordinances. County Attorney Bruce Barker reviewed hearing
procedures and order in which cases would be heard today. Cases heard
were as follows:
VI #2114 - Elmer and Bernice Loeffler/Francis Derby (tenant) (cont. from
07/12/94) : Ed Stoner, Department of Planning Services, reported this case
closed.
BCV #2116 - Ernest F. and Sharon E. Spurlin: Mr. Stoner reported this
case closed.
VI #2116 - Randall Duncan/Ron Rainey (tenant) : Mr. Stoner reported this
cased closed.
VI #2000 - Clifford Dyer: Mr. Stoner presented the case report, including
a video of the property made August 8, 1994, for the record. He reported
the semi-trailer storage, repair, and salvage operation on this property
is a violation of Sections 31.4. 7, 31.2, 33.4.2, and 33. 4.4.5 of the Weld
County Zoning Ordinance. To correct the violations, the property owner
must apply for and have approved a Special Review Permit or move the
machinery from the property. Clifford Dyer, property owner, was present
and indicated he had allowed the trailers to be stored on the property to
help out a friend. He stated he did not realize how many trailers were on
the property until he received the violation notice. Mr. Dyer discussed
his desire to develop the land and the constraints he has encountered with
increased taxes, zoning, and decreased sales value because of the feedlot
reopening next to the property. (Let the record show that Commissioner
Baxter is now present. ) He indicated he has a verbal agreement with the
tenant to remove one trailer a week, which has worked out to this point.
Commissioner Harbert stated this violation has been on-going since July
26, 1993, and asked when the extra trailers had been moved onto the
property. Mr. Dyer did not know an exact date, and, in response to
Commissioner Hall, indicated there are still five or six trailers on the
property, as well as his own horse trailer and flatbed trailer. He also
stated the trailers are not all salvage. Responding to questions from the
Board, Mr. Stoner indicated the property is zoned A (Agricultural) and C-3
(Commercial) , which does not allow for any storage, repair or salvage
without an approved Use by Special Review Permit. In response to
Commissioner Hall, Mr. Dyer indicated he could have all the trailers moved
within six weeks. No public comment was offered. Commissioner Hall moved
to delay referral to the County Attorney for legal action of VI #2000
against Clifford Dyer for six weeks to allow the property owner time to
have the remaining trailers moved from the property. The motion was
seconded by Commissioner Harbert and passed unanimously.

VI 112109 - Melba Distel: Mr. Stoner reviewed the case report, including
a video of the property made August 8, 1994, for the record. He stated
the noncommercial junkyard is a violation of Sections 31.2 and 31.3.9 of
the Weld County Zoning Ordinance. To correct the violation, the property
owner must submit and have approved a screening plan or remove the junk
from the property. William Distel, representing the property owner, was
present and indicated the property has been essentially as it is for
twenty-five years and indicated some questions as to exactly what the
violations were. The Board asked to view the video again, with Mr.
Distel's commentary. Mr. Stoner stated no screening plan has been
submitted or approved; however, some orange plastic snow fence has been
installed along the east side of the property, as evidenced in the video.
In response to the Board's questions whether the vehicles ran or were
licensed, Mr. Distel indicated the vehicles on the property are not
required to be licensed, as long as they are used on the farm only.
Commissioner Harbert asked staff what would have to be removed from the
property, according to the Zoning Ordinance guidelines. Mr. Stoner
reiterated that nothing need necessarily be moved if a screening plan is
submitted, approved and put in place. He indicated the Board could decide
whether the snow fencing in place on a portion of the property was
adequate screening. Greg Thompson, Department of Planning Services,
stated that a six-foot, wooden fence is typically used for screening, as
long as nothing is visible from the adjacent properties through or over
the top of the screening. He reiterated that no screening plan has been
submitted or approved for this property. In response to Mr. Distel's
question, Mr. Barker clarified that the Weld County Zoning Ordinance was
enacted in 1976, with numerous amendments through the years. Commissioner
Baxter explained the Planning Department does not go about the County
looking for violations of the Zoning Ordinance; however, it must respond
to specific complaints about a property. Mr. Distel enumerated a number
of complaints about the Planning Department staff's methods and
requirements. In response to Commissioner Kirkmeyer's question as to why
they had not responded to any notices sent since May 16, 1994, regarding
the violations, Tom Distel, the property owner's son, stated he had talked
to Barry Kramer, Department of Planning Services, on May 23, 1994, and did
not understand what had to be done to comply. The Distels indicated their
mother owns the property and, since William Distel farms 200 miles away,
he has to work on the property when he has time. In response to William
Distel's statement, Commissioner Hall explained the definition of
"junkyard, " as well as the necessity of a screening plan and what to
include in the plan. William Distel again interjected complaints about
County policies, and questioned who considered what to be violations, this
being private property. Commissioner Kirkmeyer responded by reviewing the
Planning Department's case file and stressing the Board's responsibility
to uphold the Zoning Ordinance standards. She reminded the Distels that
they had the choice of cooperating with the Board and Planning staff by
submitting a screening plan for approval and making a timely effort to
correct the violations, or dealing with the courts in a legal complaint.
At this time, Chairman Webster asked the Distels if they could have the
property in compliance within thirty days. William Distel indicated he
would like enough time to get his wheat planted, and Mr. Stoner clarified
that the screening plan is all that is required at this time to initiate
compliance. After further discussion, Commissioner Harbert moved to
require the Distels to submit a screening plan to Department of Planning
Services staff by August 23, 1994, with approval and completion of said
plan by November 1, 1994. Commissioner Baxter seconded the motion.
During discussion, Commissioner Baxter reiterated the process of
submitting the screening plan, its approval and implementation. In
response to Commissioner Kirkmeyer, Commissioner Harbert clarified her
motion that if a screening plan is not submitted by August 23, 1994, this
case will be referred directly to the County Attorney for legal action.
She also stressed the importance of communicating and cooperating with
Department of Planning staff regarding any problem with the plan or its
implementation. Mr. Barker added that the screening plan must be
approved and completed by November 1, 1994, or the case will be directly
referred to the County Attorney for legal action. No public comment was
offered. With no further discussion, the motion passed unanimously.

