U.S.R. 44 :85:17 was adopted in June 1985 and the Weld County Planning Services staff has determined the changes requested in this Application are a material deviation from the original permit. r The following information corresponds to the numerical Application requirements in the Procedural Guide: 1 . A COMPLETED APPLICATION FORM IS ATTACHED. 2 . A DETAILED DESCRIPTION OF THE PROPOSED OPERATION AND USE SHALL BE SUPPLIED. DETAILS FOR THE FOLLOWING ITEMS, WHEN AP- PLICABLE, ARE REQUIRED. ' a. EXPLAIN PROPOSED USE. The Applicant is requesting an amendment to its presently existing Use by Special Review Permit 44 : 85: 17 which allows the Applicant to operate a commercial table-egg production complex as approved on the plot plan. The proposed amendment would allow the Applicant to complete the infrastructure necessary to operate the facility. See the attached map which delineates the existing structures and proposed structures. When completed, there will be capacity for 2,000,000 birds on Applicant' s property. The total bird population is not an Weld County Sectember 3 , 1991 Pa=e 2 increase from the existing Use by Special Review Permit. Additionally, the Applicant would like to construct 90,000 square feet of greenhouses for the purpose of growing vegetables. b. EXPLAIN NEED FOR USE. The Applicant is the principal supplier for a multi-state region for Safeway stores and several food distributors including McDonald' s and Nobel/Sysco (a food distributor) which serve Colorado ar_f the mountain states . Their current production averages around four million eggs each week (330 ,000 dozen) . These eggs come from approximately 840 ,000 chickens . In addition to the 28 egg production houses there are six brooder houses located in the southeast ccrner of the property. The Applicant feels that opportunities exist for the production of vegetables and that this use would complement the current egg operation. C. EXPLAIN THE TYPES CF EXISTING USES ON SURROUNDING PROPER- TIES. The surrounding uses are agricultural and compatible with Applicant ' s egg production facility. d. THE DISTANCE OF TEE PROPOSED USE TO RESIDENTIAL STRUC- ' TURES IN EACH DIRECTION. 1 . South. 200 ' to 300 ' to Sarchet family residence. 2 . West. A mile to a mile and a half on Weld County Road 32 to a residence. 3 . North. More than a mile to a residence on Weld County Road 36 . 4 . East. Five residences ranging from 1/4 mile to 1/2 mile distance from this Special Use Permit area. e . THE MAXIMUM NUMBER OF USERS, PATRONS, MEMBERS, AND BUYERS. There are approximately three customer tricks (semi- trucks) that pick up eggs each day. Any remaining waste is mixed with wood shavings (85% shavings and 15% poultry waste) and sold as compost. The existing land uses surrounding the Applicant' s property are predominantly three activities: (1) field crops (corn, alfalfa, and wheat) ; (2) cattle feeding; (3) natural gas production and (4) turkey farm. In fact, Morning Fresh Farms engages in three of these activities; alfalfa , wheat and gas , using to gas in the egg / operations and selling the alfalfa . The surrounding farms and businesses are not only s:srilar and compatible with the Applicant' s activities , but are directly benefited and complemented by the poultry farm. The Applicant buys grain from local farmers and sells alfalfa hay and manure to them. The propcsed use is merely an expansion of the already existing and operating facility. The surrounding uses, therefore , would be just as compatible with the Applicant as they are now and would benefit even more by increased purchases of grain. A description of all existing land uses adjacent to the property is as follows : All surrounding land uses of propert. in the immediate vicinity are agricultural in nature with some residences connected with the agricultural uses . f . EEV1r2fn tion Services subject: A-1 Organics Composting Proposal In response to your request for evaluation of the A-1 Organics proposals, I am submitting the following comments. . With regard to the regional composting facility, my evaluation of the Solid Waste Disposal Sites and Facilities Act and subsequent regulations indicates that a Certificate of Designation would be required for a regional composting facility. My conversations with the State Health Department personnel have led me to believe that the State would assume that position also. In July of 1990, the State Health Department Solid Waste Division developed a set a guidelines for Composting Facilities (a copy is attached for your information) . I think that you will find that these proposed regulations address a wide variety of aspects associated with the composting facilities. My view of disposal of ones own waste on ones own property is much more narrow then appears to be interpreted by A-1 Organics. The general criteria for disposing of ones own waste on ones own property is generally restricted to the fact that the waste is generated by that facility, at that location, and not transported off site. The waste is then treated or disposed of in a manner in compliance with the Solid Waste Disposal Sites and Facilities Act and Regulations by the owner of the property, on that property, and no other material is brought in to that site from an off-site location. Neither of the proposals from A-1 Organic appear to fall into that criteria, and therefore my interpretation would be that both of these facilities would be treatment and disposal of waste from an off-site location and would therefore require a Certificate of Designation pursuant to the State Statutes. It is my opinion that any composting facility operating within Weld County should have to meet a minimum set of criteria in order to preserve and protect the environment and not be a nuisance source that could adversely effect the area or the residents who live adjacent to the facility. The following is a list of specifications that I feel would be important to consider in siting a composting facility within Weld County. 