Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster - Absent Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Director of Engineering Department, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated May 13, 1992, and duly published June 11, 1992, in the Windsor Beacon, a public hearing was conducted to consider the creation of Weld County Road 8 Local Improvement District #1992-3. Chairman Kennedy stated that since he has a financial interest in this matter, he will abstain from the hearing, and Chairman Pro-Tem Harbert will chair this hearing. Mr. Kennedy then left the podium. Lee Morrison, Assistant County Attorney, made this a matter of record. Let the record reflect that Commissioner Webster is now present. At the request of Chairman Pro-tem Harbert, Mr. Morrison advised the Board of the procedure to be taken at today's hearing. He explained that bids would be let and after the work was completed, an assessment hearing would be scheduled at which time individual protests may be heard. Mr. Morrison said the Board should consider accepting the draft resolution to create said local improvement district and hear any protests today. Drew Scheltinga, Director of Engineering Department, explained the area to be paved consists of 8.5 miles. The district consists of 229 total parcels, with properties adjacent to said road and the five subdivisions accessing said road to be assessed. The assessment will be $500 per parcel, which may be paid in one lump sum or over a ten-year period at 8% simple interest. There were 127, or 55%, of the property owners that signed the petition. Mr. Scheltinga said three parcels adjacent to Road 8 were excluded. Said parcels are owned by the State of Colorado, Public Service, and the Keene 4-H Club. He also said there were three petitions to be included submitted by McAllmans, Gartrells, and Ells, who are not adjacent to said road or in one of the five subdivisions. He noted that four letters against, one submitted today as Exhibit MM, and ten letters in favor of the district have been received. Mr. Scheltinga said the improvements will consist of 12' driving lanes, with 3" of asphalt and 6" aggregate base course, with varying shoulders not less than 4' wide. No major earthwork is expected. Drainage will include improvements to ditches and culverts, with the driveways being the responsibility of the property owners. There will be a 9" increase in the height of the road. Weld County will install any needed or requested culverts; however, the property owner will have to pay for the purchase of said culverts. Mr. Scheltinga said the preparation work will be done by the Weld County Road and Bridge Department, with the aggregate base course being estimated at $390,000. Paving will consist of 18,000 tons of asphalt estimated to cost $435,240, with a total cost of $825,240. The districts contribution will be $114,500, which is approximately one-quarter of the paving cost. He said the anticipated $500 assessment will not change. Administrative costs will be from $15,000 to $25,000, which include engineering, bidding, hearing, field work, and legal costs. Mr. Scheltinga said the tax notifications for this district may be separate from the regular notice. In response to a question from Commissioner Webster, Mr. Scheltinga explained that .7 of mile on the Interstate 76 overpass is already paved; therefore, there will only be 7.8 miles of new pavement. Chairman Pro-tem Harbert had all persons in the audience who agree with Ms. Prough stand. Mr. Morrison counted eleven people. Wulf Kroekel, Vantage Acres, said he agrees the road needs paved; however, he does not want to pay for it. Mr. Kroekel said the surrounding area did not pay for paving, and his assessment will be $1000 for paving a road he is not adjacent to and will not use. At the Chairman Pro-tern's request, Mr. Morrison counted five people, including Mr. Kroekel, who stood in opposition. Commissioner Lacy named several roads that have been paved through the process of local improvement districts. Chairman Pro-tem Harbert explained that Weld County does not solicit these districts, the public requests them. Lola McCleskey, property owner, stated her opposition to the payment and concerns regarding tax increases. Mr. Morrison read the title of the proposed resolution into the record. He explained what said resolution entails and said, upon the Board's adoption, all statutory requirements will have been met. Commissioner Lacy moved to approve the draft resolution to create Weld County Road 8 Local Improvement District #1992-3. Commissioner Kirby seconded the motion, which carried unanimously. This Certification was approved on the 20th day of July, 1992.