VI 112069 - Stanley L. and Emma Lou Hiller: Mr. Stoner presented the case
report, including a video made on August 8, 1994, for the record. He
indicated this noncommercial junkyard is a violation of Sections 31.2 and
31.3.9 of the Weld County Zoning Ordinance, and, to correct the
violations, the property owner must install a screening plan or remove the
junk from the property. In response to Commissioner Harbert, Mr. Thompson
verified that Mr. Hiller's screening plan was submitted on April 26, 1994,
and approved on May 4, 1994, with concerns whether the fence would be high
enough on a portion of the property; however, the plan has not been
implemented. Stanley Hiller, property owner, was present and explained
that the fiberglass panels to be used as screening must be ordered and
will take six to eight weeks to acquire. He also stated that he has made
numerous attempts to contact Planning staff, who never seem to respond to
his calls. In response to Chairman Webster, Mr. Hiller explained that by
using the fiberglass panels as screening, he could later use it for other
purposes after the property is cleaned up. In response to Commissioner
Kirkmeyer, Mr. Hiller indicated he would be financially able to obtain the
material for the screening. The Board encouraged Mr. Hiller to complete
work on the screening such as setting the posts and rails while waiting
for the fiberglass panels to arrive. No public comment was offered.
Commissioner Hall moved to delay referral to the County Attorney for legal
action of VI #2069 against Stanley and Emma Lou Hiller until November 1,
1994, to enable the property owner to complete the screening plan.
Commissioner Kirkmeyer seconded the motion, which carried unanimously.
VI 112004 - Melvin and Imogene Bickling: Mr. Stoner presented the case
report, including a video of property made August 8, 1994, for the record.
He indicated the noncommercial junkyard is a violation of Sections 34.4.2
and 33.4.2 of the Weld County Zoning Ordinance, and the property owners
must submit and have approved a Site Plan Review or remove the outside
storage from the property to correct the violations. Mr. Stoner reported
that some of the material has been removed, but the property is still in
violation. The property owners were neither present nor represented at
this hearing. No public comment was offered. Commissioner Hall moved to
refer VI #2004 against Melvin and Imogene Bickling to the County Attorney
for legal action. The motion was seconded by Commissioner Kirkmeyer and
carried unanimously.
VI #2118 - Robert and Noreen Sims: Mr. Stoner reported that Mr. Sims is
hospitalized at this time and requested this case be continued to
September 13, 1994. Commissioner Hall moved to continue VI #2118 against
Robert and Noreen Sims to September 13, 1994, at 10:00 a.m. Commissioner
Kirkmeyer seconded the motion, and it carried unanimously.
This Certification was approved on the 15th day of August, 1994.

As of July 26, 1994 the above property remains in violation of the Weld
County Building Ordinance. I have scheduled a hearing with the Board of
County Commissioners on Tuesday, August 9, 1994 at 10:00 a.m. to consider
this Building Code Violation. The property will be reinspected on August
8, 1994 to determine compliance and if uses on the property are not in
compliance at the time of the inspection, then the Building Code Violation
will be considered by the Board of County Commissioners at the hearing. If

Inspected property to determine compliance. The property is not in compliance
at this time. There are still two camping trailers being used as housing. The
trailers are skirted and there is a porta-john sitting next to them. There has
been 9.p. contact between Mr. Duncan and me or Todd Hodges since June 3, 1994.
When At stopped by the property on the 25th of July the main residence a double
wide mobile was being moved about 200 feet south of it original location and was
unable to contact anyone.

violations of Sections 31.3.3, 43.2, and 31.2.2 of the Weld County Zoning
Ordinance.
The use of two camping trailers for temporary or over night housing without the
appropriate zoning permits. To correct the violation a certificate of compliance
would need to be applied for and approved for the first accessory to farm and a
zoning permit applied for and approved for the second trailer.
It is the intention of this office to assist and cooperate with you without
imposing undue hardships; however, we have no discretion in this matter if you
fail to correct this violation. You have until July 21, 1994, to correct this
zoning violation. Failure to do so will result in this office scheduling the
violation before th Board of County Commissioners to consider whether to refer
the violation to the County Attorney's office for legal action.
