HomeMy WebLinkAbout941057 RESOLUTION RE: APPROVE RELEASE OF PORTION OF COLLATERAL IN THE AMOUNT OF $79, 747.00 FOR SHILOH, INC. (S #354) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated May 25, 1994, the Board did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) with Shiloh, Inc. , concerning property described as a tract of land situated in the SE* of Section 4, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, pursuant to said agreement, Letter of Credit #744, drawn on the First Interstate Bank of Fort Collins, N.A. , P.O. Box 578, Fort Collins, Colorado 80522-0578, in the amount of $292, 370.00 was submitted to Weld County, and WHEREAS, James Scott, of Shiloh, Inc. , has presented the Board with a request for partial release of said collateral for completion of gas service, survey, street monuments, landscaping, engineering, and supervision, in the amount of $79, 747.00, and WHEREAS, after study and review, and based upon the recommendations from the Department of Planning Services and County Attorney staff, the Board deems it advisable to approve said request to release said portion of collateral in the amount of $79, 747.00 to Shiloh, Inc. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a portion of collateral, in the amount of $79, 747.00, held by Letter of Credit #744, drawn on the First Interstate Bank of Fort Collins, N.A. , P.O. Box 578, Fort Collins, Colorado 80522-0578, in the total amount of $292,370.00, be, and hereby is, released. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 26th day of October, A.D. , 1994. The improvements agreement provided for partial release of the collateral. Mr. James Scott, Shiloh, Inc. in his letter of September 30, 1994, has requested partial release of collateral in the amount of$79,747.00, for completion of the gas service, survey, street monuments, landscaping, engineering and supervision. The total amount secured for these items was $93,820.00. The amount requested to be released reflects the 15% to be retained for warranty, as provided for in the collateral agreement. The Department of Planning Services Staff requests that the Board approve the requested partial release of collateral in the amount of$79,747.00.
