RE: APPROVE CANCELLATION OF UNCOLLECTIBLE LEASEHOLD TAXES OF VARIOUS YEARS FOR
PIEDMONT EXPLORATION IN THE AMOUNT OF $46,327.04
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Francis M. Loustalet, Weld County Treasurer, has submitted a list
of leasehold taxes, assessed for various years for Piedmont Exploration, deemed
to be uncollectible, said list being attached hereto and incorporated herein by
reference, and
WHEREAS, Francis M. Loustalet has certified to the Board that he has
exhausted all means for collecting said leasehold taxes, and
WHEREAS, Section 39-10-114(2) (a) , CRS, as amended, provides that any taxes
levied on leaseholds which are determined to be uncollectible after a period of
six (6) years after the date of their becoming delinquent, may be cancelled by
the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the leasehold taxes assessed for the various years for
Piedmont Exploration, as set forth in detail in the list submitted by the Weld
County Treasurer, in the amount of $46,327.04, be designated as uncollectible
and, therefore, are cancelled in accordance with Section 39-10-114(2) (a) , CRS,
as amended.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 1st day of April, A.D. , 1992.

Subject: Cancellation of Delinquent Leasehold Taxes
Please furnish the County Treasurer with a resolution authorizing the County
Treasurer to cancel the different years of leasehold taxes for Piedmont
Exploration.
A copy of the taxes are attached.

RE: Piedmont Exploration Accounts
Dear Commissioners :
As you are aware that Piedmont Exploration filed bankruptcy several years ago.
The owner and president of the company, Mr. Saunders, has since died.
Piedmont Exploration oil wells have been plugged and abandoned. Weld County had
no information as to what the wells actually produce. The taxes on the said
wells are noncollectible since there are no assets such as equipment to distrain
or seize to satisfy the taxes .
It is my opinion that the taxes should be canceled according to 39-10-114(2) (a)
C.R.S . as amended.