1. The facility should be required to provide some kind of protection so that leachates do not infiltrate through the surface of the ground beneath the compost piles and contaminate any groundwater table which may exist below the facility. This could be some kind of a clay-lined working area or a facility which has a synthetic liner lying underneath a blanket of sand protected by an asphalt work area. Another alternative would be to find a suitable geologic location where no ground water table would exist within a hundred feet of the surface of the ground and geologic structures are sufficient to preclude the transportation of any leachate material from the surface below into the subsurface area. r A-1 Organic Composting Proposal December 18, 1991 Page 2 2. The facility should be designed and operated in a manner so as to prevent nuisance conditions and not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant run-off. 3. The facility should be sufficiently designed so as to control run-on and run-off of any precipitation and/or flood waters which would be associated with a significant precipitation event. All run-off which is accumulated on the site should be diverted to a lined containment pond and the contaminated water should be disposed of in a manner which protects against contamination. Probably the best method of disposal would be to incorporate the polluted water into the compost piles as method of disposal. The facility should also be protected by a berm around the outside of the facility so that flood waters cannot run onto the facility and commingle with the polluted waters associated with the composting facility itself. 4. The facility should be designed and operated in manner that will assure that no hazardous materials are handled at the facility and that all materials received at the facility are free from contamination from hazardous materials. 5. The facility should be operated in a manner that would control any fugitive dust, blowing debris, or other potential nuisance conditions that might be carried off site and negatively impact adjacent landowners or residents. I strongly support the development and operation of composting facilities within Weld County. Composting is a very desirable procedure which can reduce organically based waste materials into a material that is highly desirable from any agricultural standpoint. Composting is one of the most important procedures which can be utilized to reduce the total volume of waste that is being transported to solid waste disposal facilities. They can be operated in a manner that would not have a negative impact on the environment or to adjacent landowners and residents. Caution should be utilized in assuming that composting is in the end-all process for handling solid waste problems. Frequently, composting facilities, if improperly operated, can deteriorate to a situation that yields a tremendous amount of odor and nuisance conditions, plus significant contaminants to the ground water table in the form of leachates if not controlled. One very significant problem associated with composting is that, in the case of waste materials which have high metal concentrations, heavy metals can be further concentrated by the composting procedure and can have a significant contamination effect on any leachates that may be produced at the site. However, if properly operated, composting facilities can be a very desirable method of solid waste disposal within the front range area. In my recent involvment with metropolitan Denver municipalities through the Denver Regional Council of Governments, the sincere interest fo'- alternate disposal of yard waste is unquestionable however the financial and personnel resources are limiting! . This facility could provide an economically feasible operation for any Front Range community for organic recycling that otherwise might not be affordable. A composting operation such as this would enable the 36 government communities in the "front range" to get an organic recycling program started without any significant capital expenditure. For most of the smaller suburban communities, such an expenditure for a project would not be feasible even if the funding were available. My question is would such a facility for a pilot operation be possible for A-i Organics under the roving composting permit within Weld County without the need of a separate USR or certificate of designation? No estimate of total water requirement was submitted. Before we can determine the adequacy of the supply we need an accurete estimate of the anticipated demand on a year round basis. The proposed water supply is to be from a number of existing wells. Before we can comment on the adequacy of the water supply the applicant needs to provide a response to several concerns. The proposed water supply includes several alluvial wells decreed in Water Court Case number W-5832, in 1976. These wells have a junior priority on the South Platte River drainage and cannot operate without a Water Court approved plan for augmentation or approved replacement plan. We understand that these wells currently operate under the GASP substitute supply plan. The applicant has purchased one replacement unit. In a letter to the County dated June 26) 1985, we commented.that "No further expansion beyond 1,000,000 chickens is recommended until such time as the applicant obtains other sources of water, and the proposed water supply needs of both the existing- operation and proposed expansion are submitted to this office for our review and comments. Additionally the wells are decreed and permitted for irrigation, stock watering, domestic or commercial use or a combination of uses. Each well must be used only for its decreed or permitted use. If the well is to be used for a use other than that stated in the decree and well permit, then a new well permit is required. Page 2 Lanell J. Swanson September 19, 1991 The proposed water supply also includes several wells in the Laramie Fox-Hills aquifer in an area where 4 % of diversions must be replaced. We have no record of a replacement plan. Each of the wells supplying water to this facility requires a totalizing flow meter. We request that the applicant submit a sketch indicating the well location on the property and show the appropriate well permit number and meter reading. Until the items discussed above are adequately addressed, we connot comment on the adequacy of the water supply. We recommend that this proposal be held in abeyance until the items above are satisfactoraly resolved.
